(1976 Code, fi 111/,-127) Secs. 15.38-15-45. Reserved: ARTICLE IV. COMMUNITY DEVELOP- MENT ADVISORY COMMISSION Sec. 15.46. Created; Composition: There is hereby created a community develop- ment advisory commission whose primary pur- pose shall be to provide for citizen participation in the development and evaluation of the city of Dubuque's community development block grant ("CDBG") program. The commission shall comprise nine (9) mem. bers; four (4) members shall be residents of census tracts and block groups where at least fifty one percent (51%) of the residents are low/moderate income persons as determined by the United States department of commerce, bureau of the census; four (4) members shall be residents of the community at large; and one member shsn be that member of the housing commission designated by the housing commis- sion. (Ord. 83-92, 11-2-1992; Ord. 88-95, fi 5, 12-18-1995, eIT. 1-1-1996; Ord. 42-2003, ~ 1. 5.19-2003) Sec. 15-47. Application And Appointment Process: The process of appointment to the commission by the city council shall include at least the following elements: (1) Submission of an application form con- taining the requested information on the qualifications and expectations of the applicant; and (2) Notice to and an opportunity for the general public to comment, in writing, on the qualifications of each applicant; and Supp. No. 59 (3) A formal interview by the city council to determine the applicant's qualifications and ability to serve sITectively on the commission. Individuals who, by their professional or personal experience or interest, are knowledge... able of the development needs of the community at large and of low and moderate income per- sons in particular sball be considered qualified to serve on the commission, subject to city coun- cil review and consideration of other applicable information. (Ord. 83.92, 11-2.1992) Sec. 15.48. Term; Filllnc Of Vacancies; Compensation: The term of office for a commission member shall be three (3) years except as set forth be- low. The initial terms of the commission shall be as follows: (1) For each of the five (5) residents of the five (5) census tracts with the lowest median household income as determined by the U.S. department of commerce, bureau of the census; one shall be ap- pointed for an initial term of one year, two (2) shall be appointed for an initial term of two (2) years; two (2) shall be appointed for an initial term of three (3) years. (2) For the three (3) community at large residents; one shall be appointed for an initial term of one year, one shall be appointed for an initial term of two (2) years, and one shall be appointed for sn initial term of three (3) years. (3) For the one member of the housing com. mission designated by the housing com- mission, the initial term shall be one year. A commission member may be removed at any time with or without cause by a vote of two- thirds ('/3) of all members of the city council. 941 ~ 15.48 DUBUQUE CODE e A vacancy occurring on the commiSSIon caused by resignation or otherwise, shall be filled by appointment of the city council for the remainder of the unexpired term. Members of the commission shall serve with- out compensation except for actual expenses, which shall be subject to approval by the city council. (Ord. 83-92, 11-2-1992) Sec. 15-49. Duties And Re8ponsibilities; General: The commission shall have the following duties and responsibilities: (1) To conduct public hearings in accordance with the minimum standards established in the CDBG program's citizen participa- tion plan to ensure meaningful citizen input in the planning, implementation and assessment of the city's CDBG pro- gram; (2) To provide for and encourage the partici- pation of low and moderate income per- sons who reside in designated areas of slum and blight and residents of low and moderate income neighborhoods, BS de- fined by the city council, in the planning, implementation and assessment of the CDBG program; (3) To identify community development needs, particularly the needs of persons of low and moderate income; (4) To serve in an advisory role upon the request of the city council in policy deci- sions regarding funding priorities and program development and implementa- tion; (5) To monitor and evaluate program activi- ties to advise whether identified commu- nity development objectives h8ve been met; (6) To undertake public information efforts to educats the citizenry of the availabili- Supp. No. 59 ty of CDBG funded programs and to provide for a greater understanding of the city's community development ef- forts; (7) To assist in the preparation of the stste- ment of community development objec- tives and projected use of funds, amend- ments thereto and required reports in- cluding, but not limited to, the annual grantee performance report (GPR) and the annual comprehensive housing 8ssis- tsnce strategy (CHAS); (8) To serve in an advisory role to the city manager in the review of complaints and grievances received in accordance with the procedures established in section 15-52 of this article; and (9) To support, upon request, the efforts of the city council and other city commis- sions in the assessment of the general development needs of the community. e The city council shall have the authority to establish or revise the priorities of the commis- sion. Appeals to the board of adjustment may be taken by any person aggrieved or by any officer, depart- ment, board, or bureau ofthe municipality affected by any decision of the administrative officer. Such appeal shall be taken within a reasonable time as provided by the rules of the board by filing with the officer from whom the appeal is taken and with the board of adjustment a notice of appeal specifying the grounds thereof, The officer from whom the ap- peal is taken shall forthwith transmit to the board all the papers constituting the record upon which the action appealed from was taken. An appeal stays all proceedings in furtherance of the action appealed from, unless the officer from whom the appeal is taken certifies to the board of adjustment after the notice of appeal shall have been filed with the officer that by reason of facts stated in the certificate a stay would in the officer's opinion cause imminent peril to life or property. In such case proceedings shall not be stayed other. wise than by a restraining order which may be 3280 granted by the board of adjustment or by a court of record on application on notice to the officer from whom the appeal is taken and on due cause shown. To hear and decide appeals where it is al- leged there is error in any order, requirement, deci- sion, or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto, 2. To hear and decide special exceptions to the terms of the ordinance upon which such board is required to pass under such ordinance. 3. To authorize upon appeal in specific cases such variance from the terms of the ordinance as will not be contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the ordinance will result in unnec- esaery hardship, and so that the spirit of the ordi- nance shall be observed and substantial justice done. In exercising the above.mentioned powers such board may, in conformity with the provisions of this chapter, reverse or affirm, wholly or partly, or may modify the order, requirement, decision, or de- termination appealed from and may make such order requirement, decision, or determination as ought to be made, and to that end shall have all the powers of the officer from whom the appeal is taken. . I have worked with Janice since last October when we met at a Community Development Advisory Commission meeting. Since then, she has been an active participant in the development of a multicultural center in the Washington Neighborhood area. She has also been working collaboratively with Jerelyn O'Connor to develop a neighborhood association in the Washington area to help address the issues of vandalism, safety and crime in her neighborhood. She is eager to help this community grow and develop into a safe and welcoming place for everyone. I believe her involvement on the Community Development Advisory Commission would add a new and needed perspective, which the commission has expressed a need for in recent months. Two current Commissioners have contacted me hoping I would be able to encourage diverse, female citizens of Dubuque to apply. Being an African American woman who is reasonably new to the community, Mrs. Craddieth will be able to express the needs of the minority population she lives in community with. I feel she will be a valuable addition to the CD Advisory Commission. I am sure the other applicant for the CD Advisory Commission is just as capable, but due to the current makeup of the CD Advisory Commission (8 males and I female), he lacks the diversity this commission is seeking.
