SUBJECT: Burbach Charitable Contribution
Leisure Services Manager, Gil Spence is recommending that the City accept the donation of a
49,700 square foot parcel of land from Carl and Mary Ann Burbach. The property is located at
the end ofWelu Drive and is adjacent to the City-owned Medical Associates Greenbelt. It could
be used as part of the City park system.
I concur with the recommendation and respectfully request Mayor and City Council approval.

INTRODUCTION
.
The purpose of this memorandum is to provide a recommendation on the offer of Carl
J. And Mary Ann Burbach to make a charitable contribution of land to the City for park
purposes.
DISCUSSION
At its October 16th meeting the City Council received and filed and referred to the City
Manager a letter from Brian J. Kane communicating the proposed charitable contri-
bution from Carl J. and Mary Ann Burbach of Lot 22 of Sunset Park Eighth Addition.
This lot is 49,700 square feet located at the end of Welu Drive, southwest of the Penn
Place Apartments. The property is adjacent to the Medical Associates Greenbelt and
could provide access to that property.
This neighborhood is a mix of single family homes, duplexes, and apartments. The size
and location of the property would lend itself to a tot lot park aimed at youth eight years
old and younger. Usha Park is several blocks away, across Pennsylvania Avenue, and
will serve older children of the area. This park would provide the parents with real
young children a park in their immediate neighborhood that they could walk to.
ACTION STEP
The action requested is that the City Council accept the offer of Carl J. and Mary Ann
Burbach to donate Lot 22 of Sunset Park Eighth Addition.

Dear Mr. Mayor and Members of the Council:
Weare counsel for Mr. and Mrs. Carl 1. Burbach and have been retained in connection with
their charitable intent to give Lot 22 of Sunset Park Eighth Addition to the City of Dubuque, Iowa.
Mr. Burbach has been conferring with Mr. Tim Moerman and Mr. Gil D. Spence in this regard.
By this letter we advise you oftheir desire to make this charitable contribution; the property has been
appraised by Mr. J.L. Felderman at a value of.$75,OOO.OO. We enclose a copy of the plat showing
the location and dimensions of the proposed real estate to be gifted, along with the cover page of Mr.
Felderman's appraisal as of August 16,2000.
If you are amenable to receiving this property as a gift, we propose the following:
1. Mr. and Mrs. Burbach would convey all of their interest to the City of Dubuque on or
before December 31,2000 via a Quit Claim Deed. The property would be conveyed to the City "AS
IS" without any representations or warranties;
2. IRS Form 8283 would be signed by an authorized representative of the City
acknowledging the value of the gift at $75,000.00 based upon the appraisal performed by Mr.
_ Felderman;

3. There is no existing abstract to the property under examination and Mr. and Mrs.
Burbach do not contemplate creating one;
4. A Closing Statement would be prepared to reflect the appropriate expenses borne by the
appropriate parties all subject to the later agreement of the parties concerning this matter (i.e.
proration of real estate taxes, recording costs, etc.).
If you are agreeable to the foregoing, please contact us so that we can finalize this matter by
year end.

The purpose of the appraisal is to estimate the market value of the property, as is, in fee simple,
unencumbered by liens, as of a given date (or current market value, if not specified otherwise). The
function of the appraisal is for valuation purposes. A legal description will be found herein. The
