RESOLUTION AUTHORIZING EXECUTION OF A COMMUNITY DEVELOPMENT
BLOCK GRANT AGREEMENT WITH THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
Whereas, under provisions of Title I of Housing and Community Development Act of
1974, as amended, the City of Dubuque prepared and submitted an Annual Action Plan for a
Community Development Block Grant; and
Whereas, the submission has been approved by the US. Department of Housing and
Urban Development in the amount of$1,441,000 for a twelve month program year commencing
July 1,2000 and ending June 30, 2001; and
Whereas, a grant agreement covering the activities proposed to be carried out with the
Community Development Block Grant funds has been transmitted to the City of Dubuque by the
U S. Department of Housing and Urban Development..
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:

Section 1. That the Funding Approval! Agreement, authorized by the US. Department of
Housing and Urban Development on July 1,2000 for a Community Development Block Grant to
the City of Dubuque in the amount of$1,441,000 and identified as Grant Number B-00-MC-19-
0004 is hereby accepted.
Section 2. That the Mayor of the City of Dubuque be and he is hereby authorized and
directed to execute said Agreement on behalf of the City of Dubuque, Iowa.

I am pleased to inform you that a review of your Fiscal Year 2000 Annual Action Plan and
2000-2005 Consolidated Plan has been completed and your program is approved in the amount of
$1,441,000. Instructions specific to the CDBG program are included in the enclosure.
Enclosed are the Grant Agreements and Funding Approvals (three copies for each
program) which constitutes the contract between the Department of Housing and Urban
Development and the City of Dubuque. You should note particularly any special conditions
included in item 8 or 11 of the Funding Approvals.
In order to establish a line of credit for the grant funds, you should execute and return two
copies of the Grant Agreement. Retain one copy of the Grant Agreement for your files. In
addition, if there is a need to delete or add individuals authorized to access the Voice Response
System, a VRS Security Access Authorization Form (HUD-27054) must be prepared, notarized,
and returned to this office with the Grant Agreement. If there is a need to establish or change the
depository account to which these grant funds are to be wired, a Direct Deposit Sign-Up Form
(SF-1199A) must be completed by you and your financial institution and mailed to this office.
You are encouraged to continue to vigorously promote full partnerships between the City
of Dubuque and its non-profit service providers, neighborhood organizations, the economic
community and private citizens as you implement your Consolidated Plan. In the process of
transforming plan elements into projects, the quality of success will depend in large part on the
closeness of cooperation among all the Consolidated Plan partners. We offer our continued
support and technical assistance during the coming year to help forward the objectives of the
Consolidated Plan.

Grant Agreement
This Grant Agreement between the Department of Housing and Urban Development (HUD) and the above named Grantee is made
pursuant to the authority of Title I of the Housing and Community Development Act of 1974, as amended, (42 U.S.C. 5301 et seq).
The Grantee's submissions for Title I assistance, the HUD regulations at 24 CFR Part 570 (as now in effect and as may be amended
from time to time), and this Funding Approval, including any special conditions, constitute part of the Agreement. Subject to the
provisions of this Grant Agreement, HUD will make the funding assistance specified here available to the Grantee upon execution of
the Agreement by the parties. The funding assistance specified in the Funding Approval may be used to pay costs incurred after the
date specified in 4 above provided the activities to which such costs are related are carried out in compliance with all applicable
requirements. Pre-agreement costs may not be paid with funding assistance specified here unless they are authorized in HUD
regulations or approved by waiver and listed in the special conditions to the Funding Approval. The Grantee agrees to assume all of
the responsibilities for environmental review, decision making, and actions, as specified and required in regulations issued by the
Secretary pursuant to Section 104(g) of Title I and published in 24 CFR Part 58. The Grantee further acknowledges its
responsibility for adherence to the Agreement by subrecipient entities to which it makes funding assistance hereunder available.

E.O. 12372 - SPECIAL CONTRACT CONDITION
Notwithstanding any other provision of this agreement, no funds provided under this agreement may be
obligated or expended for the planning or construction of water or sewer facilities until receipt of written
notification from HUD of the release of funds on completion of the review procedures required under
Executive Order (E. 0.) 12372, Intergovernmental Review of Federal Programs, and HUD's implementing
regulations at 24 CFR Part 52. The recipient shall also complete the review procedures required under
E. O. 12372 and 24 CFR Part 52 and receive written notification from HUD of the release of funds before
obligating or expending any funds provided under this agreement for any new or revised activity for the
planning or construction of water or sewer facilities not previously revie\ved under E. O. 12372 and
implementing regulations.

