NOTICE OF CLAIM
Bruce Rutz of 1734 Central A venue, Apt. 2-C, Dubuque, lA, 5200 I, hereby makes claim against
the City of Dubuque for injuries sustained on Sunday, January 9,2005.
On the above date at approximately 600 p.m., Bruce Rutz was a pedestrian on the city sidewalk
owned by the City of Dubuque, immediately adjacent to and in frollt of the private parking lot on
the east side of Central Avenue. The sidewalk was slippery, icy, defective, and dangerous and it
caused Bruce Rutz to slip and fall. The location of the fall is just north of the entry to Liberty
Tax Service, 1736 Central Avenue, Dubuque, lA, 52001.
Bruce Rutz laid on the sidewalk where he fell for about 20 minutes before he was discovered and
transported by ambulance to the hospital. He suffered serious permanent injuries to his right
arm, shattering the ball of the right humerus, requiring surgery to repair his injuries. He will
have a significant scar and deformity to his right shoulder, significant permanent injuries, and he
was caused to suffer considerable pain. He has been unable to pursue his normal employment,
and the length of his disability from employment is unknown at this time but believed to be in
excess of 4 months or more.
Consequently, the economic and personal damages and losses including medical bills and other
medical expenses are well in excess of$100,000.00.
Claim is hereby made against the City of Dubuque accordingly
