Amendment to Section 32 of the Code of Ordinances of the City of Dubuque , . . . ORDINANCE NO. 79-00 AN ORDINANCE AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES SECTION 32-311 DESIGNATING MUNICIPALLY OWNED PARKING LOTS BY REMOVING SPECIFIC LOTS; AMENDING SECTION 32- 312 METERS - INSTALLATION AUTHORIZED AND DIRECTED; AND AMENDING SECTION 32-314 ESTABLISHING METERS-TIME AND FEE SCHEDULE FOR MUNICIPAL LOTS BY REMOVING THE METER TIME AND FEE SCHEDULE FOR SPECIFIC LOTS NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Sec. 32- 311 of the City of Dubuque Code of Ordinances is amended to read as follows: Sec. 32-311. Designated - Lots: The various Municipally owned parking lots in the City shall be designated and numerically as follows: (1) Lot No.1: The lot situated between Ninth and Tenth Streets and Iowa Street and Central Avenue. (2) Lot No.2: The lot situated at the northwest corner of Ninth and Bluff Streets and running parallel to Ninth Street. (3) Lot No.3: The lot situated at the northwest corner of Fifth and Bluff Streets. (4) Lot No.5. The lot situated at the northwest corner of Twelfth Street and Central Avenue. (5) Lot No.6 The lot situated on the southwest corner of Eleventh and Bluff Streets. (6) Lot No.7 The lot situated on the north west corner of 3rd and Main Streets. (7) Lot No. 10 The lot situated on Fifth Street and the alley east of Locust Street and running parallel to the alley from Fifth to Sixth Streets. (8) Lot No. 12 The lot situated on the north east corner of 4th Street and Central Avenue. Section 2. Section 32-212 of the City of Dubuque Code of Ordinances is amended to read as follows: Sec. 32-312. Meters - Installation Authorized And Directed: The City Manager is hereby authorized and directed to install parking meters in those Municipally owned parking lots designated numerically as Lots No.1 through 3, 5, 6, 7 and 10 for the purpose of, and in such numbers and at such places as may be necessary to the regulation, control and inspection of the parking of motor vehicles therein. . Section 3. Section 32-314 of the City of Dubuque is amended to read as follows: Section 32-314. Meters- Time and Fee Schedule For Specific Lots is amended to read as follows: . . . Parking meters on Municipally owned parking lots, when installed and properly operated, shall show legal parking upon and after the deposit of United States coins, and in the non- metered parking lots, parking spaces shall be reserved in accordance with the following schedules: (1) On Parking Lots No.1, 2, 3, 5, 6, 7 and 10 the amount of fee shall be displayed on each parking meter and shall indicated the period of time allowed for the particular United States coin deposit after meter has been placed in operation. The maximum parking time allowed shall be indicated on the parking meter assigned to the meter space to which it applies. (2) On Parking Lot No.3, reserved parking for each space for the sixteen (16) parking spaces for which parking meters have not been installed shall be rented through lease and agreement approved by City Council. (3) On Parking Lot No.5, reserved parking for each space for which a parking meter has not been installed shall be reserved by the City for assignment by the City Manager for purposed of carrying out the business of City government. (4) On Parking Lot No. 10, reserved parking for nonmetered spaces shall be between the hours of six o'clock (6:00) A.M. and six o'clock (6:00) P.M. daily, excluding Saturdays, Sundays and holidays at a monthly rate of thirty five dollars ($35.00), payable each month. (5) On Parking Lot No. 12, reserved parking for nonmetered spaces shall be between the hours of six o'clock (6:00) A.M. and six o'clock (6:00) P.M. daily, excluding Saturdays, Sundays and holidays at a monthly rate oftwentv:f,.. dollars ($25.00), payable each month. 1:1Ve Notice of such restrictions, as provided for in this Section, shall be displayed at each lot. The owner or operator of any vehicle who shall receive notice either personally or by the attaching of such notice to said vehicle if said vehicle is parked in violation of this subsection shall, when such notice is served upon such owner or operator or attached to said vehicle, pay to the City Treasurer as a penalty for such violation the sum of five dollars ($5.00). Van Milligen, City Manager SUBJECT: Amendment to Section 32 City of Dubuque Code of Ordinances Parking System Supervisor Cindy Steinhauser is recommending an amendment to Sections 32-311 and 32-314 of the City of Dubuque Code of Ordinances. This change will remove the following lots from the parking system: Lot #8: Sold to American Trust as part of their branch facility construction at 9th and Locust Streets. . Lot #9: Sold to a developer for construction of the CIGNA building. Lots #4 & #11: Displaced to construct the new parking ramp at 4th and Iowa Streets. Also, two new lots, at 4th Street and Central Avenue and 3rd and Main Streets will be added to the system. Section 32-311 of the Code of Ordinances provides for the designation of municipal parking lots and Section 32-314 establishes the time and fee schedule for specific lots. Economic growth in the downtown area over the past year has led to the removal of several parking lots from the system. Included in this are the following: Lot #8 - Located on 10th & Bluff Streets was sold to American Trust as part of their improvements to the branch facility and parking lot on 9th & Locust Lot # 9 - Located on the Plaza adjacent to the 5th Street land, this was sold to a developer to make way for the new CIGNA facility. Lot #4 & #11 - Located on 4th & Iowa Streets is now being developed by the City of Dubuque as a structured parking facility. Based upon the above changes in the system, the above mentioned lots need to be removed from the Code of Ordinances. In addition, the City has acquired property on the corner of 4th Street and Central Avenue and on Third and Main Streets with the intent to create two new surface parking lots. These lots needs to be added to Section 32 of the Code of Ordinances.
