This is a claim for damages to the claimant's vehicle, which
he alleges it sustained when it hit an unmarked construction hole
on West 32nd Street. This is the second claim for the same
incident - Mr. Meehan originally filed a claim against the City on
February 9, 1998. That claim, on the recommendation of Mr. Mike
Koch, Public Works Director and City Engineer, was forwarded to
Winger Construction because of the indemnity clause in its contract
with the City. After an investigation by Winger's insurance
company, the claim was denied.
The claimant has been advised by the Legal Department to
contact Winger Construction Company directly concerning this claim.
It is the recommendation of the Legal Department that the claim be
administratively closed.
