AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY lOCATED ALONG KATHY DRIVE
FROM R-1 SINGLE-FAMilY RESIDENTIAL DISTRICT TO R-2 TWO-FAMilY
RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from R-1 Single-Family Residential District to R-2 Two-Family Residential District, as
shown in Exhibit A, and to the center line of the adjoining public right-of-way, all in the
City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The subject property was platted for single-family homes in May,
1994. The construction of single-family homes has been slow to develop, but recently
several single-family homes have been built on platted lots.
Physical Characteristics: The subject property is located on the south side of the city of
Dubuque. The property is relatively flat except for the northwest corner of the site,
which slopes to the north.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan designated
the area for a mixture of single-family and multi-family residential development.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the proposed development.
Traffic Patterns/Counts: Jaeger and Kathy Drives are both designated as
residential streets. No traffic counts are available for either street.
Public Services: Existing public services are adequate to serve the proposed
development.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided and storm water is adequately
handled.
. Adjacent Properties: The proposed rezoning from R-1 to R-2 will not significantly
impacted adjacent properties other than a slight increase in the volume of traffic
generated from the site once fully developed.

CIP Investments: None proposed.
Staff Analysis: The applicant, Lloyd S. Gudenkauf, is requesting rezoning of the
subject parcel of land from R-1 Single-Family Residential District to R-2 Two-Family
Residential District. The property is located along a future extension of Kathy Drive in
the Jaeger Heights Subdivision.
When originally platted in 1994, the lots were designated for development of single-
family homes. Recently, the applicant has received inquiries about construction of
duplexes or two-unit town homes that have been popular on the west side of Dubuque.
These structures contain two units with off-street parking and garages for each unit.
Some of these units are subsequently subdivided along a common wall and both sides
sold off individually as townhouses. This style housing has been a popular option for
those who do not want or need a larger single-family residence.
The proposed area for rezoning abuts to the south the existing Tower Hills mobile
home park. The proposed R-2 zoning would be compatible with the adjacent mobile
home park and would serve as a transition zone from the park to the single-family
homes fronting on Barbara Drive. Attached to this staff report is a map indicating the
. area to be rezoned and the layout of Jaeger Heights Subdivision.
Staff recommends the Zoning Advisory Commission review Section 6-1.1 of the Zoning
Ordinance that establishes criteria for rezoning requests.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request stating R-2 zoning allows to build duplexes or
single-family homes on the subject lots. Staff reviewed surrounding zoning and land use
and noted that Tower Hills Mobile Home Park is adjacent to the property on the south side.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that R-2 zoning has been
used in several other subdivisions and has been very successful in providing an additional
housing alternative.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
