City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developers, GNZ Properties, Inc., Larry A. Miller and Delbert G. Miller, have
recently completed in Wingate Place No. 3 and Wingate Place No. 4. Maintenance of
said improvements, with the exception of the stormwater detention facilities, shall be the
responsibility of the owner and contractor for a period of two years from the date of
acceptance by City Council. The stormwater detention facilities shall remain the
responsibility of owners, GNZ Properties, Inc., Larry A. Miller and Delbert G. Miller, until
80% of the lots are developed.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
which the developers, GNZ Properties, Inc., Larry A. Miller and Delbert G. Miller, have
recently completed in Wingate Place No. 3 and Wingate Place No. 4.
BACKGROUND
As a condition of subdivision plat approval through Resolution Nos. 152 -10 and 360 -10,
the developers of Wingate Place No. 3 and Wingate Place No. 4, GNZ Properties, Inc.,
Larry A. Miller and Delbert G. Miller, were required to install certain improvements
including street paving with curb, sanitary sewer main, watermain, storm sewers and
catch basins, stormwater detention facilities, and street lighting and to dedicate these
improvements to the City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On September 26, 2011, GNZ Properties, Inc., requested City's acceptance of the
improvements in Wingate Place No. 3 and Wingate. Place No. 4. Upon inspection, it has
been determined that the public improvements required by Resolutions 152 -10 and 360-
10, except storm water detention facilities, have been completed in accordance with
plans approved by the City Council and in conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
required by Resolutions 152 -10 and 360 -10. Maintenance of said public improvements,
with the exception of the stormwater detention facilities, shall be the responsibility of the
owner and contractor for a period of two (2) years from the date of acceptance by City
Council. The stormwater detention facilities shall remain the responsibility of the owner,
GNZ Properties, Inc., Larry A. Miller and Delbert G. Miller, until 80 percent (80 %) of the
lots are developed as per the resolution approving the final plats.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements, except stormwater detention facilities, in Wingate Place No. 3 and
Wingate Place No. 4.

ACCEPTING PUBLIC IMPROVEMENTS IN WINGATE PLACE NO. 3 AND WINGATE
PLACE NO. 4
Whereas, pursuant to Resolutions 152 -10 and 360 -10, certain public
improvements including street paving with curb and gutter, sanitary sewer, watermain,
storm sewer and stormwater detention facilities, catch basins, and street lighting were
installed by the developers of Wingate Place No. 3 and Wingate Place No. 4.
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same, except the
stormwater detention facilities, have been completed in accordance with the plans
approved by the City Council and in conformance with City specifications, and has
recommended that the improvements be accepted by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements, except the stormwater detention facilities, in Wingate
Place No. 3 and Wingate Place No. 4 be and the same is hereby accepted.
Section 2. That maintenance of said public improvements shall be the
responsibility of the owners for a period of two (2) years from the date of this resolution.

The dirt at the corner of Wingate Drive and Sylvan Drive was removed by September 15, 2011 and most of this
area was seeded and mulched. The final coat of asphalt was installed on Wingate Drive on Monday September,
19, 2011. The base and wiring for the street Tight at the intersection of Wingate Drive and Eastgate Court has
been installed and the fixture should be installed this week.
Although the detention basin will not be accepted until a later date, the final inlet pipe was installed and the
detention basin has been final graded. The basin still needs to be seeded and mulched which should happen
this week, weather permitting. Seeding and mulching the disturbed areas behind the curb of Wingate Drive will
also be taken care of at that time.
Therefore, the improvements for Wingate Place No. 3 and Wingate Place No. 4 are complete and we are ready
for final inspection and acceptance by the City of Dubuque. Please let me know what I need to do to start this
process. We are anxious to start the clock on the two year maintenance period.
