SUBJECT: E-mail Letter from Sara and Roger Poling of 1615 Born Avenue
The Mayor and City Council Members received a presentation from the residents of
1615 Born Avenue, Sara and Roger Poling, regarding a subdivision for property located
to the west of their home. Planning Services Manager Laura Carstens has provided
information about their concerns.
The subdivision in question is being developed by Tom Keizer and Bill Luksetich. The
enclosed preliminary plat for Indiana Subdivision was approved by the Zoning Advisory
Commission on March 3, 2005 as being in conformance with the City's Subdivision
Ordinance. The approved preliminary plat provides for the subdivision of the
approximately 4-acre parcel into 8 single-family building lots and a detention basin.
The next step for the developers is to submit a final plat with improvement plans to City
staff for review. The City Council then would review and approve the final plat at a
future Council meeting. The timetable for submittal to the City Council is dependent on
when the developer submits the required final plat and improvement plans.
The plat conforms to the City Zoning Ordinance and has a 50 foot street right-of-way
access. If the Polings do not agree with the survey work, they will need to have a
survey done.

The Mayor and City Council Members received the enclosed emailletter from the
residents of 1615 Born Avenue, Sara and Roger Poling, regarding a subdivision for
property located to the west of their home. Planning Services staff has reviewed this
letter, and has the following responses to the Rolings' questions.
Plat Approval Process
The subdivision in question is being developed by Tom Keizer and Bill Luksetich. The
enclosed preliminary plat for Indiana Subdivision was approved by the Zoning Advisory
Commission on March 3, 2005 as being in conformance with the City's Subdivision
Ordinance. The approved preliminary plat provides for the subdivision of the
approximately 4-acre parcel into 8 single-family building lots and a detention basin (Lot
A).
The next step for the developers is to submit a final plat with improvement plans to City
staff for review. The City Council then would review and approve the final plat at a
future Council meeting. The time table for submittal to the City Council is dependent on
when the developer submits the required final plat and improvement plans.
Plat approvals are treated as action items on the agendas of both the Zoning Advisory
Commission and the City Council. Public input at the City Council meeting would
therefore be at the discretion of the Mayor.
Width of Street Access
The new subdivision will be served by a new 31-foot wide public street named Indiana
Court that will intersect with Born Avenue. The street access is adjacent to the Poling
property at 1615 Born Avenue, which lies to the north, and to the Palmer property at
1595 Born Avenue, which lies to the south.

The street access is 50-foot wide, which is the City's minimum right-of-way width for a
31-foot wide public street. As shown in the typical section on the plat, the 50-foot right-
of-way provides room for a 31-foot wide street back of curb (BOC) to back of curb
(BOC), 5-foot wide parkways for street tree planting on each side of the street, and 4-
foot wide sidewalks on each side of the street. These measurements meet the City's
standards for a public street.
Accuracy of Survey
The plat identifies the location of several iron pipes found in the field. The found pipes
include pipes at the comers of the southern property lines of 1615 Born Avenue (the
Roling residence) and 1595 Born Avenue (the Palmer residence). If the Rolings do not
agree with the survey work, then they will need to have a survey done of their property
by a licensed land surveyor to prove that the survey for Indiana Subdivision is
inaccurate.
Zonina
The subject property is zoned R-1 Single-Family Residential and has been since 1985.
Between 1975 and 1985, the property was zoned R-2 Two-Family Residential. Prior to
1975, the property was zoned Single-Family. The approved preliminary plat is for
development of 8 single-family homes. The plat conforms to the City's Zoning
Ordinance with respect to planned use, lot area, and lot frontage on a public street.

Dear Mayor and City Council members,
My husband and I ,live at 1615 Born Ave. A neighbor recently showed us a
plan that puts a subdivision in the lot behind ours and a road that will
be created between our property and our neighbors at 1595 Born.
Weare concerned about this possible new road especially . We are not
sure that there is enough room for it to go between our properties, and
we have a young child and are not thrilled at the prospect of being a
comer lot. When we purchased the property, we knew of the easement
between us, but had always been told that it was too narrow for a road,
at best it would be a one way entrance or exit to the lot behind us.
(we know that is zoned for business and figured we could have a parking
lot behind us.)
Is there anything we can do to prevent this new property from going in?
How can we be sure that the lots have been surveyed correctly?-- the
flags marking our lot are different than the lot lines we have been given
before.
Many of our neighbors are unhappy about this as well. What is our best
avenue of complaint? to the new owners, do they need approval at a city
council meeting, who should we consult to voice our concerns?
We would appreciate any help in this matter.
The plan was prepared by Buesing and Associates for Bill Luksetich and
Tom KeIzer ofKZ investments 4840 Asbury Rd. Dubuque IA 52002. We have
not yet contacted them to seek further info.
