A resolution and other supporting documentation are attached. BACKGROUND Acquisition of repetitively flood- damaged property is a high priority for the City of Dubuque, as stated in the Local Hazard Mitigation Plan. The City historically has received periodic flood water inundations, mostly resulting from flash floods, with Catfish Creek being the primary source in the south part of the community, with increasing frequency, duration and depth over the past 15 to 20 years. Planning Services staff has been working with East Central Intergovernmental Association (ECIA) to facilitate the buyout of four properties that sustained substantial damage in the July 2011 flood event in the Catfish Creek flood plain. Attachment 1 is the property list. Attachment 2 is a vicinity map of the location of the four properties. Attachment 3 is the 2011 HGMP Buyout Application. The application includes a Local Match Resolution (Tab K) to be signed by the Mayor and at least four City Council members. The application is due to the State by December 15, 2011. DISCUSSION Flood plain properties sustaining substantial damage are eligible for the Federal Emergency Management Agency (FEMA) Buyout Program on a voluntary basis. Property owners of the four impacted and qualifying properties have requested buyouts. Three of these properties sustained damage to a degree that they must be demolished prior to the City obtaining ownership through the FEMA Buyout Program. The property at 1580 Old Mill Road (Biedermann) was the one that burned during the course of the flood. The two properties at 1658 Manson Road (Beining) and 1654 Manson Road 1 2011 HMGP Buyout Application (Thorpe) have had portions of their foundations collapse, making them a threat of imminent collapse. A request was filed with the State for the use of FEMA Public Assistance funds for demolition and related costs for these three properties. The fourth property at 1711 Old Mill Road (Lin) has suffered structural damage to the foundation, but not to extent that it poses a threat of imminent collapse. These structures have a documented history of flood damage and have flooded on more than one occasion. None of the properties were insured by the National Flood Insurance Program (NFIP), leaving the owners with limited resources for repair of their substantially damaged properties. This project proposes to acquire these properties and convert them to open space by removing all structures. Acquisition of these properties will remove flood -prone residents from harm's way and eliminate damages caused by flooding and future need for emergency response personnel. Removal of these properties also will reduce the number of structures in the flood plain, thereby reducing potential property damage in the future. BUDGET IMPACT The estimated budget of $673,718 for this HMGP Buyout Application is found in Tab D. The acquisition costs are estimated at $538,318. Replacement housing benefits are estimated at $93,400. A City contract to be signed with ECIA for Project Management of this application for $36,000 will include pre -award costs of $6,000 for professional services in project development. The remaining $30,000 will be used for management of the project from grant award to project closeout (36 months). These tasks include communication with property owners, request and award bids for legal costs, demolition and debris removal, file quarterly reports and related documentation. Legal costs, permits, and fees will cost approximately $1,500 per property or $6,000 for the entire project. The FEMA Buyout Program provides 75% of the funds with the City having a match of 15% and the State picking up 10 %. Authorized under Section 404 of the Stafford Act, the Hazard Mitigation Grant Program (HMGP) is funded by the Federal Emergency Management Agency (FEMA) to provide grants to State and local governments to implement long -term mitigation measures after a major disaster declaration. The purpose of the program is to reduce loss of life and property resulting from natural disasters and to enable mitigation measures to be implemented during the recovery from a disaster. Mitigation Project Requirements: 1) Project must conform to Iowa's Hazard Mitigation Plan. Specifically both roads intersect and are bordered by the Catfish Creek South and Middle Forks confluence. II. Detailed Project Description A. Describe the problem to be mitigated: This project will mitigate repetitive riverine flood losses on Old Mill and Manson roads located in the City of Dubuque in the floodplain and floodway. These properties have experienced repetitive flooding and all were substantially damaged in the July 2011 heavy rain event. Further, emergency personnel experience difficulty in responding to the property owners in need. In fact, as a result of flooding in one house a gas can tipped over and a spark ignited a fire. By the time firefighters arrived the house was surrounded by deep waters, six feet deep on the main floor of the house. The flood waters substantially damaged the house and the fire destroyed the roof. Fire damage was contained to this one property. The City of Dubuque will acquire 4 residential