Van Milligen, City Manager SUBJECT: Pennsylvania Avenue - Radford Road Sidewalk Installation Project (CIP: 010C89 and 350042) City Engineer Gus Psihoyos recommends initiation of the bidding process for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project, and further recommends that a public hearing be set for May 16, 2005. This project will provide for installation of sidewalks on the north side of Pennsylvania Avenue from Iowa 32 (Northwest Arterial) to Radford Road, the east side of Radford Road from Pennsylvania Avenue to the Asbury city limits, and from Middle School property, northerly, on the west side of Radford Road to the Asbury city limits. Van Milligen, City Manager Gus Psihoyos, City Engineer <;.j ,0 SUBJECT: Pennsylvania Avenue - Radford Road Sidewalk I nstallation Project (Capital Improvement Projects: 010C89 and 350042) INTRODUCTION The enclosed resolutions authorize the pubic bidding procedure for the Pennsylvania Avenue - Radford Road Sidewalk Installation Project. BACKGROUND On November 15, 2004 City Council approved the installation of sidewalks on the north side of Pennsylvania Avenue from Iowa 32 (Northwest Arterial) to Radford Road, the east side of Radford Road from Pennsylvania Avenue to the Asbury city limits, and from Middle School property, northerly, on the west side of Radford Road to the Asbury city limits. DISCUSSION This assessable project consists of 5,114.5 lineal feet of sidewalk installation on Pennsylvania Avenue and Radford Road. This installation will also include excavation, grading, seeding and traffic control work. A neighborhood informational meeting was held on April 5, 2005 to seek input from citizens and property owners on the project. Three property owners attended, all of whom indicated their desire to install the walk prior to the City's contractor performing the work. No other issues were brought up against the project. It is anticipated that additional property owners will install their respective sidewalk prior to the award of the contract, which could reduce the total cost of the project. The Middle School property was not included as part of the assessment. The Dubuque Community School District is proposing to approve the contract for the Radford Road/Radford Court intersection work and sidewalk installation at its April 11, 2005 board meeting. The sidewalk is to be completed by June 6, 2005. The project is scheduled to be completed by August 15, 2005 to provide for the August 26, 2005 student orientation at the Eleanor Roosevelt Middle School. The schedule for the project will be as follows: Advertisement for Bids Notice of Hearing on Plans & Specifications Mail Notice to Property Owners Published Notices to Property Owners April 22, 2005 May 6,2005 April 22, 2005 April 22, 2005 April 29, 2005 May 10,2005 May 16, 2005 May 16, 2005 August 15,2005 Receipt of Bids Public Hearing Award of Contract Completion RECOMMENDATION It is recommended that the City Council give preliminary approval to the Resolution of Necessity, to approve the preliminary assessment schedule, to establish the date for the public hearing, and to authorize the City Clerk to advertise for proposals. PROJECT COMPLETION INCENTIVE Since the sidewalk is an integral part of the overall sidewalk network for safe passageway for students to the new Middle School, staff has included an incentive bonus for the contractor to complete all work prior to the specified completion date of August 15, 2005. For each calendar day that all work is fully completed prior to the specified completion date of August 15, 2005, one percent (1 %) of the actual construction costs will be given, to a maximum of five percent (5%) of the actual construction costs, as an incentive to complete the project ahead of schedule. For each calendar day that any work shall remain uncompleted beyond the specified completion date of August 15, 2005, $1,000 per calendar day will be assessed, not as a penalty but as predetermined and agreed liquidated damages. The Contractor will be separately invoiced for this amount, and final payment will be withheld until payment has been made of this invoice. BUDGET IMPACT The estimate for the project is as follows: Construction Contract Contingency Engineering Project Completion Incentive Total Project Cost $119,322.40 11,932.24 19,688.20 5.966.12 $156,908.96 Funding for this project is as follows: City Share Property Owner Assessment Total Project Funding $ 8,525.13* 148.383.83 $156,908.96 *The City Share includes the maximum incentive of five percent (5%) of the actual construction costs. The City's share will be funded through CIP010C89 and City Sidewalk Project 350042. ACTION TO BE TAKEN The City Council is requested to give preliminary approval to the Resolution of Necessity, to approve the preliminary assessment schedule, to establish the date for the public hearing, and to authorize the City Clerk to advertise for proposals through the adoption of the enclosed resolutions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That a public hearing will be held on the 16th day of May, 2005, at 6:30 p.m. in the Public Library Auditorium at which time interested persons may appear and be heard for or against the proposed plans and specifications, form of contract and cost of said improvement, and the City Clerk be and is hereby directed to cause a notice of time and place of such hearing to be published in a newspaper having general circulation in the City of Dubuque, Iowa, which notice shall be not less than four days nor more than twenty days prior to the day fixed for its consideration. At the hearing, any interested person may appear and file objections to the proposed plans, specifications, contract, or estimated cost of the improvement. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the City Council deems it advisable and necessary for the public welfare to make the herein mentioned improvements, and unless property owners at the time of the final consideration of this proposed resolution have on file with the City Clerk objections to the Resolution of Necessity, they shall be deemed to have waived all objections pertaining to the regularity of the proceeding and the legality of using the special assessment procedure. Said improvements shall be constructed and done in accordance with the plans and specifications which have been approved by the City Council and now on file with the City Clerk. That the cost and expense of making such improvement will be assessed partially or totally against privately owned property lying with the assessment limits, and in an amount not to exceed that provided by law, and in proportion to the special benefits conferred. The portion of the cost which shall be borne by the City will be paid from the Sales Tax Fund and special assessment bonds may be issued in anticipation of deferred payments of assessments when a contract has been performed and accepted, and the proceeds thereof used to pay the contractor.
