Dear Mayor and City Council Members: INTRODUCTION The Historic Preservation Commission has reviewed the application of Downtown Neighborhood Council/Dave Stuart for funding from the Historic District Public Improvement Program to install decorative fence/rail, brick sidewalks, and retaining walls at 1105,1145,1389, and 1470-1472 Locust Street and 1323-1325 Bluff Street in the Jackson Park Historic District. The application and staff report are attached for your information. DISCUSSION Chairperson Dave Stuart excused himself from the table, indicating that he would abstain from the vote because he is representing the Downtown Neighborhood Council. Vice Chairperson Chris Olson presided. Mr. Stuart presented the application to the Commission. He indicated the application is for the installation of decorative fence/rail, brick sidewalks, limestone step, and retaining walls at five locations in the Jackson Park Historic District. He indicated that at 1105 Locust Street, the proposal is for continuation of the brick paver sidewalk previously approved and funded under the HDPIP program. He explained that at 1145 Locust Street, the proposal is for installation of the same brick sidewalk pavers and a limestone step to match the new sidewalk grade. He said the proposal for 1389 Locust Street is to install a brick sidewalk. He indicated that at 1470- 1472 Locust Street, a brick sidewalk was previously approved and funded under the Service People Integrity Responsibility Innovation Teamwork Historic District Public Improvement Program Page 2 HDPIP program. He said the current HDPIP proposal for this property is to install a retaining wall with a decorative fencelrail that would match a wall with a decorative fence as shown in a historic photo submitted with the application. He reviewed the proposal for 1323-1325 Bluff Street is to install a brick sidewalk and a retaining wall similar to the one proposed at 1470-1472 Locust Street. Mr. Stuart reviewed how the HDPIP funding for the sidewalks was calculated based on the additional cost for brick sidewalk over standard concrete, and the HDPIP funding for the limestone step and retaining walls with decorative fence/rail was based on the 3:1 split for the entire cost. He explained that the retaining walls would be constructed in the public right-of-way, with a written waiver from the Engineering Department. Staff Member Carstens reviewed the staff concerns with funding the limestone step and retaining walls with decorative fencelrail under the HDPIP program, since these improvements would be of private benefit but not public benefit. Staff Member Wernimont explained the staff's suggested budget for the project, to fund just the brick sidewalks. He added that the retaining walls with decorative fence/rail are eligible expenses for the Historic Preservation Revolving Loan Fund, even if installed in the public right-of-way so long as permission is obtained from the Engineering Department. The Commission discussed the application. They discussed the grade changes between the existing sidewalks and the new brick sidewalks. They debated the inclusion of the retaining walls and fencing in the HDPIP program. RECOMMENDATION By a vote of 7 to 0 with one abstention by Chairperson Stuart, the Historic Preservation Commission recommends that the City Council approve the project as submitted. Bya vote of 6 to 0 with two abstentions by Chairperson Stuart and Commissioner Olson, the Historic Preservation Commission recommends that the City Council approve $24,346.95 in HDPIP funds for the installation of brick sidewalks at 1105 Locust Street, 1145 Locust Street, 1389 Locust Street, and 1323-1325 Bluff Street. Project Summary. Discuss the project and the key project work elements of the proposed streetscape improvements. Project will replace existing gray portland cement sidewalks with new brick (vitrified clay) meeting current industry standards for pavers, Individual abutting property owners electing to replace their sidewalks are responsible for all matching funds requirements, With the sidewalk replacement, the width of the "planting lawn" (the grass area between the curb and the sidewalk) may be modified to allow for more green space and landscaping components (refer to individual site plans for modification details), The brick sidewalks will be installed by a contractor on the current city's list ofapproved sidewalk contractors using a proposed "construction standard". Abutting property owners are free to chose the color of brick as well as the pattern of the sidewalk, Property owners have chosen to use either Robinson Brick's tumbled clay pavers in the Santa Fe color, or Pine Hall brick "rumbled" pavers. A herringbone pattern matching surviving examples of pavers and patterns historically used in sidewalks in Dubuque has also