AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 3556 CRESCENT
RIDGE FROM PLANNED UNIT DEVELOPMENT WITH A PR PLANNED
RESIDENTIAL DESIGNATION AND AG AGRICULTURAL DISTRICT TO R-1
SINGLE-FAMILY RESIDENTIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from Planned Unit Development with a PR Planned Residential Designation and AG
Agricultural to R-1 Single-Family Residential District, to wit:
Lot 1 of Mineral Lot 290. Lot 1 of Lot 2 of Mineral Lot 290. and Lot 2 of Mineral
Lot 285, and to the center line of the adjoining public right-of-way, all in the City of
Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Discussion
The applicant spoke in favor of the request noting that the rezoning will be consistent with
surrounding land use and will allow development of a single-family development. Staff
reviewed past rezoning request on the subject property.
The Zoning Advisory Commission discussed the request noting that the proposed zoning is
consistent with surrounding zoning and land use.
Recommendation
Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property has been used for agricultural purposes
both before and after its annexation to the City.
Physical Characteristics: There is approximately 100 feet of grade change between the
street and the south property line. The property slopes away from Crescent Ridge and
English Mill Road to the south.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan designated
the area for single and multi-family residential uses.
Impact of Request on:
Utilities: Existing utilities are available to serve the site. The recently extended
South Fork sanitary sewer intercept is located south of the subject property and
there is an existing City water main in Crescent Ridge.
Traffic Patterns/Counts: Crescent Ridge is designated as a collector street.
Based on 1997 lOOT counts, there are approximately 1,260 vehicle trips per day
on Crescent Ridge.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development
and adequate storm water control is provided as approved by the City Engineering
Division.

Adjacent Properties: Staff does not anticipate any adverse impact to the
environment as the proposed R-1 Single-Family zoning would be consistent with
surrounding zoning.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of a parcel of land that has
frontage on Crescent Ridge from PR Planned Residential and AG Agricultural to R-1
Single-Family Residential. The subject property encompasses approximately 20 acres
and the applicant proposes to develop it for a single-family residential subdivision.
A portion of the property was rezoned from AG Agricultural to a PUD Planned Unit
Development with a PR Planned Residential designation in December, 1995, to allow
development of 75 ctNelling units in nine structures for low to moderate income
residents. The approved development has never gone forward and the applicant is
now seeking rezoning of the property from'pR Planned Residential to R-1 Single-
Family Residential. A portion of the property that was not rezoned by the previous
O'Mler is already zoned R-1 Single-Family.
Access to the site will be via Crescent Ridge Road and storm water detention would be
required as part of the subdivision. If rezoned, the next step for the developers will be
to submit subdivision plats for the Commission and City Council review.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes criteria for review of rezoning requests.
