RE: Status of Platted Quinn Street
Dear Ms. Fedderson:
This is in response to your recent request for information regarding recent activities associated
with property boundaries, fences, parking, and other miscellaneous issues in the vicinity of
Quinn Street.
In our conversation, you requested answers to five specific questions as follows:
l Why was the recently-placed City curbing tipped toward the middle of the street?
, What has been referred to many times as a "sidewalk" is actually a curb which the City
installed to prevent storm water from flowing easterly across Quinn Street and flowing
down and eroding the steep embankment on this side of Quinn Street. (The curbing
was tipped toward the middle of the street in order to redirect the water flow away
from the steep embankment and keep the water on the flatter, graveled surface of

2. What options are available to a resolution of these problems?
A. The City could force the removal of the Mastin's fence from the public right-of-
way; however, City staff feels there is no justification for this action given the
circumstances at this time.
B. Quinn Street could be vacated and sold to you and the Mastins, with each party
purchasing one-half of the platted right-of-way. This would require City Council
action and costs for platting.
There is sufficient room to construct a private road between the centerline of /
Quinn Street and the drop-off located along the east edge of the graveled
roadway. Major reconstruction work would be needed on the east side of Quinn
Street in order to make this option workable, or the Mastins would need an
easement to cross your property line.

C. The City could proceed to fully improve Quinn Street with curb and gutter, and
assess both you and the Mastins for the cost of the curb and gutter and
concrete paving. This too would require City Council approval.
This cost is usually around $150 per running foot of property footage; however,
in this case, because of the difficult terrain, this cost would be probably' be
significantly higher than most assessments.
It would also be possible to construct a new driveway for your property west
of Quinn Street directly onto Valley Street.

Quinn Street could then be used as a sole access to the Mastin property,
thereby eliminating any conflicts between the two traffic flows.
E.
Subject to City Council authority, sufficient property could be acquired by direct
purchase or eminent domain to allow for parking on one side of the street and
still allow 10 feet for vehicle passage.

Why was Quinn Street surveyed by the City?
When you placed a bucket of sand in the approximate middle of the graveled surfacing
of Quinn Street, the clearance between the bucket and the east edge of the roadway
was extremely narrow. This caused the passage of a vehicle along the east side of this
bucket to be extremely hazardous, especially during winter-driving conditions. The City
surveyed the corner of the alley to make sure the bucket was located correctly on the
property corner.

Why is the City not banning parking on Quinn Street?
Currently there is no posted parking prohibition on either side of Quinn Street. Parking
is allowed on any public street if such parking leaves an available width of 10 feet of
the roadway for the free movement of vehicular traffic.

7. Why is the fence not required to be removed by the City?
According to the adjacent property owner, Mr. Delbert Mastin, this fence was installed
approximately 35 years ago. Mr. Mastin indicates that he pursued the proper location
of his front property line and that the line was marked by the City prior to the
installation of the fence.

Of course, there is no way of determining whether this is true or not. We do know that
there are a significant number of platting and surveying errors in this area, and to be
absolutely certain of property boundaries, a comprehensive survey would be needed.
In the last 25 years in which the fence has been located within the Quinn Street right-
of-way, I am not aware of any complaints filed with the City with regard to its location.
(If you have difficulty turning around on your property, the Mastin driveway may be a l
possible location for you to turn around before entering Valley Street. I ~ould suggest

The City considers these types of issues as neighborhood issues, since they involve
only two to three parties; and the City generally does not want to interject itself into
such long-standing matters as to set new public policy affecting other parts of the City
as well. The fence has a long history of being at its present location without posing
a traffic problem, or any other problem of which the City is aware. Since sufficient
width is available for passage of a vehicle adjacent to the fence, the City sees no
reason to require the removal or relocation of the fence at this time.
I believe this answers all the questions which you raised during our recent telephone
conversation. In addition to the above, I am again suggesting that you pursue the mediation
process through the Dubuque Dispute Resolution Center, for which I have attached a brochure
which outlines the procedure. In talking with the Mastins, they have indicated that they are
agreea61e in pursuing this process. If I have misunderstood any of your questions, please feel