properties. All properties are located in the 100 -year floodplain or floodway and have experienced repetitive losses. All 4 were declared substantially damaged by the Floodplain Manager following a July 2011 flood event. This project will: A) alleviate the continued monitoring and repair costs to the city and to the residents as well as the need for government services to the area and: B) eliminate flood risks to residents and property damage to buildings. Once this application is awarded, all properties will need to be determined environmentally cleared. (SHPO clearance has already been attained on all 4 properties.) Properties will then be acquired, structures will be demolished, and land will be deed restricted and maintained as open space in perpetuity. C. Mitigation Plan Information 1. Explain: The proposed mitigation measure will provide an independent and long -term solution to the problem by permanently removing 4 substantially damaged properties from the floodplain /floodway areas and converting the space to green space in perpetuity, thereby eliminating the damage and costs associated with regular flooding. This project does not conflict with any long -term planning for Dubuque. Yes E. How does the proposed mitigation measure address a repetitive problem or a problem that poses a significant risk to public health and safety if left unresolved? Explain: The project permanently removes the at -risk structures and people from areas highly susceptible to flooding. Significant flooding has occurred between 1993 and 2011. If left unresolved this area will continue to flood, causing further structural damage, potential injury and illness to the residents and safety personnel. Removing the properties from the areas will be the most effective and environmentally sound alternative from the range of alternatives that are available. Removal will be the only method to completely ensure the occupants will be safe. F. How will the proposed mitigation measure substantially reduce future disaster losses, including the risk of future damage, hardship, loss, and /or suffering? Explain: The acquisition of properties and demolition of structures removes all risk of future disaster losses. The green space deed restriction assures no future property damage will occur as residential improvements will no longer be possible in the project area. G. Will the community suffer severe detrimental impacts (loss of life, loss of essential services, damage to critical facilities, economic hardship) if the proposed mitigation measure is not implemented? Explain: Without the proposed mitigation measures, the potential for loss of life for residents and emergency personnel is a very real possibility due to the potential structural damage, drowning, electrocution, etc. resulting with every significant rain and flood event. Each major flood event results in sanitary sewer overflows and interruptions in electric service in the area and road closures and places an economic hardship on the property owners having to repair flood damage. In the past twenty years the specific area of this project experienced major flood events in 1993, 1998, 2000, 2002, 2004, 2008, 2010, and now 2011. The floods have impacted the City's sanitary sewer system, storm sewer system, as well as streets and other areas of erosion. The 2011 flood resulted in flood depths in the structures in this application ranging from five to nine - plus feet. Two homes have collapsed foundation walls, another has foundation wall damage, and the fourth was also subsantially damaged as a result of 6 feet of flood water on its main floor. I. Discussion of Project Alternatives - Proposed Project & 2 Alternatives: A. Project descriptions and impacts (both beneficial and detrimental): Do Nothing Alternative: If nothing is done to alleviate the flooding problem, the area will continue to sustain flood damages, resulting in further damage to the structures, lower property value, increased costs to the city, and continued loss of services. Homeowners, rescue staff, police, fire and other city personnel will continue to be placed in a dangerous situation. This alternative allows for the continued flooding of these structures. The beneficial impact is that public funds would be saved in the short run. Therefore this alternative is not a viable option. Proposed Project: The proposed project will acquire and demolish 4 residential properties within the city limits of Dubuque. This action will eliminate the ongoing damages that have occurred during recent flood events. The acquisition and removal of the structures will eliminate the possibility of future damage to the structures and threat to the health and safety of the owners and emergency response personnel. The detrimental impact is it will be an expenditure of public funds. However, as noted, all 4 properties are located in the floodplain /floodway and were substantially damaged in a July rain event. Thus it will have a positive long term benefit cost ratio. Other Feasible Alternative (include estimated cost): The City of Dubuque considered the construction of a dike along the Catfish Creek in this area. The beneficial