ORDINANCE NO. 86-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED NEAR 3160 CEDAR
CROSS COURT FROM AG AGRICULTURAL DISTRICT TO R-1 SINGLE-
FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from AG Agricultural District to R-1 Single-Family Residential District, to wit:
Lot 3 of Mineral Lot 221, and to the center line of the adjoining public right-
of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

The subject property was annexed to the City of Dubuque in the
Physical Characteristics: The subject property generally slopes to the northeast and is
below the grade of either or both Cedar Cross Court or Cedar Cross Road. A portion of
the property lies within the Catfish Creek flood plain.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan designated
the subject property for park and open space.
Impact of Request on:
Utilities: Sanitary sewer is available to the site, whereas water would have to be
extended from Cedar Cross Court to serve the subject property.
Traffic Patterns/Counts: No traffic counts are available for Cedar Cross Court.
Public Services: the applicant will have to coordinate appropriate access to the
house site with the Fire Marshal's Office to ensure adequate accessibility for
emergency services.
Environment: Staff does not anticipate any adverse impact to the environment.
Adjacent Properties: Staff does not anticipate any adverse impacts to adjacent
properties from the construction of a single-family residence. There is significant
spacing between businesses on Cedar Cross Court and Hughes Court from the
proposed single-family home site.

CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of an eight acre parcel from AG
Agricultural to R-1 Single-Family Residential. The applicant is the owner of Dolphin's
Custom Cabinets that has access onto Cedar Cross Court. Access to the subject
parcel would be through Mr. Dolphin's property on Cedar Cross Court.
The subject property was not designated as part of the 1995 Comprehensive Plan but
was shown as existing park and open space. The subject property lies between the
Commercial Service and Light Industrial zoned properties that are served by Cedar
Cross Court and Hughes Court. The area lies below the adjacent businesses and
surrounding roadways in the Catfish Creek valley. The request is unique in that it was
not anticipated that residential property could be developed in this area because of the
lack of available access into and out of the area. The applicant in this case has a
unique opportunity, because of his ownership of property fronting on Cedar Cross
Court. The applicant has contacted the Fire Marshal's Office in regard to laying out an
appropriate access that emergency services can utilize in an emergency situation.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes standards for review of the rezoning request.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that the reqzoning will allow him to
build a new single-family home. Staff reviewed surrounding zoning and land use, and
noted that the applicant has reviewed access with the City's Fire Marshal.
The Zoning Advisory Commission discussed the request, noting that access to the property
will be paved and the proposed R-l zoning will not adversely impact adjacent property.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve.
A simple majority vote is needed for the City Council to approve the request.
