Whereas, Ordinance 69-98 was adopted on November 2, 1998 by the City Council amending the PI Planned Industrial District for Dubuque Industrial Center; and Whereas, A. Y. McDonald Manufacturing Company, 4800 Chavenelle Road, has requested an amendment to the PUD Ordinance regulating on-premise primary signage allowed in the PI Planned Industrial District for Dubuque Industrial Center. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (the Zoning Ordinance) is hereby amended by repealing Section 2(E)(4)(C)(5) of Ordinance 69-98 and enacting a new Section 2(E)(4)(C)(5) in lieu thereof, as follows: Sign locations on lots. Building-mounted primary signs may be located on any facade of a building in the industrial park. Freestanding primary signs may be located anywhere on the building lot. Secondary signs may be located anywhere on the lot and on any building facade. No signs may project in space over a street or right-of-way line, any visibility triangle area, or onto another lot. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. 5. law. Section 3. McDonald Mfg. Co., I have submitted this application for a text amendment to the sign ordinance for the planned industrial district that A. Y. McDonald's manufacturing facility is loc~ted. This letter of explanation states the reasons why the text should be amended. . In 1983, A. Y. McDonald Mfg. Co. purchased a set of 5 ft. high letters for the back of their new building on Chavenelle Drive. The purpose of the letters was to identify the facility from the Hwy. 20 and Northwest Arterial corridors. A sign permit application was submitted and approved and the letters were installed in their present location. The development of businesses along the north side of highway 20 and the recent addition to the foundry building at A. Y. McDonald has blocked the vie~ of the sign. The people at A. Y. McDonald recently contacted me to have the letters relocated from the south face of the building to the east face of the building. This would again make the sign visible from both the Hwy. 20 and the Northwest Arterial corridors. I was notified by Planning Services that the signage ordinance had been rewritten back in 1990 and that a variance would be required in order to relocate the sign letters on the building. I was later notified that this application would need to go through a text amendment proceedure rather than a variance proceedure. When the ordinance was rewritten, one of the restrictions implemented was that "Primary signs may be located only in the area enclosed by the street right-of- way line, the line formed by the street facade of the building and the side lot lines." In short, the primary signage, both freestanding and building mounted, would have to be located in the "front yard" of the building. The existing SlgO falls within the allowed square footage but does not conform to the location restrictions of the rewritten ordinance. The letters could be moved to the Chavenelle (north) face of the building, however, there is no need to have the letters on the front of the building. . Some buildings may be situated so that their primary building mounted signage would work better on an elevation of the building other than the elevation that faces the street. In this particular instance, the building faces Chavenelle Drive but the parking lot, employee and visitor entrances are either located on or are accessed from the east elevation of the building. Both myself, and the people at A. Y. McDonald Mfg. Co., request that the text be amended to allow for building mounted primary signage on all facades of a building in the industrial park. Co. intends on removing the existing letters and replacing them with new letters that will be installed on the east face of the building. There was one letter ~N~ destroyed by the last windstorm. FROM: SUBJECT: Dubuque Industrial Center Text Amendment INTRODUCTION Larry Weitz Sign Systems, Inc. has submitted an application requesting an amendment to the PI Planned Industrial District PUD Planned Unit Development on behalf of A.Y. McDonald Manufacturing Company. The request is to modify the text of the sign regulations to allow for building-mounted primary signage on all facades of a building in the Dubuque Industrial Center. The subject PUD was amended in November of 1998 to change the list of allowed uses for lots fronting Radford Road. DISCUSSION A. Y. McDonald Manufacturing Company presently has a wall sign on the south wall of their building. Chavenelle Road is to the north, the Northwest Arterial to the east, and Highway 20 to the south. The area of that signage is approximately 412 square feet (82.5 feet long by 5 feet high), which is well below what is allowed. Due to business expansion and changes to the surrounding property, the applicant has stated that the present location of the sign does not effectively serve its purpose. The PI District ordinance for the Dubuque Industrial Center, which includes A.Y. McDonald Manufacturing Company, regulates signage differently than the Zoning Ordinance. Specifically, it identifies regulations pertaining to primary signs. The regulations that the applicant is requesting to change are those in Section 2(E)(4)(C)(5). That section states: "Primary signs may be located only in the area enclosed by the street right-of-way line, the line formed by the street facade of the building and the side light lines." This language was established by previous ordinances and was adopted by the ordinance approved on November 2, 1998. . . . Dubuque Industrial Center Text Amendment Page 2 That application was submitted in July of 1998. It appears that the language of the ordinance would suffice for freestanding signs. A freestanding sign in compliance with the current ordinance could be installed with the copy facing in any direction, thereby providing flexibility in where the business is seeking visibility. That flexibility is not evident for wall-mounted signs in the current ordinance. A. Y. McDonald has stated that relocating the sign to the east facade of the building would make it visible from Highway 20 and the Northwest Arterial. Signage on the north wall, which would be in compliance with the ordinance, would not provide visibility to the Northwest Arterial or Highway 20. Based on these circumstances, A. Y. McDonald has requested a modification to the ordinance to allow building-mounted primary signs to be located on all facades of a building in the industrial park. Attached is a copy of the sign regulations from the recently adopted ordinance for the Commission's review. The applicant has submitted a two-page letter, a short synopsis of the type of sign that would be installed, a site plan showing the approximate location of the existing sign, as well as the proposed sign, and an elevation of the proposed sign. ACTION STEP Staff recommend that the Commission members review Section 3-5.5(F) of the Zoning Ordinance which establishes the standards for approval of a PUD. The application, staff report and related materials are attached for your review. Discussion The applicant, Dave Schultz, spoke in favor of the request to amend the PI Planned Industrial District for the Dubuque Industrial Center by changing Section 2(E)(4)(C)(5) on-premise primary signs to allow sign age on any building facade. He noted that the amendment was requested on behalf of A. Y. McDonald Manufacturing Company at 4800 Chavenelle Road, to relocate an existing sign. He reviewed the request noting that the existing language in the PI Planned Industrial District does not allow enough flexibility for placement of signs considering the unique nature of several of the buildings in the PI Planned Industrial District relative to their street frontage. Staff Member Mark Noble reviewed the ordinance language and how the proposed language would impact the location of signs within the PI Planned Industrial District. He reviewed the history of the existing signage at this site. The Zoning Advisory Commission discussed the change noting that no adverse impacts are anticipated by approving the new language. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. Whereas, Ordinance 69-98 was adopted on November 2, 1998 by the City Council amending the PI Planned Industrial District for Dubuque Industrial Center; and Whereas, A. Y. McDonald Manufacturing Company, 4800 Chavenelle Road, has requested an amendment to the PUD Ordinance regulating on-premise primary signage allowed in the PI Planned Industrial District for Dubuque Industrial Center. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (the Zoning Ordinance) is hereby amended by repealing Section 2(E)(4)(C)(5) of Ordinance 69-98 and enacting a new Section 2(E)(4)(C)(5) in lieu thereof, as follows: ........ .' 5.
