The HPC is advisory to the City Council for the review of public projects in historic districts. A timeline and other supporting documentation are enclosed for the City Council's consideration. Background The Carnegie Stout Public Library Board of Trustees requested HPC concurrence for two, free - standing, internally illuminated, aluminum signs that were installed by Lange Sign Group without an approved building permit and without HPC review. The signs replaced two, free - standing, internally illuminated, aluminum signs as part of the Library renovation project. Details of the new signs are provided in the enclosed plans provided by Lange Sign Group. The Library plaza renovation was presented to the HPC for review in 2009. The City Council agreed with the Commission's recommendation and approved the Library plaza renovation at the June 15, 2009 City Council meeting. The application and approval are enclosed. The 2009 staff report noted the plans depicted locations for monument signs. Designs for new signs were not included in the Library plaza renovation plans. The staff report noted the design of new signs will need to be reviewed by the Commission at a future meeting. New signs were installed September 13, 2010 by Lange Sign Group without a permit and HPC review. No permit has been issued yet for the signs. Discussion The Commission initially reviewed the new signs at our February 17, 2011 meeting. The HPC's principal concerns with the signs were the yellowish color and the design and materials of the sign base. The Commission felt that the signs needed to be repainted a color that better matched the building. The HPC also did not support the plastic columns that serve as the base of the sign and recommended a stone or concrete base raised no more than 12 inches above the ground. Subsequently, the Library Board met and discussed the signs and the HPC's recommendations. The Board expressed a willingness to repaint the signs with a color that Carnegie Stout Public Library Signs Page 2 more closely matches the building since Lange Sign has agreed to do that at no charge. The Library Board expressed their decision to retain the columns, which the Board felt provide a desired height for the signs and appropriate design of the columns. The HPC reviewed the Library Board's position at our August 18, 2011 and noted Lange Sign's and the Library Board's procedural concerns with the sign permit review process. The Commission noted Planning Services staff has met and developed new procedures for sign permit reviews to improve the efficiency and timeliness of the process. The HPC felt that Lange Sign did not get the proper authorization to install the signs. The Library Board considered a new sign design proposed by Lange Sign Group at the September 29, 2011 Board meeting. This design was, in effect, only repainting the signs to the color recommended by the HPC. The Library Board reaffirmed their desire to retain the signs as designed, and to repaint them as recommended by the HPC. The HPC considered the Library Board's position again at our November 17, 2011 meeting, and then reaffirmed our position for the reasons previously stated. Recommendation: The HPC feels that allowing the signs would establish a bad precedence for the City not following its own rules. The Commission hopes the City Council looks to the HPC as the mechanism which assures that improvements happen according to the ordinances and architectural guidelines adopted by the City Council. The HPC notes that the Library is individually listed in the National Register of Historic Places and is also a contributing building to a National Register Historic District. The Commission notes the building is also a City Landmark in a local historic district, which sets the standard above other buildings. By a unanimous vote at our February 17, August 18, and November 17, 2011 meetings, the HPC respectfully recommends that the City Council approve the sign design without the columns and instead, with the use of a stone or concrete base raised no more than 12 inches above the ground, and to change the color of the painted parts of the sign to match the color of the building for all the reasons discussed at our meetings. The application depicted location for new monument signs, but no proposed design or materials. Rick Golus, The Durrant Group, was present at the meeting. Mr. Golus was the project manager. The Staff report noted if new signs are proposed, the HPC will need to review the design at a future meeting. The HPC recommended approval of the entry plaza. City Council approved the entry plaza. Sign permit application submitted to the Building Services Department. Sign Permitted forwarded to the Planning Services Department for review. Planning Services Staff contacted Lange Sign to inform them that the sign was located in both an OR zoning district and in a historic preservation district and that HPC review may be necessary. Planning Services Staff informed Lange Sign that research would be required to determine how original signs were allowed. Research began on the signs. Coordination with City Legal Staff regarding the legal non- conforming status of the former library signs and proposed signs also began. Planning Staff researched CSPL sign history in the Planning and Building Departments as well as the archives in the Historic Federal Building archives and was unable to find permit information. Planning Services Staff again made another attempt to locate permit information for the previous signs. Staff did locate permit information. It was misfiled in archives. The new signs were installed without an approved building permit or HPC Advisory Design Review. The HPC questioned the sign installation and why they did not review the signs. Planning Services Staff met with Legal Staff to discuss the 1 Carnegie Stout Public Library Timeline of Events: review process. It was determined the Unified Development Code does not require a permit for government signs, and thus the