RE: Diamond Jo/Bird Sign Appeal of the 4th Street Peninsula Permit Moratorium
INTRODUCTION: Gene Bird Sign Company is appealing my refusal to issue two sign permits
for the Diamond Jo Casino to the City Council. I have attached a copy of the letter for your
information. I have also attached copies of the proposed signs for your review.
BACKGROUND: On August 7th, 2000 the City Council adopted an Ordinance that established
a building permit moratorium for the Fourth Street Peninsula ROD Redevelopment Overlay
District.
That Ordinance allows the City Council to direct the Building Services Manager to issue permits
that the City Council believes would not negatively impact the master planning process for the
Fourth Street Peninsula ROD Redevelopment Overlay District.
DISCUSSION: The permit application indicates that a new 73 square foot wall sign would be
installed on the north side of the Portside Building and sign faces for two free standing
directional signs would be replaced.
The Board of Adjustment has approved the installation of these signs. Important to note is that
the existing wall sign and reader board on the west side of the Portside Building would be
removed as part of this permit process. The agreement to remove the existing sign was part of the
Board of Adjustment process.
Gene Bird will be in attendance at the City Council meeting to answer any specific questions
about the signs.
CONCLUSION: I recommend that the City Council find that no negative impacts would arise
due to the issuance of these sign permits and'that I be directed to issue the same.
