NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That AppendiX A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter described property from ID Institutional District to OS Office Service District, to wit: Lot 2 Red Cross Place, and to the center line of the adjoining public right-of-way, all in the City of Dubuque, Iowa. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. Property History: The subject property is currently owned by the American Red Cross and was originally rezoned in 1986 to the ID Institutional District classification. Physical Characteristics: The subject property slopes east toward the single-family residential lots fronting on Bunker Hill Road. Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not include this area. The 1990 DMATS Plan - Institutional. The 1995 Gruen Plan - Institutional. Impact of Request on: Utilities: Existing utilities are sufficient to handle the proposed development. Traffic Patterns/Counts: Asbury Road is rated as a minor arterial and carries approximately 14,000 vehicle trips per day in this stretch of Asbury Road. Clarke Drive is also rated as a minor arterial; however, there are no current traffic counts available. Public Services: Existing public services are adequate to serve the proposed development. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control is provided during all phases of construction. Adjacent Properties: The primary impact to adjacent properties will be the change from an open space area to off-street parking for vehicles associated with the proposed office building. Staff Analysis: The applicant is requesting rezoning of a small parcel of land from ID Institutional District to OS Office Service District. The subject parcel is located on the north end of an existing OS zoned parcel that the applicant has developed for an office building. The applicant is proposing rezoning of the subject parcel to allow construction of a single-story office building. The subject parcel would be utilized for additional off- street parking. Attached to this staff report is a copy of the proposed site layout for the new office building and parking. The City Council previously approved OS zoning for the corner parcel subject to providing a 20 foot setback from adjacent residential property to the east. The existing office building is located no closer than 75 feet to the adjacent residential property and the proposed one-story office building would be a minimum of 30-feet from the proposed residential property. Screening would also be required between the residential property and the proposed parking area. Staff recommends the Zoning Advisory Commission review section 6-1.1 of the Zoning Ordinance that establishes criteria for reviewing rezoning requests. Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, stating he would work with adjacent property owners to provide appropriate screening for the proposed single-story office building and parking lot. Staff reviewed the request, indicating that the area to be rezoned to OS provides additional parking spaces for a second office building, while the office building itself will be on property already zoned OS Office Service. There was a neighboring property owner who spoke with concerns regarding privacy and storm water drainage. The Zoning Advisory Commission discussed the request, noting that the applicant will provide appropriate screening and storm water will be directed to the existing detention basin that has sufficient capacity to accommodate the additional storm water run-off. Recommendation Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request.