signs are exempt from the building permit process; however failure to consult the HPC was a violation of city policy. October 20, 2010 December 13, 2010 December 16, 2010 January 18, 2011 January 21, 2011 January 31, 2011 February 17, 2011 The City Manager was informed of the signs and direction was requested. The City Manager requested City Departments meet to determine where the process failed and reiterate the City's policy that public signs for historic properties be reviewed by the HPC. Planning Services and Legal Staff met to discuss process and respond to the City Manager's questions. Planning Staff met with Library Director Susan Henricks and Project Manager Steve Brown to discuss the process and reiterate the city policy. Susan Hendricks explained at the meeting that she had relied on the sign contractor to obtain the permits and reviews required for historic districts. Susan and her staff had advised the sign contractor that the Library was in a historic district, and they were assured by the sign contractor that the firm would handle the sign permit and review process. Results of January 18th meeting reported to the City Manager. Noted that the HPC had requested the sign contractor present an application for Advisory Design Review. CSPL applied for Advisory Design Review to allow the after - the -fact signs. HPC reviewed the application. The meeting was attended by Rick Droeske, Lange Sign and Library Director Susan Henricks. The Commission noted the proper process was not followed. The Commission recommended approving the signs as submitted without the columns and using a stone or concrete base raised no more than 12 inches above the ground and change the color of the painted parts of the sign to match the color of the building. March 24, 2011 Planning Services Manager Laura Carstens and Lange Sign representatives Dan Lange and Rick Droeske met with the 2 Carnegie Stout Public Library Timeline of Events: CSPL Board of Trustees to discuss the signs and the HPC's recommendations. July 28, 2011 August 18, 2011 August 30, 2011 September 15, 2011 September 29, 2011 November 17, 2011 The CSPL Board met and agreed to repaint the sign as requested, but will not remove the columns or lose the height of the signs. The HPC met and discussed the CSPL Board's decision. The HPC re- affirmed their motion to recommend City Council approve the signs as submitted without the columns and use a stone or concrete base raised no more than 12 inches above the ground and change the color of the painted parts of the sign to match the color of the building. Library Director Susan Henricks informed Planning Services Staff that Lange Sign was providing the CSPL Board of Trustees with a new sign design. In light of the new information, the HPC met and reconsidered their motion to City Council. The HPC instead forwarded a recommendation to the Library Board with the following suggestions: 1) To maintain the sign design without the columns, 2) to use a stone or concrete base no more than 12 inches above the ground; 3) to change the color of the painted parts of the sign to match the color of the building; and 4) to thank the Library Board for its reconsideration. The CSPL Board of Trustees met and discussed the HPC suggestion. It was noted the only change reflected in the plans was to change the paint color. The Board agreed to follow their original plan to only change the color of the sign. Lange Sign acknowledged that they did not have a permit in hand when the signs were installed. Susan Henricks questioned if the sign columns could be repainted as they are chipping and peeling. Planning Services Staff reported to the HPC that the only change to the signs was that Lange Sign agreed to repaint the painted portions of the sign to a color recommended by the Commission, but no significant changes were proposed for the sign design or materials. Staff noted the position of the CSPL Board is that they are willing to repaint the signs with a color that blends better with the building, but they are not willing to remove the columns because the Board would like to maintain the functional height of the signs. A design for the exterior library signage was received from Lange Signs and presented to the Library Board, which reflected the change in color to the signs without other elements changed. The Library Board of Trustees, with a vote of 6 -0, agreed to the color change and reaffirmed their earlier decision to alter only this element. The Board believes the height of the signs, which are similar to the size and height of the earlier signs, are important in order to be seen. Although the columns and top piece may not be proportional as the Commission pointed out, they are representative of the building and had been approved prior to the installation. It is regrettable that after this approval by the Library Board that the sign was not submitted to the Historic Preservation Commission for review. The Director and Library Board of Trustees trusted their construction manager and Lange Signs to manage the necessary permits and approvals. Enclosures Minutes — Historic Preservation Commission February 17, 2011 Page 3 DESIGN REVIEW: Application of Carnegie Stout Public Library for a Certificate of Appropriateness to replace existing aluminum signs with new aluminum signs for property located at W. 11th, Bluff and Locust Streets in the Jackson Park Historic District. Staff Member Johnson reviewed the staff report. He explained the request is to allow two after - the -fact freestanding internally illuminated aluminum signs that were installed without an approved building permit and without the Commission's review. He said that the new signs were installed as part of the Library renovation project and that they replaced two freestanding internally illuminated aluminum signs. He referred to the plans provided by Lange Sign Group contained in the application. Staff Member Johnson explained the Library Plaza renovation was presented to the Commission for review