Duggan and members of the City Council Date: September 7, 2000 Re: Claimant Claim of Michele Schreiber Date of Claim Date of Loss Nature of Claim Michele Schreiber 8/11/00 6/12/00 vehicle damage This is a claim for damages to the claimant's vehicle, which it sustained when it hit a can of industrial marking paint that was lying in the street. According to the report of Public Works Director Mike Koch, the vehicle hit ~he can of spray paint on Brown Street,. which is in the vicinity of a City construction site on Van Buren Street. He indicated that the spray can in the street was not a natural condition, but due to the negligence of "the City, and has recommended that the claim be paid. It is therefore the recommendation of the Legal Department that this claim, in the amount of $142 be paid by the Finance Director and submitted to ICAP for reimbursement. Claim of Michelle Schreiber SUBJECT: The above claim is a result of a vehicle hitting a spray paint can which was located on Brown Street in the vicinity of the City construction site on Van Buren Street. The type of paint indicated is typical of that used by the .City Engineering Division for surveying on construction projects. I don't think this is a typical"object in the street" claim, since the loss of the spray can in the City street was not a natural condition, and was due to the negligence of the City.
