ORDINANCE NO. 88-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED ALONG JULIEN
DUBUQUE DRIVE FROM PI PLANNED INDUSTRIAL DISTRICT TO R-1
SINGLE-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from PI Planned Industrial District to R-1 Single-Family Residential District, to wit:
Lot 1 of Lot 1 NW 1/4 of the NE 1/4, Lot 1 of Lot 1 of Fractional Government
Lot 1, Lot 1 of Rock Cut Subdivision, Lot A of Government Lot 1 and Lot 3
Fractional Government Lot 1 all in Section 6, T88N, R3E, 5th P.M., in City of
Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the. ,
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upop publication, as
provided by law: ' ,

Property History: The subject property was the former location of the Koch Supply
Company which manufactured sulfuric acid at this site from 1948 to 1986. The current
property owner, Mr. Klauer, purchased the property in 1994 after the site had been
abandoned and up for sale from 1986 to 1994. In 1998, there was a proposal to utilize
the area for an auto repair/salvage and junk yard that ultimately did not locate on the
property because of conditions established for enclosing the operation by the City
Council.
Physical Characteristics: The subject property is located in the Riprow Valley, which is
situated between two Mississippi River bluffs. The valley lies 30-50 feet above the
flood plain. Two railroads are located in the valley: Illinois Central and Union Pacific.
The project site has riverfront access and also can be reached by Julien Dubuque
Drive.
Concurrence with Comprehensive Plan: The subject property is not included as part
of the 1995 Comprehensive Plan.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: Julien Dubuque Drive is classified as a collector street;
however, there are no vehicle counts available.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
because of the requested rezoning, and the proposed rezoning would have less of

an impact on the environment than leaving the property zoned as Planned
Industrial.
Adjacent Properties: Staff does not anticipate any significant negative impacts to
the adjacent property from the rezoning of it to R-1 Single-Family Residential.
CIP Investments: The City of Dubuque is a partner in the proposed project to
develop the 26-acre parcel that will include a picnic area, parking lot, prairie and
hiking trail on the 7-acre parcel currently owned by the City, and a girls softball
complex on the 19-acre parcel currently owned by Mr. and Mrs. Klauer.
Staff Analysis: The requested rezoning is to rezone property at the end of Julien
Dubuque Drive from PI Planned Industrial District and County A-1 Agricultural District
to R-1 Single-Family Residential District. The requested rezoning is to allow
development of a recreational facility that includes a picnic area, parking lot, prairie,
hiking trail and girls softball complex. The 26-acre project is comprised of a 19-acre
parcel owned by Mr. and Mrs. Robert Klauer and a 7 -acre parcel currently owned by
the City of Dubuque.
The requested rezoning to R-1 Single-Family Residential is being sought as this district
allows parks as a permitted use. The POS Public Open Space does not allow active
recreational uses which is the intent of the proposed Riprow Valley Restoration Project.
In addition to the recreational facilities provided on the 26-acre parcel, the Heritage
Trail will be connected with the Riprow Valley and the existing recreational amenities of
the Mines of Spain State Recreation Area.
In conjunction with the rezoning, a small portion of the riverfront and Mississippi River
will be annexed to the City of Dubuque from the County. The property is currently
zoned County A-1 and will also be rezoned to R-1 Single-Family Residential as part of
this rezoning request.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes criteria for reviewing rezoning requests.

The Oty of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
Planning Services Manager Laura Carstens representing the City of Dubuque, spoke in favor of
the request reviewing history of the site, the proposed recreation facilities and compatibility of
the proposed development to surrounding land uses.
Regina Thibeau, speaking on behalf of the Riprow Valley Coalition, spoke in support of the
request as a benefit to the community and preserving the history of Dubuque. Sister Mira
Mosie, representing Sisters of Charity, BVM, Mt. Carmel, spoke in support of the rezoning.
The Zoning Advisory Commission discussed the request, noting that the proposal is consistent
with the Comprehensive Plan and will not adversely impact adjacent property owners.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.
