A RESOLUTION ACCEPTING A CONVEYANCE OF PROPERTY ON
PENNSYLVANIA AVENUE TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an agreement with Assemblies of God
Ministers Benefit Association, pursuant to which Assemblies of God Ministers Benefit
Association agreed to convey all that part of the following described property lying north
of the centerline of Pennsylvania Avenue: Lot 1 of Lot 1 of Lot 2 of Bryne's Subdivision in
the City of Dubuque, Dubuque County, Iowa, as shown on the Exhibit A thereof; and
Whereas, Assemblies of God Ministers Benefit Association has executed a
conveyance of said property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA: .
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Quit Claim Deed from Assemblies of God Ministers Benefit
Association, copies of which are attached hereto, as required by Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection herewith.

QUIT CLAIM DEED
For the consideration of one and no/100 Dollar ($1.00) and other valuable consideration in hand paid
by the City of Dubuque, the Assemblies of God Ministers Benefit Association, a corporation organized
and existing under the laws of the State of Missouri, does hereby Quit Claim to the City of Dubuque,
all its right, title, estate, claim, and demand in the following described real estate in Dubuque County,
Iowa:
THE RIGHTS, TITLE, CLAIM, INTEREST, IF ANY, GRANTED IS TO LAND DESCRIBED AS FOLLOWS:
All that part of the following described. property north of the centerline of Pennsylvania
Avenue: Lot 1 of Lot 1 of Lot 2 of Bryne's Subdivision in the City of Dubuque, Iowa,
according to the recorded plat thereof, subject to easements and restrictions of record, and as shown
on Exhibit" A" attached hereto and by reference made a part hereof.

Deeds with a consideration of $500.00 or less are exempt from transfer tax. Iowa Code Sec. 428A.1.
This land is being acquired for public purposes and a Declaration of Value is not required. Iowa Code
Sec. 428A.1.

Public Works Director Mike Koch is recommending acceptance of a Quit Claim Deed
for a right-of-way purchase on Pennsylvania Avenue near the Northwest Arterial.

SUBJECT: Pennsylvania Avenue - Acceptance of Quit Claim
INTRODUCTION
Enclosed is a resolution accepting a Quit Claim Deed for a right-of-way purchase on
Pennsylvania Avenue near the Northwest Arterial.
DISCUSSION
.
Additional right-of-way was necessary for the widening of Pennsylvania Avenue at the
intersection with the Northwest Arterial. Existing right-of-way was 66 feet. This
right-of-way purchase allowed for an additional 1 2-foot lane and accompanying taper.
Consideration for the parcel was one dollar ($1.00) plus facilitation in vacating an
existing roadway easement for Anderson Road platted in 1913.
Enclosed is a Quit Claim Deed for the parcel needed for the paving project, and to
provide necessary grading for the installation of sidewalks. Included is the following
