Van Milligen, City Manager From: ~Rich Russell, Building Services Manager Re: Dubuque County Historical Society/Conlon Construction Appeal of the 4th Street Peninsula Permit Moratorium INTRODUCTION: Dubuque County Historical Society and Conlon Construction are appealing my refusal to issue a building permit for the Mississippi River Discovery Center to the City Council. BACKGROUND: On August 7th, 2000, the City Council adopted an Ordinance that established a building permit moratorium for the Fourth Street Peninsula ROD Redevelopment Overlay District. That Ordinance allows the City Council to direct the Building Services Manager to issue permits that the City Council believes would not negatively impact the master planning process for the Fourth Street Peninsula ROD Redevelopment Overlay District. DISCUSSION: The permit application indicates that a 44,000 square foot, two story museum would be constructed between the existing museum and depot buildings. CONCLUSION: I recommend that the City Council find that no negative impacts would arise due to the issuance of this building permit and that I be directed to issue the same.
