City Hall Telephone: 589-4210 ORDINANCE NO. 59-00 AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CODE OF ORDINANCES OF THE CITY OF DUBUQUE, IOWA, BY PROVIDING FOR THE AMENDMENT OF ORDINANCE 1-93 BY APPROVING AN AMENDED CONCEPTUAL DEVELOPMENT PLAN FOR THE FINLEY HOSPITAL ID INSTITUTIONAL DISTRICT AND RECLASSIFYING HEREINAFTER DESCRIBED PROPERTY LOCATED IN THE 1400 BLOCK OF UNIVERSITY AND INCLUDING ALLISON PLACE FROM R-2 TWO-FAMILY RESIDENTIAL DISTRICT TO ID INSTITUTIONAL DISTRICT NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (the Zoning Ordinance) of the Dubuque Code of Ordinances be amended by providing the amendment of Ordinance 35-93 by approving an amended Conceptual Development plan for The Finley Hospital 10 Institutional District and by reclassifying hereinafter described property from R-2 Two-Family Residential District to 10 Institutional District, to wit: Lot 1, Lot 2 and Lot 3 of Milligan's Subdivision; Lot 1 of Lot 1 of Motor subdivision; Lot 2, Lot 3, Lot 4, Lot 12, NW 2/3 of Lot 13, SE 1/3 of Lot 13, NW 1/3 of Lot 14, SE 2/3 of Lot 14, Lot 15, Lot 1 of Lot 16, Lot 2 of Lot 17, Lot 19, Lot 1 of Lot 20, Lot 2 of Lot 2 of Lot 20 and Lot 1 of Lot 2 of Lot 20, all of Finley Home Addition; Lot 2 of Minard's Subdivision and to the center line of the adjoining public right-of-ways, all in the City of Dubuque. Section 2. That in order to accomplish the purposes of the 10 Institutional District and of the Zoning Ordinance, the property herein above described is subject to the following conditions and restrictions: A. Use Regulations The following regulations shall apply to all uses made of land in the above- described 10 Institutional District: 1) Principal permitted uses shall be limited to the following: a) Hospitals. (46) Ordinance No. Page 2 b) c) d) e) f) g) h) -00 Out-patient care facilities. (36) Offices for administrative personnel or other institutional employees or affiliates. (14) Classroom, laboratories, lecture halls, auditoriums and similar places of institutional assembly. (45) Off-street parking and loading. (NA) Existing private uses or structures situated within an 10 Institutional District for which the R-3 District standards shall apply. (NA) Facilities and operations for the diagnosis, care and treatment of human health disorders, including examinations in operating rooms, physical therapy or x-ray facilities, psychiatric treatment, convalescent care and similar hospital-related uses, but not to include commercial uses or uses listed as conditional or accessory uses for this district. this provision shall include separate doctors clinics and other medical facilities not owned or operated by the principal institution and included in the conceptual development plan. (36) Group day care center (8). 2) Accessory Uses. The following uses shall be permitted as accessory uses in the above-described 10 Institutional District: 'r a) Restaurants or cafeterias, flower shops, gift shops, and candy, cigar or magazine stands but only when operated or located entirely within a principal building. b) Facilities with a compounding, dispensing or sales of drugs or medicines, prosthetic devices, lotions or preparations, bandages or dressings and similar medical or health-related supplies. c) All uses customarily incidental to the principal permitted use in conjunction with which such accessory use is operated or maintained, but not to include commercial uses outside the principal building. B. Lot and Bulk Regulations Development of land in the 10 Institutional District shall be regulated as follows: .. Ordinance No. -00 Page 3 . 1) All buildings, structures and activities shall be located in conformance with the attached conceptual development plan and all final site development plans to be approved in accordance with the provisions of the ID Institutional District regulations as provided in the Zoning Ordinance of the City of Dubuque, Iowa. C. Site Development Standards 1) Final site development plans shall be submitted in accordance with Section 4-4 of the Zoning Ordinance. 2) The landscaping and screening requirements shall be established in accordance with the requirements of Section 4-5 of the Zoning Ordinance. D. Additional Standards 1) The off-street parking requirement for the principal permitted uses for the herein described ID Institutional District shall be shown on the attached amended conceptual development plan. . 2) Signage permitted in this ID Institutional District shall be as follows: a) Nine free-standing signs with a maximum of 50 square feet per sign; b) One free-standing sign with a maximum of 100 square feet per sign; c) 22 wall-mounted signs with a maximum of 50 square feet per sign; d) Four wall-mounted signs with a maximum of 100 square feet per sign; e) One wall-mounted sign with a maximum of 200 square feet; f) Directional signs, as needed.. with a maximum sign area of 10 square feet and 10 feet in height. g) That all other sign regulations not herein identified shall conform to Section 4-3.11 Schedule for Sign Regulations for the ID Institutional District. . 