been chosen by property owners, Two properties (four individual lots) (1323 & 1325 Bluff Street, and 1470 & 1472 Locust Street) will also add a short retaining wall per historical documentation of 1470 & 1472 Locust Street. Owners may perform some of the installation work as in-kind contributions to reduce their out-of-pocket expenses. Projects are planned to be start in the Spring and be complete by the end of the Summer of 2005 B. Neighborhood Impact and support. Describe the current conditions and how the project will improve the neighborhood and/or project area. Discuss the level of neighborhood and property owner support. Dubuque's Streetscape and Landscape Guidelines for the Jackson Park Historic District recommend "materials for new sidewalks and crosswalks that are consistent with the historic materials, such as brick pavers. . . ", and further states that "It is currently City policy to remove and replace these (historic sidewalk materials such as brick) materials during new construction, either with broom finish poured concrete or, more recently, stained concrete pavers or stained and stamped concrete. Preservation and replication of any of the historic masonry materials for sidewalks would be appropriate in the Jackson Park District and adjacent neighborhoods, and is the recommended treatment." Currently the City has no "construction standard" for brick paver sidewalks. The City does have a standard for Portland Cement Concrete sidewalks and requires, per its Sidewalk Inspection Policy, that defective sidewalks be replaced per that standard. That effectively precludes a property owner from installing a historically appropriate brick sidewalk in public right of way. Members of the Downtown Neighborhood Council have produced a construction standard titled "BRICK SIDEWALKS, DRIVEWAYS, HANDICAPPED RAMPS, STREETS AND ALLEYS". That standard is based on current industry practices and will produce a sidewalk that is not only historically appropriate but will last many decades without problems. This standard has been used to recently install the new sidewalks and ADA ramp at 1105 Locust Street. HANDICAPPED RAMPS. STREETS AND ALLEYS Descriotion. This work shall consist of removal, and disposal of existing Portland Cement Concrete sidewalks, driveways and handicapped ramps and construction and/or repair of brick sidewalks, driveways, handicapped ramps, streets and alleys according to the plans and these specifications. Materials. Materials used shall conform to the following:, A. Brick oavers. Vitrified clay paver shall conform to the requirements of ASTM C902, Class SX, Type I, Application px. The units shall be standard 4" x 8" size having dimensions onv." x 4" x 8" (including spacer nibs on the side), chamfered edges on both bed surfaces, 12,500 psi minimum compressive strength and below 6% cold water absorption. Dimensional tolerances around the mean values for length, width and depth shall be:t 1/16 ofan inch. Clay pavers conforming to the requirements of ASTM CI272, Type F, ApplicationPX with the units of the standard 4" x 8" size having dimensions of2 3/4" x 4" x 8" (including spacer nibs on the side), chamfered edges, 12,500 psi minimum compressive strength and below 5% cold water absorption shall also be acceptable. Color shall be as specified in the contract. B. Recvcled antiaue jlIlvers. Antique brick pavers closely matching existing pavers in size and shape, color and texture, and free of obvious defects shall be acceptable when used to repair existing brick streets, alleys and sidewalks. C. Beddina sand. Bedding sand, typically mason's or concrete sand, shall conform to the grading requirements of ASTM C33 or CSA A23.1 with no greater than 1% passing the 0.075mm (No. 200) sieve. (Stone dust or waste screenings should not be used as they have an excessive amount of material passing the 0.075 mm sieve. D. Joint sand. Joint sand shall conform to the requirements ofCSA A179. Alternately, bedding sand may be used. E. Base material. Aggregate base shall be of a "road bed" or "crusher-run" type crushed gravel material with W' top size and shall conform to the requirements of ASTM D 2940. F. Edae Restraints. Edge restraints may be of brick-stood-on-edge, pre-made plastic or metal, or troweled concrete with backfill. Pre.made plastic shall be of the type specifically designed to retain brick pavers. Removal of Sidewalks. Drivewavs and Handicaooed Ramos. The Contractor shall remove the sidewalks, driveways and handicapped ramps as shown in the contract document or designated by the Engineer. If only portions of sidewalks, driveways and handicapped ramps are to be removed, the boundaries of removal shall be made by a vertical cut not less than one inch (I") deep before breaking. Any areas of sidewalks, driveways and handicapped ramps not designated for