NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter described property from HI Heavy Industrial District, to CR Commercial Recreation District, as shown in Exhibit A, and to the center line of the adjoining public right-of-way, all in the City of Dubuque, Iowa. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. This ordinance shall take effect immediately upon publication, as provided bylaw. Passed, approved and adopted this 20th day of November , 2000. Dear Chairman Bird and Commission Members Schiltz, Christ, Hardie, Nagle, Smith and Stiles: Our office represents Dubuque Yacht Basin, Inc. Donald P. Shanley is its President. . Dubuque Yacht Basin, Inc. leases what is commonly known as Bissell and Schmitt Harbors at the waterfront on 16th Street. Bissell Harbor has been leased since 1970 from the City of Dubuque and is renewable on five-year terms through the year 2020. The Schmitt Harbor Lease dates back to 1974 and goes through the year 2024. Dubuque Yacht Basin, Inc. leases an additional area from the City under a Lease dated October 9, 1987. Through the cooperation with the City Zoning Staff, all three Leases were recently amended by Resolutions passed by the City Council on April 17, 2000, and recorded at the Dubuque County Recorder's office on June 27,2000. City staff has initiated this request because these Amendments apparently extend Dubuque Yacht Basin's operations into a heavy industrial zone (H - I), and it is necessary that the Dubuque Yacht Basin's leased area be rezoned Commercial Recreational (C-R). Environment: Staff does not anticipate any adverse impact to the environment as the area has been used as a marina for many years. . Adjacent Properties: Staff does not anticipate any adverse impacts to adjacent industrial and recreational properties as the subject area has been used as a marina for many years. . . . REZONING STAFF REPORT Page 2 CIP Investments: None proposed. Staff Analysis: The requested rezoning was implemented as part of lease negotiations between the City of Dubuque and the Dubuque Yacht Basin. The subject area has been used for docking of pleasure craft, and is included in the lease boundaries for the Dubuque Yacht Basin. The existing zoning is HI Heavy Industrial and the docking and servicing of pleasure boats is not a permitted use in the Heavy Industrial district. The requested rezoning would rezone the water surface to commercial recreation which does permit pleasure craft harbors as a permitted use. Staff recommends the Zoning Advisory Commission review Section 6-1.1 of the Zoning Ordinance that establishes criteria for reviewing rezoning requests. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, noting that this issue arose during lease negotiations. Staff reviewed the rezoning boundaries relative to the existing land use facilities and boat slips. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the request will address an inconsistency between zoning and land use along the riverfront. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request.
