ORDINANCE NO. 55-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY PROVIDING FOR THE
AMENDMENT OF ORDINANCE 41-92 WHICH ADOPTED REGULATIONS FOR
THE HILLCREST FAMILY SERVICES INSTITUTIONAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances and Ordinance 41-92 be amended by adding classrooms as a permitted
use for the following property, to wit:
All of Lot 2 of Lot 2 of Lot 1 of Lot 1 of Link's Subdivision except the southeasterly
38 feet thereof, Lot 2 of the Subdivision of Lot 1 of Lot 2 of Mineral Lot 261; Lot 1
of the Subdivision of Lot 1 of Lot 2 of Mineral Lot 261, Mette I Link Place; Lot 2 of
Lot 2 of Lot 1 of Lot 2 of Lot 1 of Lot 1 of Link's Subdivision; Lot 1 of Lot 1 of Lot 2
of Lot 1 of Lot 1 of Lot 2 of Lot 1 of Lot 1 of Link's Subdivision; and Lot 1 of Lot 1
of Lot 1 of Lot 1 of Lot 1 of Lot 2 of Lot 1 of Lot 1 of Link's Subdivision; Lot 1 and
Lot 2 of Peterson's subdivision; all of Lot 2 of Lot 2 of Lot 1 of Lot 1 of Link's
Subdivision except for the southeasterly 38 feet thereof, and to the center line of
the adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. That in order to accomplish the purposes of the 10 Institutional District
and of the Zoning Ordinance, the above described property is subject to the following
conditions and restrictions:
A. Use Regulations
The following regulations shall apply to all uses made of land in the
above described 10 Institutional District:

B. Lot and Bulk Regulations.
Development of land in the ID Institutional District shall be
regulated as follows:
1) All building structures and activities shall be located in
conformance with the attached amended conceptual
development plan.
2)
A minimum front yard setback of 25 feet is required for all
structures.
3) All final site development plans shall be approved in
accordance with the ID Institutional District regulations as
provided in the Zoning Ordinance of the City of Dubuque,
Iowa.
C. Performance Standards
The development and maintenance of uses in this ID Institutional
District shall be established in conformance with the regulations of
Section 3-5.2 of the ID Institutional District.
D. Site Development Standards
The site development standards for this ID Institutional District
shall be established as follows:
1) Landscaping and screening requirements shall be
established in accordance with the requirements of Section
4-5 of the Zoning Ordinance of City of Dubuque, Iowa. All
other site development standards of Section 4-4 shall apply.
2)
All portable classrooms located in this ID District shall be
removed by Hillcrest Family Services no later than June 30,
2003.

E. Sign Regulations
The sign regulations shall be the same as that which are allowed
for 10 Districts in Section 4-3.11 of the Zoning Ordinance of the
City of Dubuque, Iowa.
F. Parking Standards
The off-street parking requirement for the principal permitted uses
for the herein described 10 Institutional District which are
designated by a bracket enclosed number next to the use shall be
as described in Section 4-2.7 of the Zoning Ordinance of the City
of Dubuque, Iowa, but in no case less than shown on the
conceptual plan adopted by the City Council on June 1, 1992.
G. Transfer of Ownership
Transfer of ownership or lease of property in this 10 Institutional
District shall include the transfer or lease agreement, the provision
that the purchaser or leasee acknowledges awareness of the
conditionals authorizing the establishment of the district.

Description: To amend the 10 Institutional District to add classrooms as a permitted use and allow the
installation of a portable classroom.
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating that there is normally sufficient off-street
parking for staff and employees; however, the recent renovations have increased demand for parking
due to construction workers' vehicles and equipment. Several neighbors spoke with concerns
regarding the number of vehicles parking on Wilbricht Lane and the use of that street for bus loading
and unloading. Staff reviewed the history of the Institutional District for Hillcrest Family Services and
noted that approving the proposed amendment would allow the portable classroom to remain longer
than the one year allowed under the Temporary Use section of the Ordinance.
The Zoning Advisory Commission discussed the request noting that the renovation project will be
completed this year and that the organization should be able to add permanent classroom space in
about two years.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the
request with one condition; the condition recommended by the Commission is that the portable
classrooms be removed by June, 2003 (the Ordinance specifies June 30,2003).
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The Zoning Advisory Commission reviewed a request from Hillcrest Family Services at
their May 3rd meeting to amend their institutional district to add classrooms as a
permitted use and allow the installation of a portable classroom beyond the one year
maximum duration for temporary use. The Zoning Advisory Commission tabled the
request to allow the applicant time to address concerns raised by surrounding property
owners regarding the parking of staff and employee vehicles on Wilbricht Lane and to
research alternatives to buses loading and dropping off students from Wilbricht Lane.
The applicants have provided additional information which is attached to this memo
that outlines their response to these two concerns.
ACTION STEP
The action step is for the Zoning Advisory Commission to review the submitted
information and make a recommendation to the City Council concerning Hillcrest
Family Services requested ID Institutional District amendment.

