ORDINANCE NO. 54-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT NORTHWEST
CORNER OF 26TH AND PINARD STREET FROM R-2 TWO-FAMILY
RESIDENTIAL DISTRICT TO R-2A ALTERNATE TWO-FAMILY RESIDENTIAL
DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:

Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from R-2 Two-Family Residential District to R-2A Alternate Two-Family Residential
District, to wit:
Lot 283 and Lot 284 Glendale Addition No.3, and to the center line of the
adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that the Zoning Board of Adjustment has
approved a conditional use permit for an employee parking lot subject to approval of this
rezoning request. Staff reviewed surrounding land use and zoning.
The Zoning Advisory Commission discussed the request noting that the proposed rezoning
will enable Klauer Manufacturing Company to provide additional off-street parking which will
benefit the neighborhood.
Recommendation
Bya vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property is currently vacant, but most recently was
used as a site for a large storage tank.

Physical Characteristics: The subject parcel has frontage on both Pinard Street and
26th Street. The property slopes generally to the west and is separated from Klauer
Manufacturing's main site by the North End Neighborhood Trail.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate a land use for this area.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: There are no traffic counts available for either Pinard
Street or 26th Street in this area.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff do not anticipate any adverse impact to the environment
provided adequate erosion control is provided and storm water is adequately
handled.

Adjacent Properties: If the subject parcel is adequately screened, adjacent
residential property should not be significantly impacted. If approved, a new
parking lot will have the benefit of providing additional off-street parking in an area
where it would be beneficial.

CIP Investments: None proposed.
Staff Analysis: Klauer Manufacturing Company is proposing rezoning of the subject
parcel at the northwest corner of E. 26th Street and Pinard Street. The parcel is
approximately 10,500 square feet in size, and will be used for the off-street parking of
employee vehicles. The proposed rezoning to R-2A Alternate Two-Family Residential
would represent an expansion of an existing zoning district as the adjacent property to
the southwest is zoned R-2A, which is the site of a Klauer Manufacturing parking lot.
The Zoning Advisory Commission recommended that Klauer Manufacturing pursue a
rezoning request to R-2A and then apply for a conditional use permit from the Zoning
Board of Adjustment, rather than seeking a rezoning to Light Industrial. The
Commission believes that rezoning to an R-2A designation is more appropriate, given
the residential character of the surrounding property, and that the list of allowed uses
for the R-2A District would not allow any future use of the property for industrial
purposes.
Screening required by the Zoning Ordinance for parking lots adjacent to residential
properties is three (3) feet in height with 50% opacity within three years of planting.
Staff recommend that the Zoning Advisory Commission review Section 6-1.1 of the
zoning Ordinance that establishes criteria for review of rezoning requests.
