SUBJECT: Asbury Road Sidewalk Installation Project
John F. Kennedy Road to Iowa 32 (Northwest Arterial)

City Engineer Gus Psihoyos recommends initiation of the bidding process for the
Asbury Road Sidewalk Installation Project, and further recommends that a public
hearing be set for June 6, 2005.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Asbury side of Kimberly properties. The area is presently difficult to cut
the grass and trim bushes, but will be more difficult to maintain and access
for snow removal, especially after snow plows have passed.
A comment was made that school children in the Kimberly Road area are
outside the two-mile limit from the Middle School and would be probably
bussed to the school. (Note: Resurrection School is within the two-mile
limit.)
Expense to Kimberly property owners affected by any future Asbury Road
project. Some property owners on Kimberly were required to repair
defective sidewalks as part of the 2004 Sidewalk Inspection Program. Also
some property owners in this area would be assessed as part of the
proposed 2006 Bonson Road Reconstruction Project.
Engineering responded as follows:
Petition received and directive of City Council was for installation of
sidewalks on the north side of Asbury Road only.
Asbury Road is not unique and many other areas of the City have multiple
frontages, access issues, topographical difficulties with property owners
responsible for maintenance of sidewalk condition, grass-cutting, plant
trimming, and snow removal.
Sidewalks are not only for school children who may be walking to
Resurrection School; they are used by bicyclists, strollers, disabled, and
other pedestrians wishing to have a continuous walking network from
neighborhoods and from one development area to another.
Property owners are being allowed to seek bids and install walks prior to
June 27, 2005; after that, the City contractor will perform the work on the
assessment project.
As part of a previous City Council directive, the City of Dubuque will not
assess a property owner more than 25% of the value of the property with
improvements over a cumulative 1 O-year period.
There are several small trees in the public right-of-way that will have to be
removed to construct the sidewalk on Asbury Road. City Forester Steve
Pregler has reviewed all the trees that must be removed and has
determined that there is no significant effect of their removal.

PROJECT COMPLETION INCENTIVE
Since the sidewalk is an integral part of the overall sidewalk network for safe
passageway for students and all pedestrian usage, staff has included an
incentive bonus for the contractor to complete all work prior to the specified
completion date of August 20, 2005.
For each calendar day that all work is fully completed prior to the specified
completion date of August 20, 2005, one percent (1 %) of the actual construction
costs will be given, to a maximum of five percent (5%) of the actual construction
costs, as an incentive to complete the project ahead of schedule.
For each calendar day that any work shall remain uncompleted beyond the
specified completion date of August 20, 2005, $1,000 per calendar day will be
assessed, not as a penalty but as predetermined and agreed liquidated
damages. The Contractor will be separately invoiced for this amount, and final
payment will be withheld until payment has been made of this invoice.

The City Share includes the maximum incentive of five percent (5%) of the actual
construction costs, tree removal, payment of agricultural-zoned properties, and
the purchase of right-of-way for sidewalk.
The City's share will be funded through CIP010C88 and City Sidewalk Project
350042.
RECOMMENDATION
It is recommended that the City Council give preliminary approval to the
Resolution of Necessity, to approve the preliminary assessment schedule, to
establish the date for the public hearing, and to authorize the City Clerk to
advertise for proposals.

PRELIMINARY APPROVAL OF PLANS AND SPECIFICATIONS
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the proposed plans, specifications, form of contract and estimated
cost for the Asbury Road Sidewalk Installation Project, in the estimated amount
of $132,107.58 are hereby approved and ordered filed in the office of the City
Clerk for public inspection.

Whereas, the City Council of the City of Dubuque, Iowa has given its
preliminary approval on the proposed plans, specifications, and form of contract
and placed same on file in the office of the City Clerk for public inspection of the
Asbury Road Sidewalk Installation Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That a Public Hearing will be held on the 6th day of June, 2005, at 6:30
p.m. in the Public Library Auditorium at which time interested persons may
appear and be heard for or against the proposed plans and specifications, form
of contract and cost of said improvement, and the City Clerk be and is hereby
directed to cause a notice of time and place of such hearing to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall be not less than four days nor more than twenty days prior to the day fixed
for its consideration. At the hearing, any interested person may appear and file
objections to the proposed plans, specifications, contract, or estimated cost of
the improvement.

RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the
City Council of the City of Dubuque and are now on file in the office of City Clerk
showing among other things the plans, specifications, form of contract, estimated
cost and preliminary plat and schedule showing the amount proposed to be
assessed against each lot and the valuation of each lot as filed by the City
Council, for the Asbury Road Sidewalk Installation Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public
welfare to make the herein mentioned improvements, and unless property
owners at the time of the final consideration of this proposed resolution have on
file with the City Clerk objections to the Resolution of Necessity, they shall be
deemed to have waived all objections pertaining to the regularity of the
proceeding and the legality of using the special assessment procedure.
Said improvements shall be constructed and done in accordance with the
plans and specifications which have been approved by the City Council and now
on file with the City Clerk. That the cost and expense of making such
improvement will be assessed partially or totally against privately owned property
lying with the assessment limits, and in an amount not to exceed that provided by
law, and in proportion to the special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from
Sales Tax Fund and special assessment bonds may be issued in anticipation of
deferred payments of assessments when a contract has been performed and
accepted, and the proceeds thereof used to pay the contractor.
The above resolution was introduced, approved and ordered placed on file
with the City Clerk this 2nd day of May, 2005.

against the making of the improvement, the boundaries of the district, the cost,
the assessment against any lot, or the final adoption of a Resolution of Necessity

time and place of such hearing to be published in a newspaper having general

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the Asbury Road Sidewalk Installation Project is hereby ordered to
be advertised for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the security to
accompany each bid shall be in an amount which shall conform to the provisions
of the Notice to Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements herein provided, to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall not be less than four days nor more than forty-five days prior to the receipt
of said bids at 2:00 p.m. on the 26th day of May, 2005. Bids shall be opened and
read by the City Clerk at said time and will be submitted to the Council for final
action at 6:30 p.m. on the 6th day of June, 2005.

have been heard and consideration given to all objections and is pending before
this Council; and
Whereas, this is the time and place set as provided for the taking of action
on the proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
Adopted, without amendment, and all objections filed or made having

