RESOLUTION NO. 500-00
RESOLUTION APPROVING THE FINAL PLAT OF BRUGGEMAN ACRES,
FIRST ADDITION, IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a final plat of Bruggeman
Acres, First Addition, in Dubuque County; and
Whereas, said plat provides 0 feet of frontage for Lots 2 and 3, where 60 feet is
required by Section 42-19 (b) Subdivision Regulations; and
Whereas, said plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19 (b) of the Subdivision Regulations is waived to
allow Lots 2 and 3 to have 0 feet of frontage, where 60 feet is required.
Section 2. That the final plat of Bruggeman Acres, First Addition, is hereby
approved, and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa, upon said final plat.

INTRODUCTION
The submitted final plat of Bruggeman Acres, First Addition, subdivides an existing lot
into three lots for sale to abutting property owners. The submitted final plat is for
property in Dubuque County that is within two miles of the City of Dubuque corporate
limits. The plat is jointly reviewed by both the City and the County.
. DISCUSSION
The applicant, William Bruggeman, is seeking to sell Lot 2 and Lot 3 to adjacent
property owners. The future owner of Lot 2 currently resides on Cedar Point Court,
while the future owner of Lot 3 has an existing house and lot with frontage on Lake
Eleanor Road. The purpose of the platting of the lot is to allow these two individuals to
purchase property to increase the size of their lots. Neither property owner has
indicated a desire to build a future home on the proposed parcels.
The Dubuque County Zoning requires new lots to have at least an access easement to
serve the newly created lot. However, the proposed access easements for Lots 2 and
3 would be exceedingly difficult to use because of existing topography, trees, and
structures. The applicant has attempted to comply with the County regulations and
thus the plat has been created with the required access easements.
If this plat were within the City of Dubuque corporate limits, staff would have counseled
the applicant to have Lots 2 and 3 incorporated into the respective existing lots of the
two people who want to buy those lots. However, because the applicant's property is in
Dubuque County, they were instructed to proceed in the manner that is shown on the
plat before the Zoning Advisory Commission.

The City of Dubuque and Dubuque County are in the process of reviewing the 28E
Agreement that gives the City of Dubuque extra jurisdictional review of subdivision
plates within two miles. This is one of the issues that will be discussed as part of that
process.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that both lots will be used to expand
the back yards of the abutting property owners who will be purchasing the lots. Staff
reviewed surrounding land uses and noted that Dubuque County requires that both lots
have a 20-foot wide access easement.
The Zoning Advisory Commission discussed the request noting that the proposed lots will
not adversely impact adjacent properties.
Recommendation
Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