impact would be the dike would protect the community from flooding. However, the City determined that the project would not be financially feasible due to existing road and bridge elevations and proximity of a railroad track, which would require a concrete wall system and some elevations of infrastructure; thus providing a negative benefit/cost ratio and would not be the most cost effective mitigation measure. The elevation of the structures was also considered. However this option continues the ongoing possibility of flood damage and safety issues and would be less effective than acquisition. B Justification for choosing the proposed project - discuss how the proposed project is the most practical, effective, and environmentally sound alternative of the alternatives. The do nothing approach and elevation option were deemed to not be a viable options because both allow for continued damages and threats to life and safety of citizens and emergency response personnel. The other project alternatives were rejected because of the high costs /low benefits, potential problems created by the construction of a dike, and other safety issues. The proposed project eliminates any future possibility of flood damage to the structures that are removed and eliminates the threat to the health and safety of owners and emergency response personnel. Acquisition and demolition has been determined to be the most effective form of mitigation to address the hazards faced by the City. C, Describe how the proposed project best fits within the overall development plan for the community. The proposed project best fits with the City's overall development plan whereby properties located in the floodplain /floodway will be acquired thereby eliminating future damage to structures on these properties. The project also removes the threats to the life and safety of citizens and emergency response personnel as well as some future emergency response costs, as well as creating the open green space. Cost Effectiveness Information For Substantially Damaged Properties Located in the Floodplain: Properties that meet the following criteria are considered cost - effective and are exempt from further benefit -costs analysis: 1) The property must be located in a FEMA- identified regulatory floodplain or floodway, and 2) The property must be declared substantially damaged by the local authority having such jurisdiction, in accordance with criteria promulgated by the NFIP. The City of Dubuque in Dubuque County, population 56,200 is located in east central Iowa. Due to repetitive flooding, acquisition of repetitively flood- damaged property is a high priority for the City of Dubuque, as stated in the Local Hazard Mitigation Plan. The City historically has received periodic flood water inundations, mostly resulting from flash flood, with Catfish Creek being the primary source in the south part of the City, with the frequency, duration and depth increasing over the past 15 to 20 years. The City of Dubuque, working in conjunction with the East Central Intergovernmental Association (ECIA) and after soliciting public participation, has identified 4 single - family, detached residential dwellings within the area for acquisition. These structures have a documented history of flood damage and have flooded on more than one occasion. None of the properties were insured by the NFIP, leaving owners with limited resources for repair of their substantially damaged properties. This project proposes to acquire these properties and convert them to open space by demolishing all structures. Acquisition of these properties will remove flood -prone residents from harm's way and eliminate damages caused by flooding and future need for emergency response personnel. The City's Floodplain Manager contacted property owners who experienced flooding in July 2011 and meetings were held to gauge interest in a possible HMGP buyout. As a result, 4 property owners expressed interest in participating in the program. The 4 property owners signed Voluntary Participation statements (See Individual Property Tabs). Pre - Disaster Fair Market Value was established as 110% of the Dubuque County Assessor's 2011 assessed value. Per the Dubuque County Assessor, the 110% of the assessed value is a very reasonable figure to use for the actual sale of houses in Dubuque. All 4 of the identified structures have been declared substantially damaged by the Floodplain Administrator for the City of Dubuque (letters attached). All 4 properties in this application are located in Zone A of the Flood Insurance Rate Map for the City of Dubuque, Panel 195180 0006 B and received flooding from the Catfish Creek. All properties are located in the south area of the City, and are affected by the same flooding source. Some of the properties this project seeks to acquire are contiguous to to properties acquired through previous HMGP acquisition projects (see attached maps). A BCA is not required as all properties are located in the floodplain /floodway and are substantially damaged. ECIA assisted Dubuque in the project development (staff time, office equipment and office supplies) and wishes to be reimbursed