in 2009. He said that the City Council agreed with the recommendation of the Commission and approved the Library Plaza Renovation at the June 15, 2009 City Council meeting. He explained the plans presented for review and approval in 2009 as part the renovation project noted the new sign locations but did not include a design. Staff explained the 2009 staff report noted the design of any new signs for the facility required review by the Commission at a future meeting. Staff stated the new signs were installed on September 13, 2010 without the benefit of an approved permit application and HPC design review. Staff Member Carstens explained a memo has been prepared and distributed to Commissioners which details the history of sighage at the Library as well as the review process for the new signs. She explained the installation of the new signs appears to have been an oversight in the review process for the Library entry plaza renovation. She noted the Carnegie Stout Public Library Director Susan Henricks has consulted with Planning and City staff numerous times on components of the renovation. Chairperson Knight noted this issue was initially raised by the Commission. The Commission noted concerns regarding the size and scale of the sign. The Commission questioned whether the sign size and height were under their purview. Staff members Carstens and Hemenway explained that specific standards regarding sign height and area are typically addressed through zoning regulations. Staff Member Johnson explained the City of Dubuque Architectural Guidelines for signs typically address style, design, materials and illumination. Staff Member Hemenway said that signs located in the Office Residential zoning district are limited to 16 square feet in area and six feet in height. He stated exemptions are given for educational institutions. He noted when the sign permit was applied for; the proposed Carnegie Stout Public Library signs were in excess of the. allowed 16 square feet and six feet in height. He noted the permit required research but assumed the Library was classified as an educational institution when the original permit was applied for in 1989, which explains why a 32 square foot and 10 foot high sign was allowed. Minutes — Historic Preservation Commission February 17, 2011 Page 4 The Commission said that they felt that the attempt to integrate design elements from the original building into the sign was not successful and that the attempt to make the material match the color of limestone failed. The Commission said that the color of the sign is greatly different than the color of the limestone in the building and; therefore, the signs stand out. The Commission stated the proportions of the sign are not appropriate. The Commission and staff discussed the ability to regulate the bulk standards for the sign. Staff Member Carstens noted the enabling legislation at the state level is different for zoning and historic preservation, and therefore, their ability to do so is somewhat limited. Staff clarified that the Zoning Ordinance would also regulate the type of sign but not the design or materials of the sign. Staff noted the Historic Preservation Commission would review the design and materials of sign. The Commission noted the existing signs use classical design elements but in a way that does not make a lot of sense. They noted the signs attempt to look like a building. The Commission said that they felt removing the columns and locating the signs on top of a solid stone or concrete surface close to the ground would be more appropriate. The Commission felt painting the sign to be more in keeping with the color of the limestone on the Library would be an improvement. The Commission reviewed the Architectural Guidelines for signs in Historic Districts. Commissioners noted the guidelines suggest signs be compatible with the scale, style and period of the building in the district. Commissioners noted new signs should be composed of traditional materials such as wood, copper or bronze. The Commission noted plastic, plywood and internally illuminated signs are not recommended. Commissioner Stover stated the existing signs have a Las Vegas appearance that cheapens the look of the Library, the restoration effort that went into the Library, and the money invested in the Library. Rick Droeske, Lange Sign Group, discussed the signs with the Commission. Mr. Droeske noted he started the project over 18 months ago. He stated that the Library's input was considered and a concept for the design of the Library signs was developed that emulated the building to some degree. He noted that neither he nor the designer were aware that the Historic Preservation Commission would be involved in reviewing the sign designs. He said the previous signs were boxy, metal and internally illuminated freestanding signs that did not match the Commission's current vision for the appropriate signage for the building. He said the proportions of the signs would have been considered if Lange Sign had known the Commission would review the project. He stated the Library selected the sign colors. Mr. Droeske took issue with Commissioner Stover's opinion that the sign looks like one that would belong in Las Vegas. The Commission reiterated that they feel that the sign is not an appropriate representation of the building. Mr. Droeske noted these issues were not brought to his attention when the permit was applied for in August, 2010. The Commission explained that as a professional Minutes — Historic Preservation Commission February 17, 2011 Page 5 sign contractor, it is Mr. Lange's job to know or educate himself on the statutes and regulations in the City of Dubuque where he conducts business. Mr. Lange explained he was not aware the building was located in a historic district. The Commission further questioned Mr. Lange's knowledge of the design review requirements for signs proposed in historic districts. Mr. Lange noted he's been in the sign business for nine years and