removal but which are damaged by the Contractor's operations shall be removed and replaced by the Contractor without compensation. Construction. Construction of brick paver sidewalks, driveways and handicapped ramps shall meet the following requirements: Preparation of Subgrade. The subgrade upon which the brick paver sidewalks, driveways and handicapped ramps is to be placed shall be prepared by excavating or filling with suitable earth to such depth below the gradeline that when tamped or rolled smooth, firm and hard, the subgrade will be uniform and at the required depth below the finished gradeline. Soil shall be compacted to a minimum of95% density. All soft areas shall be removed and filled with suitable material which shall be thoroughly compacted in layers not exceeding six inches (6") in thickness. Geotextile Fabric. Geotextile fabric shall be placed under the base material and at the base/sand bedding interface if specified in the contract. Fabric shall be turned up against vertical surfaces to contain and prevent the migration of the base or bedding sand material. Preparation of Base. Base material shall be a minimum thickness of six inches (6") for sidewalks, and handicapped ramps and eight inches (8") for driveway areas. Base shall be compacted in maximum lifts six inch lifts to at least 95% density. The finished surface of the compacted base shall have a tolerance of +1- 3/8" over 10'. Any depressions shall be filled with base material and compacted. At a minimum, the base material shall extend beyond the pavement perimeter a distance equal to the depth ofthe base material. Sand bedding. Sand bedding shall be screeded to a consistent even thickness between one and 1-1/2 inches using the edge restraint or other suitable temporary forms. Any voids resulting from removal of temporary forms shall be filled with sand. Bedding shall not be compacted or further disturbed before placing bricks. Edge restraints. Edging may be added before or after laying the bricks depending on the brick pattern and type of edge restraint specified in the contract document. Brick-stood-on- edge type restraint shall be backfilled with base material after laying brick surface. Pre- made plastic edge restraint shall be restrained by 8" spikes hammered through pre-formed holes into the stone base. Laying the brick. Brick pavers shall be placed on the uncompacted bedding sand in the pattern specified in the contract. The edge restraint system may be adjusted a small amount as necessary to avoid cutting full bricks at edges. Ifnecessary, pavers shall be cut using a power saw with masonry blade. Bricks shall be spaced with a joint width of 1/16" to 3/16". Any individual bricks demonstrating a size variance which does not allow its placement with less than a 'I." joint width shall not be used. Any individual bricks with upper surface chips, depressions or other deformities which are more than 'I." deep and constitute more than 10% of the bricks surface shall not be used. Compaction. After the pavers are placed in the specified pattern they shall be compacted into the bedding sand with a plate compactor. After the initial compaction, bedding sand or joint sand shall be swept and vibrated into the joints between the bricks until full. Backfill. After the brick pavers have been placed and compacted, the spaces along the edges of the sidewalk shall be backfilled to the required elevation with approved material. The material shall then be loosely compacted as appropriate and the surface neatly graded. Disposal of Surplus Material. Surplus or waste material resulting from the construction operations shall be disposed of by the Contractor. General Reauirements: Transverse slope. A sidewalk shall be set with a transverse slope of the finished walking surface of ',4" per foot toward the curb unless otherwise directed by the Engineer. Gradient offill. The space between a sidewalk and the curb shall be graded with a gradient of approximately \1," per foot toward the curb if site conditions allow. Handicapped Ramps. Design for handicapped ramps constructed of brick and located on public property shall conform to the surface dimension requirements of concrete ramps. Any ramp design shall be coordinated with the City Engineering Department to ensure conformance with Americans with Disabilities Act requirements. Width of Sidewalks. The minimum width of a brick sidewalk on public property shall be 4'. A "tree relief' may encroach up to one foot into that minimum width. In the event that the site renders a 4' with impractical, City Engineering Department approval shall be obtained. Brick sidewalks may be constructed wider, the same width, or narrower than the sidewalk they replace. Horizontal alignment with abutting sidewalks. The side edges of brick sidewalks shall not be required to