Sealed bids were received by the Iowa Department of Transportation for the reinforced
concrete box (RCB) culvert extension of the University Avenue Reconstruction Project.
City Engineer Gus Psihoyos recommends award of the contract to the low bidder,
Tschiggrie Excavating Co., in the amount of $1,396,624.11, which is 6.5% under the
engineer's estimate.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Reinforced Concrete Box (RCB) Culvert Extension (Twin Box)
INTRODUCTION
The enclosed resolution provides for the award of the reinforced concrete box (RCB)
culvert extension of the University Avenue Reconstruction Project.
BACKGROUND
This work is the first construction phase of the project through which University Avenue
will be extended to the south to intersect with US Highway 20 across from Theisen's
driveway. This initial phase includes construction of a double-barrel, 12- by 12-foot box
culvert as well as grading of the embankment for the future street. Upon completion of
this work, a follow-up construction phase will be necessary to provide the pavement,
traffic signals and other work necessary to complete the project. The overall project is
intended to contribute to the improved flow of traffic and decrease in intersection
congestion along the US Highway 20 corridor in the western portion of the City.
DISCUSSION
The Iowa Department of Transportation (Iowa DOT) received the following bids for the
RCB culvert extension of the University Avenue Reconstruction Project on February 15,
2005:

RECOMMENDATION
I recommend that the grading and the RCB culvert extension for the University Avenue
Reconstruction Project be awarded to Tschiggfrie Excavating Co. in the amount of
$1,396,624.11, which is 6.5% under the engineer's estimate. The completion date is
anticipated for September, 2005.

agreement. City staff will be working with the Iowa DOT and the Dubuque Metropolitan
Area Transportation Study (DMATS) for additional funding to complete this project.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution awarding the RCB
Culvert Extension for the University Avenue Reconstruction Project to Tschiggfrie
Excavating Co.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
Whereas, on the 9th day of March, 2005, plans, specifications, form of contract
and estimated cost were filed with the City Clerk of Dubuque, Iowa for the University
Avenue Reconstruction (US 20 to University Avenue) - Reinforced Concrete Box (RCB)
Culvert Extension Project.
Whereas, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are
hereby approved as the plans, specifications, form of contract and estimated cost for
said improvements for said project.

AWARDING CONTRACT
Whereas, said sealed proposals were opened and read on the 15th day of
February, 2005, by the Iowa Department of Transportation (IDOT), and it has
been determined that the bid of Tschiggfrie Excavating Co of Dubuque, Iowa, in
the amount of $1,396,624.11 was the lowest bid for the furnishings of all labor
and materials and performing the work as provided for in the plans and
specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Tschiggfrie
Excavating Co., subject to the concurrence by Tschiggfrie Excavating Co., and
the Manager be and is hereby directed to execute a contract on behalf of the City
of Dubuque for the complete performance of the work.

(City is Contracting Authority; DOT does not sign contract)
The Iowa DOT has accepted and reviewed bids on behalf ofthe City for the projects
enclosed.
We have enclosed a copy of the bid tabulations for each project and 3 originals of the
contract for the City to execute with the contractor who we have determined to be the
lowest responsible bidder. To execute this contract, we ask the City to take one of the
following two options:
REJECT ALL BIDS OPTION
1. Do not contact the contractor to discuss rejection of the contract.
2. Take action to reject all bids.
3. Send written notification to the contractor of your intent to not award the
contract.
4. Send written notification to the Office of Contracts, Iowa DOT, of your action to
reject all bids, within 30 days.
AWARD A CONTRACT OPTION
1. Do not contact the contractor to discuss modifications to the contract.
2. Take action to award the contract.
3. Send 3 originals of the contract to the contractor and ask for two signed originals
to be returned to the City for the City's signature.
4. Obtain a "generic performance bond" from the contractor. Note: Bond form
181218 and bond form 181217 cannot be used as the performance bond
form on City projects.
5. Obtain a "certificate of insurance" from the contractor listing both the contractor
and City as insured parties.
6. Have the contractor sign the "storm water discharge" certification statement for
those projects where the certification is required and return to the City. This
signed certification should remain in your files and not be forwarded to the
Office of Contracts with the signed contract.

7. Two copies of the Source of Materials listing sheets have been sent to the low
apparent bidder for each contract in the last letting with the following instruction
"Receipt of the Source of Materials Listing sheet from the Iowa DOT does not
indicate that a contract will be awarded for each contract for which you are being
sent the sheets. Where a city is the contracting authority, official action is still
necessary before you can be offered a contract. "
8. After execution of the contract, the City shall send one photocopy of the contract,
one photocopy of the performance bond, one copy of certificate of insurance, and
the original of all "Subcontract Request and Approval" forms (please keep a copy
of the "Subcontract Request and Approval" form for your files) to:
Karen Lidman, Office of Contracts, Iowa DOT, 800 Lincoln Way, Ames,
IA 50010. These contract documents should be returned to the Office of
Contracts within 30 days, regardless of when the work is proposed to start. This
does not prohibit the contractor from requesting additional subcontractors during
the course of the contract. These additional subcontractor requests or changes
after the contract has been signed should be submitted to the Project Engineer
with the justification as required by the Iowa Code.
9. The City should furnish the contractor a signed original of the contract. No
work shall commence on this project until the contractor has been furnished a
signed contract.
10. The City is reminded that federal regulations may apply to this contract. The
City shall ensure compliance with all applicable civil rights, and Davis-Bacon
requirements. The Office of Contracts, Iowa DOT, will furnish the contractor
with applicable posters.
11. Please contact your District Local Systems Engineer regarding the pre-
construction meeting, and construction administration and inspection
requirements.