3) That all previously approved conceptual development plans are hereby amended to allow for the attached conceptual development plan. Time Limitation The conceptual development plan shall be valid for a period of five years provided final site development plans are submitted within the five (5) year time frame. Extensions may be granted by the Zoning Advisory Commission at the request of The Finley Hospital. F. Transfer of Ownership Transfer of ownership or lease of property in this 10 Institutional District shall include the transfer of lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of this district. II THE FINLEY HOSPITAL AN IOWA HEALTH SYSTEM AFFIUATE Proposed Amendment to Institutional District . REQUEST AND PURPOSE The Finley Hospital requests an Amendment to its Institutional District (ID). The purpose of the Amendment is to accommodate the addition of a Medical Office Building (MOB) to the east of our existing campus. Over the past four years, Finley has purchased land necessary for the construction of this building and required parking. Finley also requested the option to purchase Allison Place and the adjacent alley from the City. This was approved by the City Council on Feb 15, 1999 through an exclusive option. · See attachment for listings and legal descriptions of all properties to be included in this amendment. DESCRIPTION OF MOB . The Proposed Medical Office Building will be located east of existing Finley building in an area currently occupied by the physicians' parking lot and Allison Place. The front of the building will face north, toward Delhi Street. The Proposed Medical Office Building will be a four level structure of approx. 20,000 SF per level. There will be a link between the MOB and Finley at each of the four levels. Two elevators and two stairwells will provide access from tloor to tloor. . First t100r (the lower level) is a covered parking garage, with an entrance on the south accessed from College Street by a drive routed similar to that of the current Allison Place. Second tloor will provide, to the north, the main public entrance to the building, complete with a front canopy and entry vestibule. This will be at the same approx. elevation as Delhi Street. A combination of current Finley Services will be relocated to this t100r. They are Finley Outpatient Physical Therapy, Finley Business Health and Finley Convenient Care. There will be leased space available for a Physician Practice. Third floor will provide leased space to (3) Physician Practices. Fourth noor wi II be a shell space that could allow for future Physician oCtice space or a relocation area for existing Finley Departments. A total of 15 MOs, 2 Midwives, and 2 Nurse Practitioners will practice from offices on the second and third floors. Because of scheduled days off, 800/0 or less of the MDs and practitioners will be in their offices available to see patients at anyone time. The Finley Hospital - Medical Office Building Addition . PARKING · Refer to attached parking references, # 1, #2, #3. . 206 parking spaces, including 7 Accessible Spaces, are required to accommodate the total "usable SF" of the MOB. ("Usable SF" includes 50% of the SF available on the shelled fourth floor). Currently, the Finley campus has 805 existing parking spaces, with 80-100 spaces consistently available throughout the main parking ramp. Also available, are approximately 130 street spaces bordering the Finley campus. With the addition of the MOB and site, we propose an additional 163 parking spaces including 14 Accessible Spaces. The additional 163 spaces combined with current unutilized spaces in and around our campus, provides a total capacity that exceeds the required 206. Like in our main parking ramp, employee and staff parking will be restricted to designated areas. This allows patients and visitors the free use of the parking areas that are most convenient to entrances. A priority for Finley will be to continue to purchase additional adjacent properties when they become available. This would allow for additional parking if future development required. Previous Planned District: The Finley Hospital Institutional District was last amended in January, 1993, allowing for the construction of a 48,704 square foot three-story addition on the northwest corner of the hospital. As part of that development, the DuMed building located at 486 N. Grandview Avenue was removed and a parking area was constructed. Purpose: The Finley Hospital is requesting an amendment to its institutional district to accommodate the addition of a medical office building on the east side of the campus. In addition, 163 additional parking spaces will be provided on the campus. Property History: The site has been home to The Finley Hospital for many years and over time has gone through various expansions. Recent expansions occurred in 1978, and again in 1986, 1987, 1991 and 1993. Physical Characteristics: The campus for The Finley Hospital is currently bordered by 3rd Street on the south, North Grandview Avenue on the west, Delhi Street on the north, and Allison Place on the east. Confonnance with Comprehensive Plan: The subject property was not included as part of the 1995 Comprehensive Plan. PLANNED DISTRICT STAFF REPORT Page 2 Staff Analysis: Streets: The Finley Hospital has been working with the City on the vacation of Allison Place. No new streets are proposed as part of this development.. Sidewalks: Sidewalks will be installed where appropriate for access from off-street parking spaces to the proposed medical office building. In addition, sidewalks will be required along University Avenue as part of the parking lot expansion for the Dubuque Internal Medicine facility. Parking: Additional off-street parking is being provided in an area once occupied by Allison Place and will total 163 new off-street parking spaces. Lighting: All new lighting will be required to be of a cut-off design to minimize impact to adjacent properties. Signage: The applicant has not provided a signage package at this time; however, staff recommends that the number of wall mounted signs be increased by two for the new building, and each sign be allowed 100 square foot. Bulk Regulations: As shown on the conceptual development plan. Permeable Area (%) & Location (Open Space): The total area of The Finley Hospital campus will be expanded by 2.36 acres. Staff estimates that approximately 85% of the site is covered by either building or paved surface. The proposed medical office building and additional off-street parking will not significantly change this ratio. Staff estimates that with the campus additions, between 10-15% of the site will be