Sealed bids were received for the Dubuque Industrial Center West 3rd Addition/
Contract A Mass Grading Project. Subject to concurrence by the Iowa Department of
Transportation, City Engineer Gus Psihoyos recommends award of the contract to the
low bidder, W.C. Stewart Construction, in the amount of $3,092,815.32, which is
20.56% under the engineer's estimate.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution authorizes the award of the Dubuque Industrial Center West 3rd
Addition/Contract A Mass Grading Project.
BACKGROUND
This project begins the construction phase of the next expansion of the Dubuque
Industrial Center West, including the connection of the east and west sections of
Chavenelle Road through the McFadden farm. The 150-acre project area includes the
former Bergfeld farm property. IIW has been retained to design and engineer this
project for the City. This first bid package allows mass grading of the site to begin as
soon as weather permits this spring, earlier than initially anticipated in the budget
process.
The project is approved in the FY06 Capital Improvement Program. General obligation
bond proceeds for the project will be available to fund project expenses incurred prior to
July 1, 2005; however, a final FY05 budget amendment will be needed to acknowledge
those expenses incurred by the project's early startup.
DISCUSSION
Sealed bids were received on March 24, 2005. W.C. Stewart Construction submitted
the low bid in the amount of $3,085,915.31. This amount is 20.46% under the
engineer's estimate. A summary of the bids received is as follows:

RECOMMENDATION
Four alternates were bid on the project. It is recommended that only one alternate be
selected. This alternate would be Alternate A-46-A, which is a 2-foot high by 3-foot
wide compost berm to replace a silt fence that was a base item. This alternate would
result in at $6,900 increase in the bid award. It should be noted that the low bidder
would be W. C. Stewart Construction regardless of which alternates would have been
selected. Attached you will find a letter from IIW Engineers & Surveyors, PC
recommending the award of the project to W.C. Stewart Construction. I also
recommend that the contract be awarded to W.C. Stewart Construction in the total
amount of $3,092,815.31.

It should be noted that the March 1, 2005 initiation memo indicated an engineering
amount of $271,500; this amount represented inspection services only and did not
include any design fees. The figure has been revised to $379,275, which includes
$155,210 for design services and $224,065 for inspection services.
The project will be funded with TIF-backed general obligation bond proceeds and RISE
grant funds:

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
Whereas, on the 2nd day of March, 2005, plans, specifications, form of
contract and estimated cost were filed with the City Clerk of Dubuque, Iowa for
the Dubuque Industrial Center West 3rd Addition/Contract A Mass Grading
Project.
Whereas, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are
hereby approved as the plans, specifications, form of contract and estimated cost
for said improvements for said project.

AWARDING CONTRACT
Whereas, sealed proposals have been submitted by contractors for the
Dubuque Industrial Center West 3rd Addition/Contract A Mass Grading Project
pursuant to Resolution No. and notice to bidders published in a
newspaper published in the City of Dubuque, Iowa on the 8th day of March, 2005.
Whereas, said sealed proposals were opened and read on the 24th day of
March, 2005, and it has been determined that the bid of W.C. Stewart
Construction of Dubuque, Iowa, in the amount of $3,092,815.31 was the lowest
bid for the furnishings of all labor and materials and performing the work as
provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to W.C. Stewart
Construction, subject to the concurrence by the Iowa Department of
Transportation, and the Manager be and is hereby directed to execute a contract
on behalf of the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.
