Duggan and members of the City Council Date: September 28, 2000 Re: Mona Turner Claim Claimant Date of Claim Date of Loss Nature of Claim Mona Turner Claim 7/25/00 12/12/99 vehicle damage This is a claim for damages to the claimant's parked vehicle, which it allegedly sus~ained when a Dubuque police officer "shoved [the claimant's] son into the side of the van to arrest him." Based upon a review of the arresting officer's report, it is the recommendation of the Legal Department .that this claim be denied. The cause of the damage was the conduct of the claimant's son, which resulted in his arrest. There was no unreasonable conduct on the part of the police officer that caused or contributed to the damage. When the females saw me, they attempted to get Marcov moving to leave. I continued down Central and made a second pass at which time Marcov was still yelling. At this time, I told him that he needed to get into the van with the females, leave and not say another word. Marcov began to walk away and stated ''this is fucking buIIshit". At this point, Marcov was taken into custody and placed under arrest for jubIic intoxication. Marcov was attempting to get into a van that was parked on 17 Street, just west of Central Ave. I do not recall at any time pushing Marcov into the side of the van. I do recall pulling him out of the van as he was trying to get in. I do not recall ever scratching the side of Turner's van with my belt or with Marcov.
