A RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 OF LOT 1 AND LOT 2 OF LOT
1 OF DARWOOD ACRES SUBDIVISION IN DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a subdivision plat of Lot 1 of Lot 1 and Lot
2 of Lot 1 of Darwood Acres Subdivision in Dubuque County, Iowa; and
Whereas, said plat provides 0 feet of frontage for Lot 2 of Lot 1, where 60 feet is required by
Section 42-19(f) of the Subdivision Regulations; and
Whereas, upon said final plat appears John F. Kennedy Road; and
Whereas, the subdivision plat has been examined by the Zoning Advisory Commission and had
its approval endorsed thereon, with conditions; and

Whereas, said subdivision plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That the City Council hereby waives Article IV, Design and Improvement
Standards, of the Subdivision Regulations, except Section 42-19, Lots and Blocks.
Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 2
of Lot 1 to have 0 feet of frontage, where 60 feet of frontage is required, and that Lot 2 of Lot 1 be
designated as a "non-buildable lot", unless it is combined with an abutting lot that has frontage on
an approved public or private street.
Section 3. That the subdivision plat of Lot 1 of Lot 1 and Lot 2 of Lot 1 of Darwood Acres
Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa, upon said subdivision plat.

Subdivision, Dubuque County

INTRODUCTION
The submitted plat of survey subdivides the existing Lot 1 of Darwood Acres
Subdivision in Dubuque County into two lots. The plat of survey is considered a
simple plat; however, Lot 2 of Lot 1 has no frontage on a public or private street
and, thus, requires the Zoning Advisory Commission to waive the lot frontage
requirement.

DISCUSSION
The plat of survey of Lot 1 of Lot 1 and Lot 2 of Lot 1 of Darwood Acres
Subdivision is located in Dubuque County near the intersection of John F. Kennedy
Road and Derby Grange Road. Lot 2 of Lot 1 is being sold to the owner of the
property at 12578 John F. Kennedy Road. The purpose of this land sale is to
provide additional property in which to locate a new septic field for the property at
12578 John F. Kennedy Road. Dubuque County does not have the frontage
requirement that the City of Dubuque does. The proposed lot split will not result in
the construction of any additional housing units.
The resulting two lots both will be over an acre in size and, while Lot 2 of Lot 1 will
not have frontage on a public or private street, the future owner of Lot 2 of Lot 1
has frontage on John F. Kennedy Road through his existing lot.

RECOMMENDA TION
The submitted plat of survey of Lot 1 of Lot 1 and Lot 2 of Lot 1 of Darwood Acres
Subdivision in Dubuque County, Iowa is in substantial compliance with the City of
Dubuque Subdivision Regulations, except for Lot 2 of Lot 1 not having frontage on
a public or private street. Staff recommend that, as there are no additional housing
units to be constructed and that Lot 2 of Lot 1 will only serve as a drain field for a
new septic system, the Zoning Advisory Commission recommend approval of the
plat of survey subject to waiving the frontage requirement for Lot 2 of Lot 1.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.

Discussion
The applicant, Larry Tscharner, spoke in favor of the request noting that this new lot will
be behind his current lot and will not have frontage on a public right-of-way. No one spoke
in opposition to the request. Staff reviewed the platting process the applicant has
undergone with the County and why the City is reviewing this request. Staff noted that Lot
2 of Lot 1 lacks frontage on a public or private street.
The Zoning Advisory Commission discussed the request noting that Lot 2 of Lot 1 could be
sold to other neighbors and this would be built upon. The Commission discussed stipulating
that this lot be designated as an un-buildable lot to ensure that a residence is not built at
this location. Also they discussed platting this into one lot in the future.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request with the condition that Lot 2 of Lot 1 be designated as a "non-buildable
lot", unless it is combined with an abutting lot that has frontage on an approved public or
private street.
A simple majority vote is needed for the City Council to approve the request.
