RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 OF 1 AND LOT
2 OF 1, A DMSION OF LOT 1 OF JAEGER HEIGHTS SUBDMSION NO.3, IN THE
CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk the Plat of Survey of lot 1 of 1 and
lot 2 of 1, a Division of lot 1 of Jaeger Heights Subdivision, No.3, in the City of Dubuque,
Iowa; and
Whereas, said plat of survey provides 31.13 feet of frontage and 5,008 square feet
of lot area for lot 1 of 1 and 28.98 feet of frontage and 5,008 square feet of lot area for
lot 2 of 1, where 60 feet of frontage and 6,000 square feet of lot area are required by
Section 42-19(b) of the Subdivision Regulations; and
~ Whereas, said plat of survey has been reviewed by the Zoning Advisory Commission
its approval endorsed thereon subject to prohibiting the construction of a single-family
home on either lot 1 of 1 or lot 2 of 1, and
Whereas, said plat of survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
lot 1 of 1 to have 31.13 feet of frontage and 5,008 square feet of lot area, and lot 2 of
1 to have 28.98 feet of frontage and 5,008 square feet of lot area, where 60 feet of
frontage and 6,000 square feet of lot area are required.
Section 2. That approval of this plat of survey of lot 1 of 1 and lot 2 of 1, a
division of lot 1 of Jaeger Heights Subdivision No. 3 is subject to prohibiting the
construction of a single-family home on either lot 1 of 1 or lot 2 of 1, and that said
prohibition is noted on the plat of survey.
Section 3. That the plat of survey of lot 1 of 1 and 2 of 1, a division of lot 1 of
Jaeger Heights Subdivision No. 3 is hereby approved and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa,
upon said plat of survey.

Recommendation
Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request with the condition that a single-family home cannot be built on either Lot 1 of 1 of
Lot 2 of 1 Jaeger Heights Subdivision NO.3.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Lot 1 of 1 and 2 of 1, a Division of Lot 1 of Jaeger
Heights Subdivision No. 3
INTRODUCTION
The applicant, William Frey, has submitted a plat of survey that splits an existing lot in
Jaeger Heights Subdivision into two. Mr. Frey will own Lot 2 of 1 and his neighbor,
Mike Lightfoot, will own the other lot.
The Zoning Advisory Commission is reviewing this plat of survey as the two lots created
do not have sufficient lot frontage or lot area as per the R-1 Single-family Residential
district standards. The Zoning Ordinance requires 6,000 square feet of lot area and 60
feet of lot frontage. The two lots will both have 5,008 square feet of lot area and
approximately 30 feet of lot frontage. The applicant has indicated the purpose of the
split is to provide each of the adjacent lot owners a larger yard, and there are no plans
to build additional housing units.
ACTION STEP
Planning staff recommends the Zoning Advisory Commission review the submitted plat
of survey and make a recommendation to the City Council.

This letter is being written on behalf of?\1r. a.1'!d Mrs. Wmiam C. Frye and Mr. and Mrs. Michael
Lightfoot. The Lightfoots live at 2200 Jaeger Dr., Dubuque, IA, 52003 and the Fryes live at
2170 Jaeger Dr., Dubuque, Iowa, 52003. Their lots are separated by an empty lot which is
described as Lot 1 of Jaeger Heights Subdivision NO.3. This property was formerly owned by
Mr. and Mrs. Lloyd S. Gudenkauf, and Mr. and Mrs. Frye desire to expand the size of their lot.
They were in contact with Mr. and Mrs. Lightfoot who also wish to expand the size of their lot.
Mr. Lightfoot and Mr. Frye bought Lot 1 of Jaeger Heights Subdivision No.3 from Mr. and Mrs.
Gudenkauf, and they now seek to have the lot split down the middle. Mr. and Mrs. Frye will
own that portion of the lot closest to their residence and Mr. and Mrs. Lightfoot will own that
portion of the lot closest to their residence. Neither one of these parties intends to build a house
on the property, and each of them is purchasing the property so as to enhance and enlarge their
own lot upon which their residence is being situated.
It appears to us that this is an excellent use of the property. Mr. and Mrs. Frye and Mr. and Mrs.
Lightfoot have enlisted the services of John L. White and Buesing & Associates who have, on
their behalf, prepared a Plat. A copy is attached hereto. The Fryes and the Lightfoots request
that the Plat be approved and filed so that they can enter into a Deed in which Mr. and Mrs. Frye
will own one-half of what is now Lot 1 of Jaeger Heights Subdivision No.3, and Mr. and Mrs.
Lightfoot will own the other one-half We believe that this is a platting matter with all winners
and no losers. We request that you approve the Plat accordingly.