I am responding to your letter of May 5th with information about a Hillcrest Family Services
request for an amendment in our Institutional District zoning classification. In public hearing on
May 3rd, the Zoning Advisory Commission tabled the request to the June 7th meeting.
We submit the following information concerning parking surrounding Hillcrest:
1. There are 86 off-street parking spaces on the Hillcrest campus. Ten (10) spaces are kept free
during normal working hours to accommodate clients of our Community Health Clinic.
Seventy- four to seventy-eight spaces are needed for the number of staff and employees at any
one time from September 1st through June 1st every year. When school is out (June 1st
through August 28th every year), only thirty~seven to forty-one spaces are required. Since
mid~February of this year, Hillcrest has hosted several building and trade contractors who are
renovating Hillcrest House-property at 2005 Asbury Road. This project has created the
parking situation because contractors have occupied parking slots and have pushed staff and
employees to the street. For example, on May 3rd -the day of public hearing-there were 18
contractors on the property doing bricklaying, plumbing and carpentry. Additionally, two
parking slots were occupied by a mortar maker, one slot by a pallet of bricks, one slot by a
scaffold-hauling truck. We have asked the contractors to park along Hillcrest Road and in
our lots off of Hillcrest Road. And, we have instructed our staff, if they are to park on
Wilbricht Lane, to park on one side of the street only. Since the pace of the renovation
program has slowed, fewer contractors are parking on site, and there has been little or no
congestion and on-street parking on Wilbricht Lane. Further, after school ends on May 30th,
nineteen slots will be available for off-street parking on the Hillcrest campus, and twenty-
four slots available in Flora Park.

2. The only alternative to using Wilbricht Lane for the loading and unloading of school buses is
to use Hillcrest Road. This alternative does not offer any advantages over using Wilbricht
Lane. I want to clarify the school bus activity. There are 13 trips per school day to the
school. Three trips are made by a full-sized school bus which stops on Willbricht Lane to
discharge students and staff into the driveway of the parking lot in the back of the property.
The first trip is 7:15am; the second is 8:15am; the third is 2:45pm. The bus often continues
west on Wilbricht Lane to St. Anne Drive and onto Chaney Road. However, on some
occasions, this full-sized bus turns around in Flora Park and travels east on Wilbricht to
Asbury Road. Two trips per day are made on Wilbricht Lane by a 20-passenger (half-sized)
school bus-one trip in the morning and one in the afternoon. Students are discharged in the
driveway to the lot. Four privately-owned vehicles operating as school busses make trips in
the morning and afternoon, discharging students in the parking lot or at a sidewalk in the
back. I wish to note that all these drop-off points along Wilbricht Lane are adjacent to or
across the street from Flora Park.

Previous Planned District: The 10 district was first established for Hillcrest Family
Services in 1983. In June, 1992, the 10 district was amended to allow for construction
of four additional residential cottages a new multi-purpose facility, improvements to the
existing grounds in terms of landscaping and walkways, and to provide additional
parking spaces.
Purpose: The proposed 10 District amendment is intended to amend the list of
permitted uses to include classrooms and to allow the installation of a portable
classroom on the property to accommodate the increased size classes.
Property History: This area was zoned prior to the establishment of the 10 district a
combination of R-2 and R-3 zoning.
Physical Characteristics: The subject property lies to the west of Asbury Road and
between Hillcrest Road and Wilbricht Lane.
Conformance with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate this area.
Staff Analysis:
Streets: The proposed amendment to the Hillcrest 10 District does not propose
any changes the surrounding streets or access to them.
Sidewalks: Public sidewalks exist along Hillcrest Road are within the campus itself.