permeable area. Landscaping/Screening: If approved, the proposed parking areas will be required to be screened from City streets as well as adjacent residential structures. Screening of parking lots are required to be a minimum of 3 feet high and 50% opacity . Phasing of development: None proposed. Impact of Request on: Utilities: Existing utilities are adequate to handle the proposed development. Traffic Patterns/Counts: North Grandview Avenue is designated as a minor arterial and carries approximately 16,100 vehicle trips a day. Delhi Street is designated as a collector street; however no vehicle counts are available. University Avenue is designated as a minor arterial, and carries approximately 8,000 vehicle trips a day. All vehicle counts are based on 1997 lOOT counts. . . . PLANNED DISTRICT STAFF REPORT Page 3 Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impacts to the environment provided that additional storm water created by the new medical office building and new off-street parking is adequately controlled and suitable storm water detention is provided. Adjacent Properties: The construction of the proposed office building and new off-street parking will make a significant visual difference in the neighborhood. Further, there also will be an increase in the number of vehicle trips to and from The Finley Hospital campus. CIP Investments: The City of Dubuque is in the process of reconstructing College Avenue with the replacement of aging utilities. Staff Analysis: The Finley Hospital is proposing an amendment to their institutional district to allow the construction of a new medical office building on the east side of the campus as well as the construction of an additional 163 off-street parking spaces. The proposed medical office building will be a four-level structure of approximately 20,000 square feet per level with approximately 52,000 square foot of office and patient care space. The new medical office building will be linked to the existing Finley Hospital at each of the four levels. The Finley Hospital also is requesting inclusion of properties along the northeast side of Allison Place into the campus, as well as four additional properties along University Avenue, to allow for expansion of an existing parking lot adjacent to the north side of Dubuque Internal Medicine. Attached to this staff report is a packet of materials provided by The Finley Hospital that describes the use of the proposed medical office building, the properties that have been acquired and are being requested for inclusion in The Finley Hospital Institutional District, a breakdown of the anticipated off-street parking demand and where the additional spaces will be provided for on the campus. Planning Staff has visited The Finley Hospital campus several times over the last several weeks and found that, as indicated in The Finley Hospital surveys, between 80-100 spaces are consistently available in the main ramp. Staff found that most street parking was occurring on a portion of 3rd Street opposite the Grandview Medical Center and Doctor's Place which are separate facilities from The Finley Hospital. In addition, Delhi Street was used for significant on-street parking. It was not possible to determine, though, whether those vehicles were owned by The Finley Hospital staff or employees, or from surrounding businesses or residences. Access to the new parking lot off of Delhi Street will be restricted to the hospital's existing entrance off that street near the helicopter landing area. Access to the new 60- space parking lot southeast of the proposed medical office will be from College Avenue PLANNED DISTRICT STAFF REPORT Page 4 only. Access to the expanded lot along University Avenue is proposed to be off the existing alley connecting to University Avenue. The Finley Hospital is currently in compliance. in terms of parking for the level of parking established in the 1993 Institutional District amendment. At that time, they were to provide 610 off-street parking spaces on the campus, and currently they provide 647 spaces. With the proposed changes to the campus, there will be 778 off- street parking spaces. These figures are somewhat different than those included in Parking Reference No.2 submitted by The Finley Hospital. Planning Staff do not include the existing off-street parking for the Dubuque Internal Medicine lot on the north side of Delhi Street nor its proposed expansion by 32 spaces. The proposed addition to the medical office building and additional off-street parking will be reviewed as a site plan once the Zoning Advisory Commission and City Council have reviewed the request and approved it. As part of that review, storm water management will be required and will include necessary storm water detention. so as to not overburden the existing storm sewer system in the area. Discussion The applicant spoke in favor of the request, reviewing with the Commission the properties to be incorporated into the ID District and the new medical office building and associated off- street parking. Several adjacent property owners expressed concern regarding future alley access and anticipated increase in traffic on College Street. Staff reviewed the existing and proposed parking spaces for the campus and reviewed the results of Finley's parking survey. The Zoning Advisory Commission discussed the request noting that adequate off-street parking is being provided as part of the campus additions, and that issues regarding the adjacent alley should be referred to City Engineering. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Site Development Standards 1) Final site development plans shall be submitted in accordance with Section' 4-4 of the Zoning Ordinance. 2) The landscaping and screening requirements shall be established in accordance with the requirements of Section 4-5 of the Zoning Ordinance. D.