align laterally with other walks they abut. However, both of the side edges of the narrower sidewalk must fall at or within the side edges of the wider sidewalk. Vertical alignment with abutting sidewalks. The newly completed brick sidewalk shall align with the abutting sidewalk vertically within ',4" along the entire with ofthe abutment. ReDair of existing brick streets. alleys. sidewalks and ramDS. Existing streets, alleys, sidewalks and ramps shall be repaired using recycled antique or new brick that closely matches existing paving material. New brick shall conform the brick paver requirements. To the greatest extent practical, the repair shall conform to these construction standards. Damaged areas may be repaired without resetting the entire surface as specified in the Contract. Provisions for snow melt. Hydronic tubing shall be installed either within the base material or the sand bed as specified by the Engineer. 1flocated within the sand bed, the sand bed thickness may be increased to accommodate the tubing as specified by the Engineer. Deviations: Deviations from these standards are acceptable where site conditions preclude or render impracticalliterai compliance. Any deviations must be documented in writing and approved by the Engineer. City Engineering Department approval shall be obtained for any deviations on public property. The buildings located throughout the Jackson Park Historic District are primarily mixed use residential, commercial and office. The bulk of the Jackson Park Historic District is primarily residential. The right-of-way and sidewalks in the Jackson Park Historic District are both narrower than those found in the nearby commercial area downtown. Staff Analysis: The applicants are applying for funding from the Historic District Public Improvement Program for proposed streetscape improvements in the public right-of- way. The Downtown Neighborhood Council has proposed the installation of brick paver sidewalks at 1105/1145/1398 Locust Street and 1323/1325 Bluff Street. They are also requesting funding for an installation of a limestone step at 1145 Locust Street, and fence and retaining walls at 1323/1325 Bluff Street and 1470/1472 Locust Street As stated in the Historic District Public Improvement Program application form, individual property owners are not eligible to apply for funding. The Downtown Neighborhood Council endorses the project. $51,312.60 $32,464.95 $18,847.65 63.27% Design Review Staff Report - Downtown Neighborhood Council Page 2 Staff Comments: The Planning Staff and Engineering Staff have reviewed the application. Staff questioned the use of the HDPIP funds to finance the installation of the retaining walls, fences and limestone steps. Staff felt that this would be an improvement that would primary benefit the property owner and not the public. Staff felt that this may lead to a precedent for more property owners to request fences and retaining walls to be built in the public right-of-way with HDPIP funds. Staff believes these improvements provide a private benefit, and the public does not receive any benefit from these retaining walls, fences and limestone steps. The public does fully benefit from the brick paver sidewalks, and so staff recommends that the HDPIP funds be used to cover the cost of the sidewalk improvements only. Staff noted that the retaining walls, fences and limestone steps can be placed in the public right-of-way at the owner's full expense after receiving written approval from the Engineering Department to build in the public right-of-way. The following table shows the cost breakdown for the request if the following costs are removed from the original request: . $5,412 for retaining wall and fence and $100 for waiver to build in the public right-of-way at 1323/1325 Bluff Street. . $5,412 for retaining wall and fence and $100 for waiver to build in the public right-of-way at 147011472 Locust Street. . $800 for limestone step at 1145 Locust Street. Total Proiect Cost $39,488.61 Total Grant Reauest $23.596.96 Total oro owner's share $15,891.65 Grant to total cost 59.76% The role of the Historic Preservation Commission in reviewing this project is to serve as an advisory design review body to the City Council for review of public works projects which have historic preservation implications in historic districts. The Commission is also responsible for providing a recommendation to the City Council about funding projects from the Historic District Public Improvement Program. The Commission's recommendation will go on to the City Council with the application materials for their review and approval of the project. Compliance with Design Guidelines: In 2002, the Streetscape and Landscape Guidelines were created to help provide recommendations for public improvements in the public right-of-way.
