Van Milligen, City Manager SUBJECT: Ordinance Amendment - Adding New Subsection 32-231 (d) Adopting Scheduled Fines provided in the Iowa Code for Speeding Violations Chief of Police Kim Wadding recommends City Council approval of an amendment to Code of Ordinances 32-231 to allow electronic entry of the fine, court costs, and bond amounts regarding the violation of speed. This capability is now available with the update to the patrol vehicles' mobile data terminals. This will save time and increase accuracy. Wadding y(j) Police Chief ~ Re: Ordinance Amendment - Adding New Subsection 32-231 (d) Adopting Scheduled Fines provided in the Iowa Code for Speeding Violations INTRODUCTION: The purpose of this memorandum is to request the amendment of Code of Ordinances 32-231 - Limits Generally to add subsection (d) Listing of Scheduled fines. BACKGROUND: Recently the police department updated the patrol vehicles mobile data terminals. The update expands our use of the Iowa Department of Transportation TraCS (Traffic and Criminal Software) system. Patrol officers use TraCS to electronically gather vehicle and personal information and scan or keystroke the information into the mobile data terminal causing the information to auto populate into the electronic versions of our police reports and citations. Using electronic means to transfer information saves officer time and reduces the likelihood for error. DISCUSSION: The proposed amendment to Code of Ordinances 32-231 adds subsection (d) outlining the speed fines for each category, giving each category a corresponding number for computer entry purposes. When the officer enters the corresponding number the mobile data terminal auto populates the information into the appropriate portions of the citation and automatically calculates and enters all current court costs and bond amounts. Currently, this portion of the citation is hand written increasing officer time and the possibility for error. Bill Blum, City Solicitor, wrote the modification to the ordinance. RECOMMENDATION: Having the ability to electronically add the fine and related costs on the police citation streamlines our data entry reducing officer time and error. I recommend the addition of subsection (d) to Code of Ordinances 32-231. . , ACTION REQUESTED: Request City Council consideration of adding subsection (d) to Code of Ordinances 32- 231 to allow electronic entry of the fine, court costs, and bond amounts regarding the violation of speed. IA 52001 Telephone: (563) 557-1310 ORDINANCE NO. 7-0 5 AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING A NEW SUBSECTION 32-231(d) ADOPTING THE SCHEDULED FINES PROVIDED IN THE IOWA CODE FOR SPEEDING VIOLATIONS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City of Dubuque Code of Ordinances 32-231 is amended by adding a new section 32-231 (d) as follows: (d) Scheduled fines are established pursuant to Iowa Code Section 805.6(6). Excessive speed in zones 55 mph or less (1) 1 through 5 over (2) 6 through 10 over (3) 11 through 15 over (4) 16 through 20 over (5) Over 20 mph over (plus $2 for each mile in excess of 20 mph over limit) Excessive speed in zones greater than 55 mph (6) 1 through 5 over (7) 6 through 10 over (8) 11 through 15 over (9) 16 through 20 over (10) Over 20 mph over (plus $2 for each mile in excess of 20 mph over limit) Section 2.