for their professional services. The amount for these pre -award services are listed in the budget. Once the project is awarded, The City will contract with ECIA for grant administration for the length of the project (36 months). ECIA will notify individual property owners of the grant award and schedule individual meetings. Owners will be informed to prepare for the sale of their properties with individual timelines and budgets. Once sellers are prepared, a closing will be scheduled, payments will be made and the title and ownership will be transferred to the City via general warranty deed. The City Attorney will complete the title search, prepare legal closing documents and record the deeds with green space restrictions in the county assessor's office. Property Acquisition Application Scope of Work Tab B Page 1 HMGP Application If, after the presentation of the offer, the seller believes the offer price is incorrect due to factual errors and /or can present additional information directly relating to the pre -flood market value, the City will have an appeal process.The seller may appeal the estimate of pre -flood value after presentation of the City's offer to purchase and before the expiration date of the offer to purchase. Within two weeks of the City's offer to purchase, the seller shall present a written statement which includes the reason for the appeal such as factual information and any data that support the reason for the appeal to increase the offer price. The seller will assume the responsibility of securing an appraisal from an Iowa certified appraiser and incurring the expense of the appraisal. The seller will understand that the appraised value will be taken under consideration after the total project budget expenses are known and any revision in the acquisition offer will be subject to City Council approval. The seller is NOT guaranteed that the appraisal price will be used to determine the offer price and should anticipate that the City will not exceed its total project budget. Within 30 days of filing the written appeal statement, the seller must provide the appraisal report to the City for review. The seller may submit a written request to the City for a 14 -day extension to allow the additional time necessary to secure the appraisal. In the case that the seller exceeds the 30 -day period to obtain and submit the appraisal, and does not provide a written request for an extension, the original offer to purchase price will prevail. When the ownership of the properties has been transferred to the City of Dubuque, the mitigation deed restriction will be recorded with the county and all remaining structures on each property will be demolished. Properties will have asbestos testing and survey (if deemed safe for inspection), possible abatement, demolition and debris removal will be performed by a qualified contractor and the contract awarded following proper bid requirements and procurement in the 44 CFR. Following state and federal law, an estimate for asbestos inspection survey, possible abatement and a contract will be granted. Bids for demolition will be accepted and a contract will be executed. Demolition includes the removal of structures and transportation of debris to the Dubuque landfill. All utilities will be capped, concrete removed and basements filled. All lots will be converted to green space in accordance with the guidelines in 44 CFR, and maintained as such in perpetuity. After demolition activities are complete, all acquired properties will be maintained in perpetuity as green space. Long -term maintenance of the property will include lawn care, trash removal and vegetation management, and will be performed by the City of Dubuque, who will budget such expenses annually. The required deed restrictions will be recorded, with copies of the restrictions provided to the appropriate federal and state agencies. The City of Dubuque is willing and prepared to proceed with this project and desire to acquire these properties to avoid future flooding and threats to the health and safety of its residents and safety personnel. Property Acquisition Application Scope of Work Tab B Page 2 HMGP Application When the property owner accepts the City's offer, the seller will provide the City with the property abstract or the City will obtain a new 40 -year abstract (at the seller's expense). The City will forward the abstract or request for a new abstract to the City Attorney, who will function as the program's closing agent. The City Attorney will be responsible for ordering the abstract work, issuing a title opinion, transmitting the title opinion to the property owner and providing sample forms of affidavits and releases. Upon receipt of the necessary title - clearing documents from the seller, the City Attorney will prepare a closing statement utilizing the HUD -1 Settlement Statement Form, and set up the closing. The City will notify ECIA of the pending closing in order to undertake the required property inspections and prepare appropriate requisitions. The City Attorney will not close the transaction and the City will not take title to the subject property until the property owner