SUBJECT: US 20 Bridge - Right-of-Way
On September 16, 2002, the City of Dubuque entered into an agreement with the Iowa
Department of Transportation to provide the necessary right-of-way for the construction
of a new US 20 bridge crossing the Mississippi River. A part of this agreement stated
that the City would provide City lands without cost to the Iowa DOT.
City Engineer Gus Psihoyos recommends City Council approval of the Purchase
Agreement and Quit Claim Deed for Parcel No. 104 to the Iowa Department of
Transportation for the mutual benefit of both parties.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: US 20 Bridge - Right-of-Way
On September 16, 2002, the City of Dubuque entered into an agreement with
Iowa DOT to provide the necessary right-of-way for the construction of a new US
20 bridge crossing the Mississippi River. A part of this agreement stated that the
City would provide City lands without costs to the Iowa DOT. Parcel No. 104,
lying east of Terminal Street south of the existing Julien Dubuque Bridge, is a
59,230 square foot parcel, of which 25,258 square feet is right-of-way for the
existing Julien Dubuque Bridge.
The Acquisition Plat indicates easements for existing and proposed sewers in the
area to be disposed of. The purchase agreement for Parcel No. 104 indicates
the conveyance to be for the "mutual benefit" of both the City and the Iowa DOT.
Sitco, Inc., a tenant on the premises, is currently in discussion with the Iowa DOT
on leasehold rights.
The Iowa DOT has prepared the Quit Claim Deed for this transaction.
I recommend that the public hearing be held on the approval of the Purchase
Agreement for Parcel NO.1 04 for Iowa DOT Project BRF-20-9(158)-38- for the
disposal of said Parcel No. 104 to the Iowa Department of Transportation for the
mutual benefit of both parties.

RESOLUTION DISPOSING OF CITY INTEREST IN A PARCEL OF
LAND LOCATED IN GOVERNMENT LOT 3 OF SECTION 30, TOWNSHIP 89
NORTH, RANGE 3 EAST OF THE 5TH P.M., DUBUQUE, IOWA
Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on this11 th day of March , 2005,
the City Council of the City of Dubuque, Iowa met on the 21st day of
March , 2005, at 6:30 p.m. in the Public Library Auditorium, 360 West 11
Street, Dubuque, Dubuque County, Iowa to consider the proposal for the
conveyance of the interest of the City of Dubuque in the following real estate
described as:
A parcel of land located in Government Lot 3 of Section 30, Township 89
North, Range 3 east of the 5 P.M., City of Dubuque, Dubuque County, Iowa, as
shown on Acquisition Plat Exhibit A dated February 22, 2005, attached hereto
and by this reference made a part hereof.

Whereas, the City Council of the City of Dubuque, Iowa overruled any and
all objections, oral or written to the proposal to convey such real estate, except
for easement as noted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the conveyance of City of Dubuque real property
described as parcel of land located in Government Lot 3 of Section 30, Township
89 North, Range 3 east of the 5 P.M., City of Dubuque, Dubuque County, Iowa,
as shown on said Acquisition Plat Exhibit A dated February 22, 2005, to the State
of Iowa be and the same is hereby approved for the sum of publication, platting
and filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. The City of Dubuque reserves unto itself a perpetual
easement including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining storm and sanitary sewer drainage, as shown on said Acquisition
Plat Exhibit A dated February 22, 2005.
Section 3. That the Mayor be authorized and directed to execute a Quit
Claim Deed, and the City Clerk be and is hereby authorized and directed to
deliver said deed of conveyance to the State of Iowa.
Section 4. That the City Clerk be and is hereby authorized and directed
to record a certified copy of this resolution in the offices of the City Assessor,
Dubuque County Recorder and Dubuque County Auditor.

1. This Agreement is between the City of Dubuque hereinafter designated the "CITY", and the
Iowa Department of Transportation, Highway Division, hereinafter designated the "DOT"
and in accordance with Iowa Code Sections 28E.12 and 306A.7.
2. The CITY hereby agrees that the DOT shall acquire rights of way for construction ofa new
U.S. 20 bridge crossing, of the Mississippi River, between the Cities of Dubuque, Iowa and
East Dubuque, Illinois.
3. The CITY hereby agrees that said right of way be acquired and paid for by the DOT and said
acquisition shall be carried out in the following manner:
In connection with this project, any real estate and. easements necessary for right of
way to construct the connection of any city street or alley on a primary highway
relocation or reconstruction project, as well as any recreational trail, access road or
frontage road rights of way, if any, which are or shall be under the jurisdiction of the
CITY, may be acquired by the DOT, for and in the name of the CITY. Where acquired
by contract, the CITY shall receive and agrees to accept title from the contract seller.
Where condemnation proceedings are necessary, a single joint condemnation
proceeding shall be instituted by the DOT to acquire necessary property rights for the
CITY and DOT.
4. Also as part of this project, the CITY shall be responsible for providing, without cost to the
DOT, any right of way for the project which involves dedicated streets or alleys, and any
other city-owned lands, except park land, which are required for the project subject to the