cannot recollect a sign project that he has undertaken in a historic district. Mr. Lange said that he has installed over 13,000 signs in the tri -state area and to the best of his memory, he has never installed a sign without a permit. The Commission reiterated the proper procedures for installing signs in a historic district, and noted they are charged with reviewing an after - the -fact sign as if it was never installed. The Commission noted that because the previous signs were internally illuminated, they would be more amenable to internal illumination. They noted the signs before were metal and the current signs are metal; and therefore, less of an issue. The Commission noted the materials in general are not the issue; rather that they felt the style is inappropriate. The Commission discussed a design alternative that would omit the columns and locate the cabinet portion of the sign on top of a solid concrete or stone base fabricated with similar color and texture as the stone on the Library. The Commission discussed painting the components of the existing sign that are identified as color PMS9141 on the rendering with a color that is similar to the stone in the building. Commissioners reiterated that the base of the sign does not have to be stone, but, can be a smooth concrete material similar in appearance to the stone on the building. Susan Henricks, Library Director, stated she is open to repainting the yellowish colored components of the sign to a more appropriate color. She said; however, that the changes proposed for the sign structure will require money that is not budgeted. She noted the signs were installed with funding from grants, and she would not know where to locate the additional funding necessary to make the changes. The Commission suggested the Library require Lange Sign Group to pay for the necessary changes to the sign, since they did not follow proper procedure. The Commission said that they felt that the professional sign contractor is responsible for following the appropriate procedures and obtaining the necessary permits and approval. The Commission noted that other businesses in the downtown have been able to follow the appropriate procedures required for installing signage. Mr. Droeske explained Lange Sign did not fail in their responsibilities and checked with Zoning regarding what they were allowed to do. He noted Lange Sign Group submitted a drawing and application for a permit. Mr. Droeske said the first time they heard the sign was not approved was when they were given notice the Historic Preservation Commission meeting. The Commission asked Mr. Droeske whether he had an approved permit when the sign was installed. Mr. Droeske suggested the question be directed to the Planning Services Department and stated the City has a responsibility to respond to a building permit application within 20 or 30 days. Staff Member Carstens explained Mr. Droeske is incorrect, and there is not a time limit in responding to a building permit application. She stated Mr. Droeske should be aware of the sign regulations because Mr. Droeske is on record presenting signs for design review to the Historic Preservation Commission. Mr. Droeske questioned which signs he presented. Staff Member Carstens stated he presented the Caroline's Restaurant sign attached to the Hotel Julien as well as the Platinum building sign. The Commission again questioned whether the Lange Sign Group is aware of design guidelines and review for signs in historic districts. Mr. Droeske acknowledged that he is aware of design guidelines in historic districts. The Commission questioned Mr. Droeske's or Lange Sign's knowledge that the Carnegie Stout Public Library is located in a historic district. He stated he is not from Dubuque and was not aware that the Library was located in a historic district. Staff Member Carstens stated that Library Director Susan Henricks had informed her that she explained to Mr. Droeske that the building was a historic structure. Staff Member Hemenway reviewed the history of the Carnegie Stout Public Library signage and the timeframe of events regarding the installation of the new signs. He said that on August 9, 2010, Mr. Droeske submitted a sign permit application and on August 10, 2010 he spoke with Mr. Droeske regarding the issue, and stated the building was in a historic district. He stated that Mr. Droeske responded that the signs that were going to be removed were internally illuminated metal cabinetry signs, and that he felt that there should not be a problem with replacing them. He said that he explained to Mr. Droeske that the permit application would need to be researched since he could not locate any permit history for the prior Library signage. Staff Member Hemenway stated he could not find the Certificate of Appropriateness review history for the signs either. He stated that, after some time, he was able to locate the original permit information and a Certificate of Appropriateness for the Library signage which he said had been misfiled in the archives located in the basement of the Historic Federal Building. He noted that Mr. Droeske said that the new signs had been in the design process for at least 18 months prior to the date they were installed. He explained the best course of action for a sign contractor is to include the Planning Services Department in the early stages of developing sign concepts so that zoning and design issues can be addressed. Mr. Droeske explained he felt Lange Sign Group did that, and by no means tried to circumvent the process. The Commission explained that they do not feel the applicant intentionally circumvented the process; however, that does not change the fact that the proper process and guidelines were not followed. Motion by Wand, seconded by Bichell, to approve the design as submitted without the columns and using a stone or concrete base raised no more than 12 inches above the ground and change the color of the painted parts of the sign to match the color of the