Addition
The City has previously entered into a contract with IIW Engineers & Surveyors, P.C. for
design and engineering services to complete the Dubuque Industrial Center West 3rd
Addition project, with subsequent amendments to the original contract. Due to
additional work requested by the City as part of this industrial park development project,
Economic Development Director Dave Heiar is recommending City Council approval of
Amendment #5.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Introduction
The City has previously entered into a contract with IIW Engineers & Surveyors, P.C.
for design and engineering services to complete the Dubuque Industrial Center West
3rd Addition project, with subsequent amendments to the original contract. Due to
additional work requested by the City as part of this industrial park development project,
Amendment #5 is presented for City Council approval.
Discussion
Since the last amendments to the original contract, IIW has been asked to provide
additional services in support of a 30-acre development proposal requiring rail access in
the project area. Their work has involved additional grading plan modifications and
design changes to accommodate the industrial prospect. Other work has related to
required environmental mitigation required by Corps of Engineers' permits. Also, the
City's request to rezone the McFadden Farm property to industrial use has required the
submission of a conceptual development plan for that property as part of the rezoning
application.
This additional scope of work has added $34,413 to overall project fees, bringing the
contract total to $292,221.75.
Additional amendments will still be needed to reflect engineering design and
construction plans for amenities at the Bergfeld Recreation area and a cul-de-sac street
serving rail-accessible lots in the project area.
Recommendation
I recommend that the City Council approve IIW Contract Amendment #5 provided with
this memo. The amendment responds to the City's request to IIW to expand their
scope of work.
Action Step
The action step for the City Council is to authorize the City Manager to sign IIW
Contract Amendment #5.

PART I - SCOPE OF SERVICES
04119-03A J Grading Modifications and Separation of Construction Contracts
The scope of the project includes revisions to Contract A, Mass Grading for the earthwork
associated with a 30 acre parcel and temporary construction access road connection to
Chavenelle Road in accordance with our January 27th, 2005 Owner meeting.
Professional services will be provided by, or under the direct personal supervision of, a
Professional Engineer licensed to practice in the State of Iowa.
A. FINAL DESIGN
1. Project administration including meetings, coordination, and project related
correspondence.
2. Redesign Contract A, Mass Grading plans, to provide rough grading for the 30 acre
parcel, and provide a temporary construction access road connection to Chavenelle
Road. This would include modifications to other portions of the project area to
provide additional fill due to the additional cut material associated with the
L site.

3. Recalculate construction quantities for earthwork volumes to "balance" the cut and fill quantities, and
roadway construction quantities.
4. Revise the earthwork specifications to include provisions and special project requirements for the
earthwork associated with the site and temporary construction access road.
5. Separate the construction contracts into Contract A Mass Grading and Contract B Paving, Drainage and
Utilities to provide a more competitive bidding scenario for each contract. This results in additional
services to prepare final design, coordination of bid letting and award of contract for two projects instead
of one, which was the basis of our original contract.
04119-08 Facility
The scope of the project "is identified in contract amendment #4, dated January II th, 2005. It was our
understanding a decision from was likely by mid January at the latest. We have provided numerous
additional cost estimates and correspondence with:: as authorized since mid January. The recent chain of
events from the decisions by an _ have resulted in numerous authorized additional
meetings, design modifications, and correspondence to assist the City. These additional services have resulted in
an increase in our estimated hourly fees as indicated in the compensation.
04119-09 Environmental Mitigation
The scope of the project is identified in contract amendment #4, dated January 11th, 2005. Our application was
submitted to the Corps of Engineers on December 2nd, 2004. IIW submitted supplemental information to the COE
on January 3n1, 2005 and January 11th, 2005. We received an executed 404/401 Permit on March 22nd, 2005 as a
result of the following:
1. Coordination of the mitigation of 0.22 acres associated with the University Avenue Extension project on
the DICW 3 site.
2. Coordination with regulatory agencies regarding their anticipated schedule for review of the application
and supplemental information.
3. Responding to concerns brought forth by Mr. Doug Fritsch regarding his well and the potential impact of
the project. We provided research on the geology, existing wells in the vicinity, prepared exhibits,
distributed to the University of Iowa, correspondence with geologists, and distributed results.
4. Meeting on site with the Iowa DNR biologist, Mr. Bob Sheets, review of his field report, distribution to
the COE, and subsequent correspondence for clarification. This site visit was a key element in securing
the 401 Water Quality Certification.
5. Prepared correspondence regarding permit review status, and permit process clarifications, review and
interpretation of the 404/401 Permit, and distribution for signatures.
6. Design modifications to the environmental mitigation requirements in Contract A Mass Grading to reflect
the changes suggested in the 401 Water Quality Certification resulting in a substantial reduction in
construction costs. (Le. environmental mitigation construction costs reduced from approximately
$100,000 to approximately $45,000)
04119-16 Conceptual Plan for Re-zonlng McFadden Property
The scope of the project includes preparing a conceptual plan for re-zoning the Vince and Louella McFadden
property in accordance with your March 28, 2005 telephone conversation with Jim Kaune.
Professional services will be provided by, or under the direct personal supervision of, a Professional Engineer
licensed to practice in the State ofIowa.

A. CONCEPTUAL PLAN

northerly of the railroad right-of-way, all in Section 29, Township 89 North, Range 2 East of the 5th PM.

PART ill - COMPENSATION
Compensation for the Part I Scope of Services for each project indicated above is as follows:
04119-03A.... Site Grading Modifications lump sum $18,000 (eighteen thousand dollars)
04119-08-' Conceptual additional $8,537 (eight thousand five hundred thirty seven dollars) This
increases the hourly estimated fee from $9,000 to $17,537.
04119-09 Environmental Mitigation additional $6,426 (six thousand four hundred twenty six dollars) This
increases the hourly estimated fee from $15,000 to $21,426.
04119-16 Conceptual Plan for Re-zoning McFadden Property lump sum $1 ,450 (one thousand four hundred
fifty dollars)
PART IV - APPROVAL
