Leisure Services Manager Marie Ware recommends City Council acceptance of the
Iowa 32 Bike /Hike Trail Phase 3 Project (between Plaza Drive and Payton), as
completed by Drew Cook & Sons Excavating, in the final contract amount of $136,946,
which was $6,654 below the bid amount of $143,600. A change order was processed
to add a 24" pipe for drainage and the trail was re- aligned.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The purpose of this memorandum is to recommend that the City Council accept the
Iowa 32 Bike /Hike Trail Phase 3 Project (between Plaza Drive and Payton).
DISCUSSION
The Iowa 32 Bike /Hike Trail Phase 3 Project has been completed by Drew Cook & Sons
Excavating in the final contract amount of $136,946. A summary of the project costs is
as follows:

A change order was processed to add a 24" pipe for drainage. The trail was re- aligned
which caused a credit of $9,078 to the project. Engineering costs were reduced for the
project as preliminary engineering was completed to apply for other grants. Those
costs were paid in previous fiscal years and projects and are not grant eligible.
A $200,000 R.E.A.P. grant was received to fund this project.
ACTION STEP
The action requested is that the City Council adopt the attached resolution accepting
the improvement and setting the final cost.

RESOLUTION NO. 355 -11
ACCEPTING THE IOWA 32 BIKE /HIKE TRAIL PHASE 3 PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Iowa 32 Bike /Hike Trail Phase
3 Project (the Project) has been completed and the City Engineer has examined the
work and filed a certificate stating that the Project has been completed according to the
terms of the Public Improvement Contract and that the City Engineer recommends that
the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor
from the Iowa 32 Bike /Hike Trail Phase 3 Project appropriation for the contract amount
of $136,946 less any retained percentage provided for therein as provided in Iowa Code
chapter 573, and to pay such retainage only in accordance with the provisions of Iowa
Code chapter 573.