Parking: The applicant is not proposing any additional off-street parking as part of
this amendment; however, they have constructed a 19-space parking lot on an
interim basis in the location shown on the approved Campus Plan for a multi-
purpose building off of Wilbricht Lane.
Lighting: As per City of Dubuque requirements.
Signage: None proposed.
Bulk Regulations: The proposed amendment to the 10 District will be in
compliance with the established setbacks provided in Ordinance 41-92 which is
attached to this staff report.
Permeable Area (%) & Location (Open Space): Approximately 63% of the 4.4 acre
site is left in open space. A large percentage of the open space is in the play area
fronting on Wilbricht Lane.
Landscaping/Screening: None proposed.
Phasing of development: None.
. Impact of Request on:
Utilities: Existing utilities are adequate to serve the subject site.
Traffic Patterns/Counts: Hillcrest Road is rated as a collector street and carries
approximately 5,700 vehicles trips per day. Asbury Road is classified as a minor
arterial and carries approximately 21.500 vehicle trips per day. Wilbricht Lane is
rated as a local street and there are no traffic counts available. All traffic counts
are based on 1997 counts by the lOOT.
Public Services: Existing public services can adequately handle the proposed
development.
Environment: Staff does not anticipate any adverse impacts to the environment
from the proposed changes to the 10 Districts.
Adjacent Properties: The addition of a portable classroom behind the residential
was positioned to be the least visible from adjacent property as possible. The
addition of a portable classroom will not increase the vehicle trips generated by
the 10 campus.
CIP Investments: None proposed in the area.

Staff Analysis: The applicants are requesting an amendment to the Hillcrest Family
Services 10 District to allow classrooms as a permitted use and to permit the use of a

has had classrooms for many years and it was an oversight that there ID district did not
include classrooms as a permitted use.
The other change to the Hillcrest Family Services ID District is to allow a portable
classroom for a longer period of time than is permitted as a temporary use by the City
of Dubuque Zoning Ordinance. The necessity of utilizing a portable classroom was
prompted by an increase in the number of students that have been referred to Hillcrest
Family Services from the Dubuque Community School District to take advantage of the
services that Hillcrest family Services provides.
Hillcrest Family Services has been following the adopted conceptual plan from 1992 in
the development of the campus and staff does not believe the proposal is contrary to
the goals of the previously adopted conceptual plan.
Staff recommends that the Zoning Advisory Commission review Section 3-5.2(d)(4) that
establishes conceptual development plan approval standards for ID Districts.

Development of land in the ID Institutional District shall be
regulated as follows:
1) All building structures and activities shall be located in
conformance with the attached amended conceptual
development plan.
2)
A minimum front yard setback of 25 feet is required for all
structures.
3) All final site development plans shall be approved in
accordance with the ID Institutional District regulations as
provided in the Zoning Ordinance of the City of Dubuque,
Iowa.
C. Performance Standards
The development and maintenance of uses in this ID Institutional
District shall be established in conformance with the regulations of
Section 3-5.2 of the ID Institutional District.
D. Site Development Standards
The site development standards for this ID Institutional District
shall be established as follows:
1)
Landscaping and screening requirements shall be
established in accordance with the requirements of Section
4-5 of the Zoning Ordinance of City of Dubuque, Iowa. All
other site development standards of Section 4-4 shall apply.
2)
All portable classrooms located in this ID District shall be
removed by Hillcrest Family Services no later than June 30,
2003.

E. Sign Regulations
The sign regulations shall be the same as that which are allowed
for 10 Districts in Section 4-3.11 of the Zoning Ordinance of the
City of Dubuque, Iowa.
F. Parking Standards
The off-street parking requirement for the principal permitted uses
for the herein described 10 Institutional District which are
designated by a bracket enclosed number next to the use shall be
as described in Section 4-2.7 of the Zoning Ordinance of the City
of Dubuque, Iowa, but in no case less than shown on the
conceptual plan adopted by the City Council on June 1, 1992.
G. Transfer of Ownershio
Transfer of ownership or lease of property in this 10 Institutional
District shall include the transfer or lease agreement, the provision
that the purchaser or lea see acknowledges awareness of the
conditionals authorizing the establishment of the district.
