RESOLUTION NO. 328-00
RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN THE
CORPS OF ENGINEERS CONSTRUCTION PERMIT APPLICATION FOR
THE MISSISSIPPI RIVER DISCOVERY CENTER WETLAND
CONSTRUCTION IN THE ICE HARBOR, THE CONSTRUCTION OF THE
HARBOR WALK AROUND THE EDGE OF THE ICE HARBOR, AND THE
INSTAllATION OF BOAT DOCKS
Whereas, the Dubuque Historical Society is proposing to construct the Mississippi
River Discovery Center in the Ice Harbor, and a portion of the development includes the
construction of a proposed wetland area along the northwest corner of the Ice Harbor; and
Whereas, a permit application is required by the U.S. Army Corps of Engineers; and
Whereas, the City of Dubuque is the owner ofthe property and the Dubuque County
Historical Society is leasing the property, the permit application must be executed by both
parties; and
Whereas, the City Council ofthe City of Dubuque approves the terms and conditions
of said permit application.
. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the U.S. Army Corps of Engineers permit application for the
construction of a wetland along the northwest corner of the Ice Harbor, in conjunction with
the Mississippi River Discovery Center Project and Harbor Walk around the westerly edge
of the Ice Harbor, and the installation of modular transient boat docks, along the westerly
edge of the Ice Harbor, be and hereby is approved.
Section 2. That the City Manager be authorized and directed to execute four (4)
copies of the permit application and forward them along with the signature of the Dubuque
County Historical Society to the U.S. Corps of Engineers for further review and comment
by various Federal, State, and Local agencies.

5. PROJECT DESCRIPTION AND REMAAKS:
Hydraulic filling with dredged sand in the Ice Harbor located in the City of Dubuque to
create a museum wetlands. Earth retaining system adj acent to the harbor for a new river
walk and emergency access drive. Prefabricated, modular boat docks for private vessels
with varying slip lengths. Refer to the attached drawings for a graphic illustration.

Public Works Director Mike Koch is requesting approval of the u.s. Army Corps of
Engineers 404 Construction Permit Application for the proposed improvements in
the Ice Harbor in conjunction with the Mississippi River Discovery Center and
Riverwalk Projects.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Corps of Engineers Construction Permit Application for the Mississippi
River Discovery Center Wetland Construction in the Ice Harbor, the
Construction of the Harbor Walk Around the Edge of the Ice Harbor, and
the Installation of Boat Docks
INTRODUCTION
The enclosed resolution authorizes the City Manager to sign the U.S. Army Corps of
Engineers 404 Construction Permit Application for the proposed improvements in the
Ice Harbor in conjunction with the Mississippi River Discovery Center and Riverwalk
Projects.
DISCUSSION
A part of the Mississippi River Discovery Center Project in the Ice Harbor area includes
the construction of a proposed wetland area along the northwest corner of the Ice
Harbor. The proposed wetland area will be approximately 1.4 acres and will extend
beyond the existing shoreline into the Ice Harbor as illustrated on the attached
preliminary site plan.
Adjacent to the wetland area, the City is proposing to construct a Harbor Walk around
the westerly edge of the Ice Harbor which will connect the Riverwalk to the Heritage
Trail southerly extensio~. The proposed Harbor Walk will extend beyond the existing
shoreline into the Ice H~bor with a retaining wall structure at the water edge. The
retaining wall structure is required to allow adequate clear zone separation between the
existing railroad tracks and the proposed pedestrian Harbor Walk.
Adjacent to the wetland area and Harbor Walk, the City is proposing to install modular
transient boat docks along the westerly edge of the Ice Harbor. The boat docks will
extend from the wetland area to the Coast Guard facility.
Since the City is a developing partner and will be leasing land to the Dubuque County
Historical Society for their phase of the project, the City is required to join with the
Historical Society in applying for the Corps Permit.

The 404 Construction Permit Application will be submitted as a preliminary plan in an
attempt to initiate the review and comment process by the various federal, state and
local agencies as required by the permit process. Since the permit process can be quite
lengthy, if potential concerns are brought forth early, they can be addressed during the
initial design stages, thus allowing the permit process to proceed with minimal delays.
As part of the preliminary review process and prior to proceeding with the actual
project, the effect of the storm water storage capacity and the operating conditions of
the Ice Harbor must be fully evaluated. Any loss of holding capacity in the Ice Harbor
basin must be mitigated by either additional pumping capacity or revised operational
procedures for the basin to close the gates at a lower river stage than it has been
historically operated.
Prior to receiving City approval and Corps permit authorization, final construction plans
and specifications will be submitted for approval and include a comprehensive report on
the storm water storage capacity of the Ice Harbor. Any proposed changes and
mitigation measures to the operating procedures of the Ice Harbor will be subject to the
concurrence of the City, the Corps and Ice Harbor property stakeholders. Receipt of a
permit does not bind the City to perform the work; it merely authorizes the work to be
done.
RECOMMENDA TION
I would recommend that the City Council authorize the City Manager to sign the U.S.
Army Corps of Engineers 404 Construction Permit Application with preliminary plans
for the construction of the Mississippi River Discovery Center Wetland Project, the
construction of the Harbor Walk around the edge of the Ice Harbor and the installation
of boat docks.
ACTION TO BE TAKEN
The City Council is requested to authorize the City Manager to sign the U.S. Army
Corps of Engineers Construction Permit Application through adoption of the enclosed
resolution.
