1. Applicant. The Iowa Department of Transportation, 800 Lincoln Way, Ames, Iowa 50010
2. Locations.
a. Project Location: Various Creeks and wetlands in Sections 10, 11, 15, and 16, Township 89 North, Range 2 East, Dubuque
County, Iowa.
b. Mitigation Location: In a cropped area in Section 36, Township 87 North, Range 1 West, Dubuque County, Iowa.
3. Project Description. The applicant proposes to construct 2.4 miles of new four-lane divided roadway (Iowa Highway 32) along
the north side of Dubuque from John F. Kennedy Road east to U.S. Highway 521lowa Highway 3. The new highway will consist of
two 24-foot-wide roadways with 7 -foot-wide paved inside and 10-foot-wide granular outside shoulders and a raised median. The
project also includes the construction of a two lane roadway from U.S. 521lowa 3 to Iowa Highway 386 and relocations of several
existing streets. Near the westem end of the project, West 32nd Street will be relocated and run under new Iowa 32 and will
intersect with John F. Kennedy Road 870 feet north of the existing John F. Kennedy RoadlWest 32nd Street intersection. Arboretum
Drive will be relocated from 1180 feet north of the present Aroretum DrivelWest 32nd Street intersection west to connect with the
relocated West 32nd Street. Existing Arboretum Drive will be closed from approximately 260 feet north of its existing interchange
with West 32nd Street to the new Arboretum Drive relocation. Near the eastem end of the project, John F. Kennedy Road will be
relocated to intersect proposed Iowa 32 1,000 feet west of U.S. 521lowa 3. Several small tributaries of the Little Maquoketa River
will be crossed using concrete box culverts. Two of the larger crossings will involve channelizations. One crossing site, at U.S.
52/lowa 3, currently consists of a 711-foot-long straight open channel and a 109-foot-long box culvert. It will be modified to a new
134-foot-long straight open channel and a 782-foot-long box culvert. The second crossing site currently consists of a 445-foot-long
open channel. It will be modified to a 169-foot-long box culvert and 231 feet of new open channel. All abandoned channels will be
filled. A bridge will be constructed on proposed Iowa 32 over relocated West 32nd Street. Bike trail embankment will be constructed
generally along the south and east sides of the new highway. The bike trail is not scheduled for surfacing at this time.
Approximately 1.5 acres of forested wetland and 1.4 acres of emergent wetland will be adversely impacted with this project. The
impacts will result from placement of embankments, clearing of vegetation, and excavation. To compensate for the wetland losses,
the applicant proposes to restore and create 1.8 acres of forested wetland and 2.5 acres of emergent wetland on a currently-farmed,
3D-acre parcel of land approximately 20 miles southwest of the project site. A small berm will be constructed adjacent to a small,
previously channelized creek and a non-perforated tile line will be used to divert water from the creek to the area inside the berm. A
Wisconsin outlet will be used to assist in controlling water depth. Flood tolerant trees ranging in size from three to four feet tall will
be planted along the east siqe,of m,~(f~e.~t~restored wetlands. The rest of the area will be allowed to revegetate naturally. Long

4. Agency Review.
a. Department of the Army, Corps of Engineers. The Department of the Army application is being processed under the
provisions of Section 404 of the Clean Water Act (33 U.S.C. 1344).
b. State of Iowa. The project plans have been submitted to the Iowa Department of Natural Resources for state certification of
the proposed work in accordance with Section 401 of the Clean Water Act. The certification, if issued, will express the Department's
opinion that the proposed activity will comply with Iowa's water quality standards (Chapter 61 lAC). The applicant has also applied
for authorization of work in the floodplain pursuant to Chapter 455B of the Iowa Code and other applicable state permits. Written
comments concernina possible impacts to waters of Iowa should be addressed to: Iowa Department of Natural Resources. 900
East Grand Avenue. Des Moines. Iowa 50319. A copy of the comments should be provided to the Corps of Engineers office (see
paragraph 11. of this public notice for address).
b. State of Iowa. A copy of the application has been submitted to the Iowa Department of Natural Resources for review. The
applicant has also applied for authorization of work in the floodplain pursuant to Chapter 455B of the Iowa Code and other
applicable state permits.
5. Historical/Archaeological. The permit application states that ''the State Historical Society of Iowa (SHSI/SHPO) has been
coordinated with regarding the presence of historic or cultural resources in the project area. For purposes of compliance with
Section 106 of the National Historic Preservation Act, the project area or Area of Potential Effect (APE) is defined to include all
lands, buildings, facilities, or other properties as may be affected by the project as described in item 2 above. Archeological survey
and testing within the APE identified two historic properties that are eligible for listing on the National Register of Historic Places
(R&C# 950200106 and R&C# 961131054). The Federal Highway Administration has determined that this undertaking will have an
Adverse Effect on sites 1308493 and 1308497 and provided notification with summary documentation to the Advisory Council on
Historic Preservation by letter dated June 1, 2000 pursuant to 36 Code of Federal Regulations 800.6(a)(1) and 800.11 (e). Based on
this determination, the Corps has determined that activities associated with this undertaking constitute an adverse effect to sites
1308493 and 1308497 and will require the applicant to provide the SHPO's current written opinion of the project as described in
this public notice.
6. Endangered Species. District staff have performed a preliminary review of this application for the potential impact on threatened
or endangered species pursuant to Section 7 of the Endangered Species Act as amended. Our preliminary determination is that the
proposed activity is not likely to adversely affect any listed species or critical habitat. Therefore, no formal consultation has been
initiated with the United States Fish and Wildlife Service at this time. However, this preliminary determination is subject to change
should further information become available.
7. Dredge/Fill Material Guidelines. The evaluation of the impact of the proposed activity on the public interest will also include
application of the guidelines promulgated by the Administrator of the United States Environmental Protection Agency under authority
of Section 404(b) of the Clean Water Act (40 CFR Part 230).
8. Public Interest Review. The decision whether to issue the Corps permit will be based on an evaluation of the probable impact
including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concem for both
protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must
be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered
including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concems,
wetlands, cultural values, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and
accretion, recreation, water supply and conservation, water quality, energy needs, safety, food production and, in general, the needs
and welfare of the people.
9. Who Should Reply. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and
officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any
comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit
for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water
quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act.
Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed
activity. These statements should be submitted on or before the expiration date specified at the top of page 1. These statements
should bear upon the adequacy of plans and suitability of locations and should, if appropriate, suggest any changes considered
desirable.

10. Public Hearing Requests. Any person may request, in writing, within the comment period specified in this notice, that a public
hearing be held to consider this application. Requests for public hearings shall state, with particularity, the reasons for holding a
public hearing. A request may be denied if substantive reasons for holding a hearing are not provided.
