NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Appendix A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by amending Section 4-3.5(c) as follows: 4-3.5. Exempted signs. The following types of signs are exempted from the requirements of this Ordinance: (C) Political signs displayed not more than forty-five (45) days prior to the governmental election to which they apply, and removed within seven (7) days of such election. Such signs shall not be placed in any public right of way or in visibility triangles as defined in Section 4- 4.6(5) corner lots. Signs placed in a Residential District shall be limited to four (4) square feet in size and may not be illuminated. Section 2. That the foregoing has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. This ordinance shall take effect immediately upon publication. SUBJECT: Proposed Text Amendment to Section 4-3.5 (c) concerning Limitation on the Size of Political Signs INTRODUCTION The Zoning Advisory Commission is being asked to review a proposed text amendment to Section 4-3.5(c) that would amend the City's regulations concerning political signs to provide for a limitation on the size of political signs in residential districts. DISCUSSION David S. Hartig, Jr. has submitted an application to amend the City's Sign Regulations Section 4-3.5(c) that would establish a limitation of four square feet for political signs in residential areas. In addition, these signs would be prohibited from being illuminated. Currently, there are no limitations on the size of political signs in the City of Dubuque. Generally, staff has observed that political signs generally are small in size and are placed on private property. In the past, staff has had some minor problems with a few political signs placed in the right-of-way; however, this has not been the rule. Staff has also observed that typically national candidates signs are mass produced and of relatively small size. However, some State candidates do have larger signs made out of painted plywood and held in place by more substantial fence posts. Attached to this memo is a draft ordinance that inserts the new language into Section 4- 3.5(c). In addition, the section of the ordinance as it currently reads is also attached to this memo. RECOMMENDATION Planning staff recommends the Zoning Advisory Commission review the attached information and make a recommendation to the City Council on the proposed text amendment to establish size restriction for political signs. The application, staff report and related materials are attached for your review. Discussion Staff reviewed the proposed text amendment indicating that political signs placed in residential areas would be restricted to a maximum size of four square feet. There were no public comments. The applicant was not in attendance. The Zoning Advisory Commission discussed the request, noting that real estate signs currently are allowed to be up to 12 square feet in size, and to restrict political signs to four square feet would be inconsistent. The Commission also noted a lack of enforcement history in regard to large political signs. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council deny the request. The first is a request to delete any time frame for these signs, allowing political signs to be displayed on residential lots at anytime during the year. The city attorney has indicated that the city is legally bound to allow this. The second decision relates to the size of the signs. Currently, there is no size limitation for political signs on residential proper;ty. Potentially, 32 square foot or larger signs could be displayed year round on residential lots. In order to make residential signage uniform, several interested citizens are asking the council to approve a six square foot limitation on such signs. (I had inadvertently asked the zoning Advisory Commission for a four foot limitation, when in fact, there exists a six foot limitation for all other permitted signage on single lot residential property.)
