A RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS 1 AND 2 OF LOOKOUT
POINT SUBDIVISION NO.2 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a plat of survey of Lot 1 and 2 of
Lookout Point Subdivision No. 2 in the City of Dubuque, Iowa; and
Whereas, said plat provides 0 feet of frontage for Lot 2, where 60 feet is required by
Section 42-1 9(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
.DUBUQUE, IOWA:
Section 1. That Section 42-1 9(b) of the Subdivision Regulations is waived to allow
Lot 2 to have 0 feet of frontage, where 60 feet of frontage is required, because Lot 2 has an
access easement to a public street.
Section 2. That the plat of survey of Lots 1 and 2 of Lookout Point Subdivision No.
2 is hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa, upon said final plat.

Plat of Survey of Lots 1 and 2 of Lookout Point Subdivision No.2
The submitted plat of survey is intended to allow the sale of a small piece of
property from the owner of what will be Lot 2 of Lookout Point Subdivision No.2
to the owner of Lot 1 of Lookout Point Subdivision No.2. The property being sold
is highlighted in yellow.
The submitted plat of survey is considered a simple plat; however, because Lot 2
of Lookout Point Subdivision No. 2 has no frontage on a public or private street.
The Zoning Advisory Commission and City Council are required to approve the
plat. Lot 2 currently has access to Mt. Carmel Road by way of the existing 10-
foot private driveway easement. Lot 1 has frontage on Grandview Avenue.
Planning Services staff do not anticipate any adverse impact to adjacent properties
if the submitted plat of survey is approved.
Planning Services staff recommend that the Plat of Survey of Lots 1 and 2 of
Lookout Point Subdivision No. 1 be approved, waiving the 50-foot lot frontage
requirement for Lot ')- of Lookout Point Subdivision No.2.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
revIew.
Discussion
The applicant spoke in favor of the request noting that he wishes to shift the existing
property line approximately 12 feet on two parcels he presently owns. Staff reviewed
that Lot 2 lacks frontage on a public street, but has an access easement.
The Zoning Advisory Commission discussed the request reviewing the possibility of
creating a BO-foot wide lot and the consequences of this type of plat.
Recommendation
By a vote of 4 to 2, the Zoning Advisory Commission recommends that the City
Council approve the request.
A simple majority vote is needed for the City Council to approve the request.