NOTICE TO BIDDERS OF THE RECEIPT OF BIDS
FOR THE ASBURY ROAD SIDEWALK
INSTALLATION PROJECT
Sealed proposals will be received by the City Clerk of the City of Dubuque,
Iowa, at the Office of City Clerk in City Hall no later than 2:00 o'clock p.m. on the
26th day of May, 2005, for the Asbury Road Sidewalk Installation Project.
Proiect Description: The project consists of 3,428 lineal feet of sidewalk
installation on the north side of Asbury Road from John F. Kennedy Road to Iowa
32 (Northwest Arterial).
Copies of the construction documents may be obtained in the City
Engineer's office at the City Hall. No plan deposit is required.
Payment to the contractor will be made from funds as may be legally used
for such purposes.
All work herein provided for shall be commenced within ten (10) days after
the Notice To Proceed has been issued, and shall be fully completed by August
20, 2005.
For each calendar day that all work is fully completed prior to the specified
completion date of August 20, 2005, one percent (1 %) of the actual construction
costs will be given, to a maximum of five percent (5%) of the actual construction
costs, as an incentive to complete the project ahead of schedule. HOWEVER, IF
THE CITY AT ANY TIME EXTENDS THE COMPLETION DATE FOR ANY
REASON, NO INCENTIVE SHALL BE PAID, UNLESS THE CITY IN ITS SOLE
DISCRETION ELECTS TO PAY AN INCENTIVE.
For each calendar day that any work shall remain uncompleted beyond
the specified completion date of August 20, 2005, $1,000 per calendar day will
be assessed, not as a penalty but as predetermined and agreed liquidated
damages. The Contractor will be separately invoiced for this amount, and final
payment will be withheld until payment has been made of this invoice. If the City
extends the completion date, liquidated damages shall be calculated from the
extended completion date.
All bids must be submitted on the Bid Proposal Form bound in the
construction documents. Each bid shall be accompanied by a satisfactory Bid
Bond executed by the Bidder and an acceptable surety; or a cashier's or certified
check payable to the City Treasurer, City of Dubuque, drawn on a bank in Iowa
or a bank chartered under the laws of the United States, in the amount of ten
percent (10%) of the bids submitted as security that the bidder will enter into a
contract for doing the work and will give bond with proper securities for the
faithful performance of the contract in the form attached to the construction
documents.
The successful bidder (Contractor) will be required to furnish a
Performance Bond in an amount equal to one hundred percent (100%) of the
contract price. Said bond is to be issued by a responsible surety company
approved and acceptable to the City Council, and shall guarantee the faithful
performance of the contract and terms and conditions therein contained, and
shall guarantee the prompt payment of all materials and labor and protect and
save harmless the City of Dubuque, Iowa, from claims and damages of any kind
caused by the operations of the Contractor.
The successful bidder (Contractor) will also be required to furnish a
Maintenance Bond that will guarantee the material, workmanship and the
maintenance of the improvement(s) constructed for a minimum period of two (2)
years from and after its completion and acceptance by the City Council.
The successful bidder (Contractor) will also be required to furnish a
Payment Bond that will guarantee the prompt payment of all subcontractors,
suppliers, materials, labor and protect and save harmless the City of Dubuque,
Iowa, from claims and damages of any kind caused by the operations or non-
payment on behalf of the Contractor.
The Contractor and approved subcontractors will be provided a Sales Tax
Exemption Certification to purchase, or withdraw from inventory, materials
furnished under for this project.
No bid submitted by any Contractor which contains a condition or
qualification shall be recognized or accepted by the City Council and any letter or
communication accompanying the bid which contains a condition or qualification
upon the bid which has the effect of qualifying or modifying any provision of the
specifications in any manner will be rejected by the City Council as not
responsive.
All proposals must be made on blanks furnished by the City Engineer and
each bidder will be required to state his prices for doing all the items in each
section on which he makes a bid and for all things necessary to make a complete
job.
The Bidder's attention is directed to the City of Dubuque's Affirmative
Action Program which is included in the Contract Specifications and the
provisions thereof and hereby made a part of the Contract Documents by
reference and incorporated therein.
The Contractor, when requested by the City of Dubuque, will furnish a
statement of his financial and practical qualifications as provided for in the
General Requirements of the Specifications.
By virtue of statutory authority, a preference will be given to products and
provisions grown and coal produced within the State of Iowa and to Iowa
Domestic Labor.
The City Council reserves the right to reject any and all bids or to waive
any technical ties and irregularities.
All bids will be publicly opened and read by the City Clerk at 2:00 o'clock
p.m. on the 26th day of May, 2005, and will be submitted to the City Council for
final action at a meeting to be held in the Public Library Auditorium, 360 West
11th Street, at said City at 6:30 p.m. on the 6th day of June, 2005. A contract will
be awarded at that time or such subsequent time as the City may determine.

City Clerk of Dubuque, Iowa, a proposed Resolution of Necessity, an estimate of cost,
and a plat and schedule showing the amounts proposed to be assessed against each
lot and the valuation of each lot within a district approved by the City Council of
Dubuque, Iowa, for an improvement of the type(s) and in the location(s) as follows:

boundaries of the district, the cost, the assessment against any lot, or the final adoption
of a Resolution of Necessity. A property owner will be deemed to have waived all
objections unless at the time of hearing he has filed objections with the City Clerk.

Sidewalk Installation
TO: All Property Owners Within the Assessment District
Attached is your preliminary assessment for the Asbury Road, north side, John F. Kennedy Road to
Iowa 32 (Northwest Arterial) Sidewalk Installation as it was initiated for bidding purposes at the
May 2, 2005 City Council meeting.
As previously indicated property owners have the opportunity to install their sidewalk prior to June
27,2005 in order to be removed from the assessment project. Installation must be in accordance
with all City Standards and Specifications, with permit being obtained prior to commencement of
any work.
This is a preliminary notice and no payments are due at this time. After construction is complete, for
those properties constructed as part of the assessment project, the actual construction cost will be
calculated and a final assessment notice sent to the assessed property owner with payment
instructions. We anticipate the project to be completed in August 2005 and final assessments sent