has found a replacement property, obtained an accepted offer on that property, and is ready to close and take possession of that replacement property. The intention for this process is that the City wishes to arrange to take title to the flood damaged properties when the owner is ready to vacate and take possession of their chosen replacement property. Three of the properties were vacated immediately at the time of the flood and have relocated. No new structures or improvements shall be erected on the property other than: (1) A public facility that is open on all sides and functionally related to a designated open space or recreational use; (2) A public restroom; or (3) A structure that is compatible with open space and conserves the natural function of the floodplain, including the uses describe din Paragraph 1.a, above, and approved by the FEMA Administrator in writing before the construction of the structure begins. Any improvements on the Property shall be in accordance with proper floodplain management policies and practices. Structures built on the Property according to paragraph b. of this section shall be floodproofed or elevated to at least the base flood level plus 1 foot of freeboard, or greater, if required by FEMA, or if required by any State, Tribal, or local ordinance, and in accordance with criteria established by the FEMA Administrator. c. Disaster Assistance and Flood Insurance. No Federal entity or source may provide disaster assistance for any purpose with respect to the Property, nor may any application for such assistance be made to any federal entity or source. The Property is not eligible for coverage under the NFIP for damage to structures on the property occurring after the date of the property settlement, except for pre- existing structures being relocated off the property as a result of the project. d. Transfer. The Grantee, including successors in interest, shall convey any interest in the Property only if the FEMA Regional Administrator, through the State, gives prior written approval of the transfer in accordance with this paragraph. i. The request by the Grantee, through the State, to the FEMA Regional Administrator must include a signed statement from the proposed transferee that it acknowledges and agrees to be bound by the terms of this section, and documentation of its status as a qualified conservation organization if applicable. ii. The Grantee may convey a property interest only to a public entity or to a qualified conservation organization. However, the Grantee may convey an easement or lease to a private individual or entity for purposes compatible with the uses described in paragraph (a), of this section, with the prior approval of the FEMA Regional Administrator, and so long as they conveyance does not include authority to control and enforce the terms and conditions of this section. iii. If title to the Property is transferred to a public entity other than one with a conservation mission, it must be conveyed subject to a conservation easement that shall be recorded with the deed and shall incorporate all terms and conditions set forth in this section, including the easement holder's responsibility to enforce the easement. This shall be accomplished by one of the following means: a) The Grantee shall convey, in accordance with this paragraph, a conservation easement to an entity other than the title holder, which shall be recorded with the deed, or b) At the time of title transfer, the Grantee shall retain such conservation easement, and record it with the deed. iv. Conveyance of any property interest must reference and incorporate the original deed restrictions providing notice of the conditions in this section and must incorporate a provision for the property interest to revert to the State, Tribe, or local government in the event that the transferee ceases to exist or loses its eligible status under this section. FEMA, its representatives and assigns including the State or Tribe shall have the right to enter upon the Property, at reasonable times and with reasonable notice, for the purpose of inspecting the Property to ensure compliance with the terms of this part, the Property conveyance and of the grant award. 3. Monitoring and Reporting. Every three years on , the Grantee (mitigation grant program subgrantee), in coordination with any current successors in interest, shall submit through the State to the FEMA Regional Administrator a report certifying that the Grantee has inspected the Property within the month preceding the report, and that the Property continues to be maintained consistent with the provisions of 44 C.F.R. Part 80, the property conveyance, and the grant award. 