CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafter described property from C-4
Downtown Commercial District to C-3 General Commercial District, to wit:
Lot 5 N 40' of Lot 4, S 10' of Lot 4, Lot 3 N 10' of N 32' of Lot 2, S 22' - N 32' of
Lot 2, S 18' of Lot 2, N 4' 8" - N 25' 4" of Lot 1, S 20' 8" - N 25' 4" of Lot 1 and
S 24' 8" of Lot 1, all of Tivoli Addition, and to the center line of the adjoining
public right-of-way, all in the City of Dubuque, Iowa.

Property History: The subject parcel has been used as the Hartig Drug Store for
many years. Two adjacent parcels included in this request were formerly the site of
residential dwelling units.
Physical Characteristics: The subject property has frontage on Central Avenue, 22nd
Street, and is adjacent to an alley to the west.
Concurrence with Comprehensive Plan: The subject parcel is not included in the
1995 Comprehensive Plan.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: Central Avenue is considered a principal arterial and is
also part of U.S. Highway 52. Based on 1997 lOOT counts, there are
approximately 15,400 vehicle trips per day. 22nd Street is considered a minor
arterial and carries approximately 11,800 vehicle trips per day based on 1997
lOOT counts.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment as
part of the rezoning request.
Adjacent Properties: Staff does not anticipate any significant impact to adjacent
property as the list of permitted uses between the C-4 Downtown Commercial and
the C-3 General Commercial District is substantially the same. The principal
difference between the C-3 and C-4 Districts is that vehicle sales and service, car

washes and drive-in/carry-out restaurants are a conditional use in the C-4 District
while they are permitted uses in the C-3 district.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of the subject parcel from C-4
Downtown Commercial to C-3 General Commercial. The subject property is located at
the northwest comer of Central Avenue and 22nd Street and has been the site of a
Hartig Drug Store for many years.
The applicant is in the process of beginning renovation and expansion of the Hartig
Drug Store in this location and will include a drive-thru pharmacy window. The request
to rezone the parcel to C-3 General Commercial was submitted because the parcel has
frontage on a principal arterial and a minor arterial which more closely resembles a C-3
General Commercial District than a C-4 Downtown Commercial District. The applicant
believes the C-3 sign regulations are more appropriate than the C-4 Downtown
Commercial sign regulations, given this parcel's frontage on a highway and minor
arterial.
The area around the intersection of Central Avenue and 22nd Street has seen the
recent redevelopment with the construction of the new convenience store/gas station
on the southwest side of the intersection.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes criteria for the review of rezoning requests.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request noting that the subject property is more
appropriately zoned C-3 General Commercial as the existing pattern of development is not
consistent with the intent of Downtown Commercial zoning. Staff reviewed surrounding
zoning and indicated that the subject parcel was located at the intersection of a U.S.
highway and minor arterial.
The Zoning Advisory Commission discussed the request noting that the subject parcel is
more appropriately zoned C-3 General Commercial because of the availability of off-street
parking and that the property is consistent with the intent of the C-3 district rather than the
C-4 Downtown Commercial District.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
