Leisure Services Manager Marie Ware recommends City Council approval of an
Agreement between Dubuque Community School District and AmeriCorps for the 2011-
2012 school year for AmeriCorps members to serve in elementary, middle and high
schools in the Dubuque Community School District.

The purpose of this memo is to recommend approval of the agreement between
Dubuque Community School District and AmeriCorps for the 2011 — 2012 school year.
BACKGROUND
The City has had a ten plus year partnership in providing AmeriCorps members to serve
in elementary, middle and high schools in the Dubuque Community School District. An
agreement between the two parties has been signed each year.
RECOMMENDATION
After city attorney review I now recommend approval of the agreement.

AGREEMENT
BETWEEN
THE CITY OF DUBUQUE
and
THE DUBUQUE COMMUNITY SCHOOL DISTRICT
for
AMERICORPS SERVICES
for
School Year 2011 -2012
This agreement, dated for reference purposes the day of November, 2011, is
made and entered into by and between the City of Dubuque (City) and Dubuque Community
School District (School District).
Whereas, School District and City have a strong desire and commitment to continue
the services of AmeriCorps so that all youth will perform academically at grade level and
families and children will have access to sage and supportive learning environments.
Whereas, it is necessary to define the roles of the parties in providing such services to
the elementary, middle and senior high schools.
Now, therefore, it is agreed by and between the parties as follows:
SECTION 1. ROLE OF AMERICORPS.
1.1. School District agrees to permit AmeriCorps volunteers assigned by City to
provide educational and recreational services to students at Audubon, Bryant, Carver,
Eisenhower, Fulton, Hoover, Irving, Kennedy, Lincoln, Marshall, Prescott, Sageville and Table
Mound Elementary Schools, Jefferson, Roosevelt and Washington Middle Schools; Hempstead
and Senior High Schools and students at the Alternative Learning Center and Connect
program at a schedule to be determined by the schools involved and in a competent and
professional manner to the satisfaction of School District.
1.2. AmeriCorps volunteers acting within the scope of their duties shall be
considered City employees.
1.3. City shall comply with all the employment laws of the State of Iowa, hold School
District harmless from and against any and all liability and all loss, damage and
expense, resulting from the negligence of City, its officers, agents or
employees. School District shall defend, indemnify, and hold harmless City, its
officers and employees, from and against any and all claims arising out of or
relating to School District's negligence.
1.4. City will name the School District as an additional insured on a primary and non-
contributory basis on its insurance contract with the Iowa Communities
Assurance Poll with limits of not less the $2,000,000. School District will name
City as an additional insured on a primary and non - contributory basis on its
general commercial liability insurance policy.
SECTION 2. COMPENSATION. School District shall compensate City for the services of
the AmeriCorps volunteers at a rate of $3.00 per hour but not to exceed Thirty Eight
Thousand One Hundred Dollars and No Cents ($38,100.00), payable as follows:
a) City shall invoice School District for the volunteer services by March 30, 2012.
b) School District shall pay City for such services by April 10, 2012.
SECTION 3. TERM. The term of this Agreement shall be for the school year 2011 -2012.
However, either party may terminate this Agreement with or without cause upon thirty (30)
days written notice to the other party.
