Dear City Clerk,
In response to the Notice to Property Owners we recently received regarding the
South Fork Sanitary Sewer Project-Phase IT, we at 12801 Nightengale Lane decline
any interest at this time in being connected to this system and object to being
assessed connection fees.
We (Kevin and Diane Torrey) object for the following reasons:
1. The City of Dubuque achieved easement through our property in two different
areas, and we feel that we have given enough to this project.
2. The City Started condemnation proceedings against us on land that we felt was
worth what we were asking for in price. Before any easement was achieved,
land that wasn't in easement planning was bull dozed. We met with Barry
Lindahl and Gus Psihoyos in regard to the condemnation proceedings. We
reached an agreement that land outside of the easement was not to be used.
When the contractor started construction through our property, they used 75
feet ofland that was not agreed upon in the easement.
3. We have been working on getting compensation for the land used out of
easement, and a fence that was removed at the time of construction. The city
won't replace the fence or the boundary markers that have been removed.
Due to the misinformation from a Dubuque lawyer, proceedings regarding land
used outside of easement, loss of fence and boundary markers, we do not feel
we should be assessed for this project.

In response to the Notice to Property Owners we recently received regarding the
South Fork Sanitary Sewer Project - Phase II, we at 12805 (or 3165 as is what we
use as our correct mailing address) Nightengale Lane decline any interest at this
time in being connected to this system.
In my phone conversation with Jeanne Schneider earlier today, I was informed we
really only need to respond if in fact we are interested in proposing a connection.
Although we are not interested, I did want to respond to that effect for the
record. We do, however, appreciate the offer, and your consideration.

AN ORDINANCE ESTABLISHING THE SOUTH FORK SANITARY SEWER
PROJECT - PHASE II CONNECTION FEE SCHEDULE FOR THE
CONNECTION OF PROPERTY TO SAID CITY SEWER
Whereas, after full consideration of the final connection fee schedule showing the
connection fees proposed to be made for the South Fork Sanitary Sewer Project - Phase
II, which schedule of connection fees was filed in the office of the City Clerk on the

Whereas, the City Council has determined that the amounts shown on said
schedule are proper and are in proportion to the benefits conferred; and
Whereas, the City Council further finds that the South Fork Sanitary Sewer Project-
Phase II connection fee schedule should be approved and adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. There is hereby established the South Fork Sanitary Sewer Project -
Phase II connection fee schedule for the connection of property to said City sewer,
attached hereto.
Section 2. At the time of connection of property to said City sewer, the owner shall
pay a connection fee to the City, as shown on the schedule attached hereto in the full
amount if the entire property is connected to said City sewer, or pro-rated on the basis of
the percentage of area connected as to the total acreage, if only a portion of the property
is connected.
Section 3. Such connection fee shall be due and payable when a sewer connection
application is filed with the City Engineer. All fees collected under this Ordinance shall be
paid to the City Treasurer.