4. Enforcement. The Grantee (mitigation grant program subgrantee), the State, FEMA, and their respective representatives, successors and assigns, are responsible for taking measures to bring the Property back into compliance if the Property is not maintained according to the terms of 44 C.F.R. Part 80, the property conveyance, and the grant award. The relative rights and responsibilities of FEMA, the State, the Grantee and subsequent holders of the property interest at the time of enforcement, shall include the following: a. The State will notify the Grantee and any current holder of the property interest in writing and advise them that they have 60 days to correct the violation. i. If the Grantee or any current holder of the property interest fails to demonstrate a good faith effort to come into compliance with the terms of the grant within the 60 -day period, the State shall enforce the terms of the grant by taking any measures it deems appropriate, including but not limited to bringing an action at law or in equity in a court of competent jurisdiction. ii. FEMA, its representatives, and assigness may enforce the terms of the grant by taking any measures it deems appropriate, including but not limited to 1 or more of the following: a) Withholding FEMA mitigation awards or assistance from the State or Tribe, and Grantee; and current holder of the property interest. b) Requiring the transfer of title. The Grantee or the current holder of the property interest shall bear the costs of bringing the Property back into compliance with the terms of the grant; or c) Bringing an action at law or in equity in a court of competent jurisdiction against any or all of the following parties: the State, the Tribe, the local community, and their respective successors. 5. Amendment. The Federal Emergency Management Agency reviewed and - accepted these. data; for• purposes of this •revision. 3.0 aCSEE Catfish Creek was studied in detail from its:. mouth at the Mississippi. River to approximately 5,200 feet upstream of the confluence of Middle Fork Catfish :Creek. North Fork Catfish Creek was studied in detail from its mouth at Middle Fork Catfish Creek to. approximately 3,500 feet upstream of University Avenue.- _Middle Fork Catfish Creek was studied in detail from its mouth at Catfish Creek to approximately 1,500 feet upstream of Radford Road. South Fork Catfish- Creek was studied in detail from its mouth at Catfish Creek to approximately 2,000 feet upstream of U.S. Highway 20. The Water- surface' profiles for the Mississippi River between river mile 578.5 and river mile 585.3 were revised on the basis of more current hydrologic and hydraulic information. Approximate flooding was added along Couler Valley..and along Union Park Hollow. • •Hydrologic and hydraulic analyses •for the: -Mississ.ippi• River were obtained from the COE report titled "Upper. Mississippi River Water S..urface:Profiles,' River Mile 0.0 to River Mile 847.5" • (Reference 1). • ., Hydrologic analyses were carried out to establish :the `peak discharge- frequency relationships for Catfish Creek and its tributaries. Catfish •Creek is' an :eungaged. Stream, 'so a'synthetie: methods were .employed to obtain the discharge - frequency 'relationships. for the 10- ,•50- ,•100 -, :and 500 -year flood events. The • COE "Bluff Frequency Study, Upper Mississippi River" (Reference 2) was used to determine the discharges for Catfish Creek. This study uses regression equations from the COE study and known basin data. Peal< 'discharge- drainage area relationships for the 10-, 50-, 100-, and 500 -year floods of each flooding source studied in detail in the community are shown in Table 1, Summary of Discharges. Channel cross sections- for the backwater analyses of Catfish - Creek were obtained from a COEtSpecial'Flood - Hazard Investigation' Report -on- Catfish Creek and its tributaries (Reference 3). For the COE F1ood..Hazard Report (Reference 3), plans were obtained to determine the elevation data and structural geometry of all - bridges -'not field surveyed. •, ` . Roughness coefficients (Manning's "n ") used in the hydraulic computations were chosen :by engineering :.judgment and':based.on field observation of Catfish Creek and its overbenk areas. Flood profiles were drawn showing computed water - surface elevations for the 10-, 50-, 100-,. and 500 -year floods. • Starting water - surface elevations for Catfish Creek were calculated using. the sloperarea method:. Boundaries of the 100- and 500 -year floods along Catfish Creek and.'its.tributaries have been delineated using the flood elevations determined at each cross section. . Between •. cross..seotions,:r. the boundaries, were interpolated. using detailed •topographic mapsrat.a scale of 1:4800.(Reference 3).•, Approximate =flooding along Coulee Valley, a.nd •Union Park Hollow. within the city • limits wasrbased 1nQ- the,.100 -year flood elevations.taken from .the•Flood Insurance Studies for Dubuque County,.Iowa,.;and the.City of Sageville, Iowa (References 5 and 6). All 'elevations are referenced to the National Geodetic Vertical Datum of 1929 (NGVD). Elevation reference marks used in this study are shown on the map and described in'Che exhibit •labeled Elevation Reference Marks. • 5.0 FLOODWAYS Floodways were previously not determined for flooding sources within the City of Dubuque. _ ,This report incorporates the results of the floodway analyses for Catfisk•Creek,•North Fork Catfish Creek, ,Middle,•Fork.Catfish Creek, and South Fork Catfish bee* into the: effective FloodTnsuranoe Study;:, Encroachment on `floodpiains, ,:such •as' struetur'es and fill, reduces the flood - carrying capacity, inereases4h.flood heights and velocities, and increases flood hazards in areas'- beyond the encroachment.. itself. One aspect of floodplain management. involves balancing the:, economi gain .from floodplain development against the resulting increase in flood hazard. For purposes of the National Flood Insurance Program, a floodway is used as a tool to assist local communities in this aspect of floodplain management. Under this concept, the area of the 100 - year floodplain is divided into a floodway and a floodway fringe. The floodway is the channel of a stream plus any adjacent floodplain areas that must be kept free of encroachment so that the 100 -year flood can be carried without substantial i1X!ronses in flood heights. Minimum I4sbrrtl stnutlnrtls limit such uWrc'a:c`L to Li) foot, provided that hazardous velocities are not produced. The floodways in ,this study are presented to local agencies as minimum standards that can be adopted, directly or that can be used as a basis for additional floodway studies. The floodways presented for this study were computed. for certain stream segments on the basis of equal conveyance reduction from each side of the floodplain. Floodway widths were computed at cross sections. Between cross sections, the floodway boundaries were interpolated. The results •of the floodway computations are tabulated for selected cross sections and are shown in Table 2, Floodway Data. • The computed floodways are shown on the Flood Insurance Rate Map. In cases where the floodway and the 100 -year floodplain boundaries are either close together or collinear, only the floodway boundary is shown. Portions of the •floodway of Catfish.Creek and North, Middle, and South Forks Catfish Creek lie outside the corporate limits. • • Along streams where floodways have not been computed, the community must ensure that the cumulative effect of development in the floodplain will not cause more than a 1.0 -foot increase in the base flood elevations at any point within the community.. , .. • The area between the floodway and the 100 -year floodplain boundaries is termed the' floodway fringe. The floodway fringe encanpasses the portion of the floodplain that could be completely obstructed without increasing the water - surface.elevation of the 100 -year flood more than 1.0 foot at any point. Insurance Stud y by approximate methods. Because detailed hydraulic analyses are not performed for such areas, :no base 'flood elevations or depths ate`shoivn within this zone. Zone AE Zone AE is the flood ins1tanee "late Zeno that . correspohds to the 100 -year floodplains that are determined in the Flood Insurance Study by detailed methods. Whole foot •base 'flood elevations derived' from the detailed hydraulic analyses are shown at selected intervals within this zone. Zone X Zone X is the flood insurance rate zone that corresponds to areas outside the 100 - year fiobdpiain, areas of 100=yeaicflboding where average depths are Tess than 1 foot, areas of 100 -year flooding where the contrib:iting'drainage' area is less than 1 square mile, and areas protected from the 100 -year flood by levees. No base flood elevations or depths are shown within 'this zone. 7.0 nooD INSURANCE RATE MAP The Flood Insurance Rate Map 'is designed for flood insurance and floodplain management applications. For flood insurance applications,1 the map designates flood insurance rate zones as described in Section 6.0 and, in the 100 -year floodplains that were studied by detailed methods, shows selected whole -foot base flood elevations or average depths: Insurance agents used the zones and base flood elevations in conjunction with information on structures !and their contents to assign premium rates for flood insurance policies. For . floodplain management applications, the map shows by tints, screens, and symbols the 100- and 500 -year floodplains, the floodways, and the locations of selected cross sections used in the hydraulic analyses and floodway computations. 8.0 OTHER STUDIES Flood Insurance Studies published for Dubuque County and the City of Sageville, Iowa (References 5 and 6); Jo Daviess County, Illinois (Reference 7); and Grant County, Wisconsin (Reference 8) are in agreement with this study. .ry 1 9.0 REFERENCES 1. If you do however purchase the land the DCCB has a permit for you would have to abide by that permits regulations. In other words the agreement of that permit would transfer rights to the owner of the property. As for the 2 address w /potential wetland (17949 and 17969 Deere St. in Dubuque, IA) if it is determined there is wetland at these sites you would need to coordinate w /the Corp and apply for a permit. -This means without a permit (assuming the land is indeed wetlands) you could not place any fill in the wetland and you could not grade any of the wetland. - That's not to say you couldn't do these activities if needed, you would need to apply for a permit first. The permit " -' would then state all regulations you would need to follow. -Upon further investigation if these areas are not wetlands you would not need to coordinate w /the Corps as these would not be 404 regulated lands.
