Leisure Services Manager Gil Spence recommends City Council approval of an agreement with Area Residential Care Vocational Services to supply litter pick-up services by the skate park at McAleece, Allison-Henderson Park, Comiskey Park and the office at the Bunker Hill Golf Course. This service costs $600 and has proven beneficial in reducing the park staff workload. I concur with the recommendation and respectfully request Mayor and City Council approval. For three years we have had Area Residential Care Vocational Services supply litter pick-up services by the skate park at McAleece, Allison-Henderson Park, Comiskey Park and our office at the Bunker Hill Golf Course. Thanks! GDS:et attachments AGREEMENT AREA RESIDENTIAL CARE, INC. VOCATIONAL SERVICES Agreement made this 25 th day of April 2005, by and between Area Residential Care, Inc, Vocational Services (hereinafter ARC) and Leisure Services . (hereinafter Customer). Whereas, ARC maintains a supported employment contract/labor service on a ongoing basis: Whereas, Customer desires ARC to supply Litter pick up services to its operation located at: See Appendix A (hereinafter called the area to be serviced). THEREFORE, the parties agree as follows: 1. Beginning on the 25 th day of April 2005 ARC will provide and perform for the Customer, the services described in the schedule attached hereto, in the buildings and areas to be serviced. 2. All personnel furnished by ARC will be employees of ARC and ARC will pay all salaries and expenses of, and all federal, social security, federal and state unemployment taxes, and any similar payroll taxes relating to such employees, and will carry workmen's compensation insurance of such employees. ARC will be considered, for all purposes, an independent contractor, and it will not directly or indirectly, act as an agent, servant or employee of customer, or make any commitments incur any liabilities on behalf of the customer without its express written consent. 3. ARC will provide for all proper safeguards and shall assume all risks incurred in performing its services hereunder. 4. ARC will provide insurance coverage set forth below, and deliver to the Customer certificates of insurance upon request: a. Comprehensive liability: $3 million. b. Workmen's Compensation coverage: Statutory 5. Without limiting the responsibility of ARC for proper conduct of its personnel and the services to be performed, the conduct of the personnel is to be guided by the rules and regulations as agreed upon between the customer and ARC and any additional special written instructions as may be issued by the customer to ARC through its designated agent. 6. ARC is responsible for the direct supervision of its personnel through its designated representative and such representative will, in turn, be available at all reasonable times to report and confer with the designated agents of the customer with respect to services rendered. 7. In exchange for performance of services, the Customer shall make payment to ARC for services rendered hereunder at the rate of $8.55 per FTE, payable on the first working day of the period following that in which services are rendered. ARC will give the customer at least (30) days notice of any price change for services rendered and the Customer will notify ARC of any changes in the use of the areas covered by this agreement. . 8. ARC will perform all services required hereunder, except when prevented by strike, lockout, act of God, accident or other circumstances beyond its control. 9. This agreement shall continue in effect from the date services are to begin. It may be terminated by either party if that party gives (30) days notice by registered mail addressed to the other party. This agreement may be executed in any number of counterparts, and together with the attached schedule contains all the covenants and agreements between said parties with respect to the subject matter of this agreement. 10. Customer representative Appendix A 4-25-05 Tasks to be done for Leisure Services - Parks and Recreation. Leisure Services will supply trash bags and rakes. Leave trash picked up by the trash cans at the park. If it is rainy, reschedule to the next day. Pop cans and bottles picked up are ARC option on how to dispose or redeem. Locations: 1. Skate Park by McAleece Field on City Island. Pick up litter on Monday and Thursday. Pick up the litter inside and outside the fence and around the parking lot. Estimated 2 FTE hours each day. 2. Allison-Henderson Park by North Grandview & Delhi. 1 st Priority is raking ofthe wood chips by the playground equipment. Workers should level the chips and make sure there is a safe amount under each piece of equipment. 2nd Priority. As time is available pick up the litter by and around the park. 2 hours FTE's, one day per week. 3. Comiskey Park on Jackson Street (25th). 1st Priority. Rake chips under playground equipment. 2nd Priority. - AsJime is available pick up litter in entire park. 2 hours FTE, one day per week. 4. Bunker Hill Offices. 1 st Priority - Pick up all litter around buildings, garages, and parking lots. 2nd Priority - Pick up litter along Grandview by the golf course from the street to the fence. 2 hours of FTE hours Other tasks and areas as mutually agreed upon.