building. The Commission reviewed that most components of the sign can be retained. The Commission reiterated that the base does not have to be stone; but, that it can be constructed of a concrete material. DESIGN REVIEW: Application of Michael Ruden / IIW Engineers & Surveyors, P.C. for a Certificate of Appropriateness to install new siding and doors on the front addition for property located at 625 Bluff Street in the Cathedral Historic Preservation District. Staff Member Johnson reviewed the staff report. He noted Mike Ruden, IIW Engineers is requesting a Certificate of Appropriateness to install new siding and doors on the front, built -in, one -story enclosed porch addition. He noted the building is a non - contributing structure to the district. He stated that is most likely due to the degree of alterations to the building, noting the enclosed porch addition where the new doors and siding are proposed. He explained the request will replace the existing metal doors and frame with two -30 inch, six panel doors. The doors will have one -half inch insulated glazing in the upper panels. The doors will be finished with faux wood paint. He referred to the drawings provided by the applicant. He noted the recent stairs and landing which appear in the staff report. He explained a building permit was issued for the stairs on October 13, 2009, and therefore the stairs were constructed legally but without the Commission's review. He stated he met with the Building Services Department back in 2009 to point out the error and reinforce the procedures for Historic Preservation Commission design review. Mike Ruden, IIW Engineers, was present. He discussed the faux wood paint and other options for paint. The Commission stated a solid paint color would be more historically appropriate. Planning staff proposes that the review process be slightly amended to improve efficiency and eliminate potential mistakes that may occur when interdepartmental review of sign requests is necessary. DISCUSSION Planning Services, Building Services, and Engineering staff frequently receive inquiries regarding signage for commercial, industrial and residential properties throughout the community. The primary point of contact for sign permits is the Building Services Department, as they are responsible for issuing sign permits. However, in addition to Building Services staff, the Planning Services Department receives numerous calls as Planning staff regulates bulk standards for signs by zoning district, and Engineering staff receive calls regarding requests to place signs in the right -of -way or complaints regarding illegal signage in the right -of -way. This memo presents a proposal whereby all sign requests are reviewed in a timely and efficient manner to avoid confusion and eliminate potential mistakes. 1. All sign inquiries (with the exception of the City's traffic signage), whether fielded by Engineering, Building or Planning staff should be routed to either Assistant Planner Guy Hemenway or Assistant Planner Wally Wernimont in the Planning Services Department. 2. Planning Services staff will determine whether interdepartmental review is necessary, and whether a sign permit application is needed. Sign Permit Review Process Page 2 3. Planning staff will forward, through e-mail, any sign requests that require: a. Compliance with the Secretary of Interior's guidelines for those signs located in a historic district, b. Design review for signs in districts bound by the Downtown Design Guidelines, c. Approval to be in the public right -of -way, to the appropriate department's staff. 4. If interdepartmental review is required, those staff that receive an e-mail inquiry from the Planning Services staff will return their review and comments by e-mail to planning staff within 3 business days. 5. Planning staff will summarize all requirements for the person requesting a sign(s) and provide them via phone, e-mail or in written form said requirements within 5 business days of receipt of the initial inquiry. 6. All sign permits that have been applied for through the Building Services Department will be routed directly to Planning Services staff for their review. Planning Services staff will follow procedures 1 -5 regarding sign permits to guarantee that, when necessary, interdepartmental review has been conducted and approval granted. 7. Planning staff will sign -off on the Unified Development Code regulation portion of the sign permit and then route it to other staff /departments, as necessary. 8. Once other departments have signed -off on the permit, Planning staff will send the signed permit to the Building Services Department for their issuance. Planning staff will then notify the permit applicant that they have received an approved sign permit. Please note that this process is not necessarily all- inclusive. There are often sign permit inquiries that require other forms of review. Special events signage for City sanctioned festivals, governmental signage ( "Dubuque, Masterpiece on the Mississippi" entry signs for example), signs placed within City easements that require City Manager and City Council approval (IBM Signs for example) require special review that may not be included in the process outlined above. Staff Analysis: The applicant is requesting a Certificate of Appropriateness for two, free - standing, internally illuminated, aluminum signs that were installed without an approved building permit and without HPC review. The signs replaced two, free- standing, internally illuminated, aluminum signs as part of the library renovation project. Details of the new signs are provided in the enclosed plans provided by Lange Sign Group. Design Review Staff Report — Carnegie -Stout Public Library Page 2 The library plaza renovation was presented to the HPC for review in 2009. City Council agreed with the recommendation of the Commission and approved the library plaza renovation at the June 15, 2009 City Council meeting. The application and approval are enclosed.