condition that the DOT shall reimburse the CITY for the value of improvements situated on
such other city-owned lands. The CITY has apprised itself of the value of these lands, and as
a portion of their participation in the project, voluntarily agrees to make such lands available
without further compensation. The DOT shall be responsible for acquisition of all other right
of way.
5.- Access rights may be acquired by the DOT along all city street intersections within the
project limits. Access rights, if acquired, will be in the name of the State of Iowa. The
acquisition of access rights will be in accordance with 761 Iowa Administrative Code
Chapter 112.11(8) and the 2002 DOT Access Control regulations.
If the CITY feels that it is in the best interest of the parties involved to modify the access
rights in any way, they may petition the DOT District 6 Engineer to do so.
6. TIlls Agreement may be executed in two counterparts, each of which so executed shall be
deemed to be an original and both shall constitute but one and the same instrument.

4. Possession of the premises is the essence of this agreement and Buyer may enter and
assume full use and enjoyment of the premises per the terms of. this agreement. SELLER
GRANTS Buyer the immediate right to enter the premises for the purpose of gathering
survey and soil data. SELLER MAY surrender possession of the premises or building or
improvement or any part thereof prior to the time at which he has hereinafter agreed
to do so, and agrees to give Buyer ten (19) days notice of Seller's intention to do
so by calling Buyer collect.
5. SELLER WARRANTS that there are no tenants on the premises holding under lease except:

6. This agreement shall apply to and bind the legal successors in interest of the Seller
and SELLER AGREES to pay all liens and assessments against the premises, including
all taxes and special assessments payable until surrender of possession as required
by the 'Code of Iowa, and agrees to warrant good and sufficient title. Names and

7. Buyer may include mortgagees. lienholders, encumbrancers and taxing authorities as
payees on warrants issued in payment of this agreement. In addition to the Total
Lump Sum, Buyer agrees to pay ~for the cost of adding title documents required
by this transaction to Seller's abstract of title. If requested to do so, SELLER WILL
deliver to Iowa Department of Transportation. Office of Right of Way. B99 Lincolnway.

abstract cQntinuation. SELLER AGREES to provide such documents as may be required by
Iowa Land Title Standards to convey merchantable title to the Buyer. SELLER ALSO
AGREES to obtain court approval of this agreement. if requested by Buyer. in the
event title to the premises becomes an asset of any estate, trust. conservatorship or
guardianship. Buyer agrees to pay court approval costs and all other costs necessary
to transfer the premises to Buyer. but not attorney fees. Claims for such transfer
costs shall be paid in amounts supported by paid receipts or signed bills.
8. Buyer agrees that any agricultural drain tiles that are located within the premises
and are damaged or require relocation by highway construction shall be repaired or
relocated at no expense to Seller. Where Buyer specifically agrees to construct and
maintain fence. the fence shall be constructed and maintained for vehicle access
control purposes only at no expense to Seller. Buyer shall have the right of entry
upon Seller's remaining property along the right of way line, if necessary, fo~ the
purpose of cpnnecting said drain tile and constructing and maintaining said. fence.
Seller may pasture against said fence at his own risk. Buyer will not be liable for
fencing private property or maintaining the same to restrain livestock.
9. If Seller holds title to the premises in joint tenancy' with full rights of
survivorship and not as tenants in common at the time of this agreement. Buyer will
pay any remaining proceeds to the survivor of that joint tenancy and will accept
title solely from that survivor, provided the joint tenancy has not been destroyed by
operation of law or acts of Seller.
19. These premises are being acquired for public purposes and ;his transfer is exempt
from the requirements for the filing of a Declaration of Value by the Code of Iowa.
11. Buyer hereby gives notice of Seller's five-year right to renegotiate construction or
maintenance damages not apparent at the time of the signing of this agreement as
required by the Code of Iowa.
12. This written agreement constitutes the entire agreement between Buyer and Seller and
there is no agreement to do or not to do any act or deed except as specifically
provided for herein.
13. Seller states and warrants that, to the best of Seller's knowledge. there is no
burial site. well. solid waste disposal site, hazardous substance. nor underground
storage tank on the premises described and sought herein except none.