CDBG
The special condition in your Grant Agreement and Funding Approval concerning the
review procedures under Executive Order (E.O.) 12372, Intergovernmental Review of Federal
Programs, and HUD's implementing regulations at 24 CFR Part 52 restricts the obligation or
expenditure of funds for the planning or construction of water or sewer facilities until the
completion of the review' process and receipt of written notification of release of funds from HUD.
Since you have not submitted your final statement for review under E.O. 12372, we assume you do
not propose to use funds for activities subject to review. However, the condition requires that in
the event you amend or otherwise revise your final statement to use funds for the planning or
construction of water of sewer facilities, you must receive written release of funds from HUD
before obligating or expending funds for such activities.
You are reminded that CDBG entitlement funds must be drawn on a first-in-first-out
(FIFO) basis. This means that before requesting CDBG entitlement funds from a newly
established Line of Credit, you should have first drawn all the funds from the previous years'
Line(s) of Credit. Please note that the FIFO method onlv applies to CDBG entitlement program
funds.
An approved release of funds, under "environmental assessment requirements of the
regulations at 24 CFR Part 58, was previously provided.

The city is reminded that it must comply with Section 504 of the Rehabilitation Act of 1973.
Section 504 stipulates that no othemise qualified individual with handicaps, solely by reason of his
or her handicap, shall be excluded from participation in, be denied the benefits of, or be subjected
to discrimination under any Federal program or activity. This does include, but is not limited to,
employment, the delivery of services and programs, and structural alternation of facilities.
Guidance for compliance with Section 504 can be found in HUn's regulations at 24 CFR Part 8
and in the Uniform Accessibility Standards.
You are requested to continue efforts to further participation in the CDBG program by
minority and womens' business enterprises (M/WBEs). You are to administer your activities so as
to encourage the participation of M/WBEs and keep records regarding said activities. These
efforts can lead to economic development within the city and create additional
employment/economic opportunities for M/WBEs. Please refer to 24 CFR 507.904 (d) for
guidance.
Section 3 of the Housing and Urban Development Act of 1968, as amended by the Housing
and Community Development Act of 1992, requires that economic opportunities generated by
HOD financial assistance shall, to the greatest extent feasible, be given to low-and very low-
income persons, particularly those who are recipients of government assistance for housing, and to
businesses that provide economic opportunities for these persons. Section 3 covers assisted
housing and community development, CDBG-funded, programs. You are to incorporate Section 3
activities into your CDBG program year and keep records regarding said activities. Please rda to
24 CFR Part 135 for guidance.e

INTRODUCTION
This memorandum requests City Council adoption of a resolution authorizing the Mayor to sign a
Community Development Block Grant (CDBG) Agreement with the U.S. Department of Housing
and Urban Development (RUD) in the amount of$1,441,000 for the program year beginning July
1,2000 and ending June 30, 2001.
DISCUSSION
.
As a CDBG entitlement community, the City of Dubuque is eligible to receive annual funding for
carrying out housing and community development activities. Before it may receive these funds,
however, it must submit a plan for the use offunds and sign an annual grant agreement.
On February 23,2000, the City Council held a public hearing on a proposed FY 2001 Annual
Action Plan which had been recommended by the Community Development Advisory
Commission. The Council approved the Annual Action Plan on March 7, 2000 by Resolution
101-2000 and authorized the City Manager to submit an application for CDBG funds.
The attached letter dated June 26, 2000 from RUD informs the City that its FY 2001 Annual
Action Plan has been reviewed and a grant of $1,441,000 has been approved. A Funding
Approval/Agreement is included for execution by the City. To complete the annual application
process, the City Council must now approve execution of the grant agreement as provided by the
attached resolution.
RECOMMENDATION
I recommend that the City Council approve the attached resolution authorizing execution of the
grant agreement with the U.S. Department of Housing and Urban Development. This will allow
the City to begin expending funds for programs included in our annual plan for the program year
which begins July 1.
