RESOLUTION APPROVING PLAT OF PROPOSED VACATED MCCLAIN STREET
AND ADJACENT ALLEY
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated January 12, 1999, prepared by IIW Engineers and Surveyors, P.C.,
describing the proposed vacated portion of McClain Street lying southwesterly of Clara
Street and a portion of a 20 foot wide alley lying between Lot 1 and Lot 2 of Watters
Subdivision No.2 in the City of Dubuque; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the plat dated, January 12, 1999, prepared by IIW Engineers
and Surveyors, P.C., relative to the real estate hereinabove described by and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby authorized
and directed to execute said plat for and on behalf of the City of Dubuque, Iowa.
. Section 2. The City of Dubuque reserves unto itself a perpetual easement 10
feet in width including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, t.V. cable, and electric lines as
may be authorized by the City of Dubuque, Iowa, as shown on the plat of Lot 2A of
Watters Subdivision No.2.
Section 3. That the City Clerk be and is hereby authorized and directed to file
said plat and certified copy of this resolution in the office of the Recorder, in and for
Dubuque County, Iowa.

RESOLUTION APPROVING PLAT OF PROPOSED VACATED MCCLAIN STREET
AND ADJACENT ALLEY
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated January 12, 1999, prepared by IIW Engineers and Surveyors, P.C.,
describing the proposed vacated portion of McClain Street lying southwesterly of Clara
Street and a portion of a 20 foot wide alley lying between Lot 1 and Lot 2 of Watters
Subdivision No.2 in the City of Dubuque; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1 . That the plat dated, January 12, 1999, prepared by IIW Engineers
and Surveyors, P.C., relative to the real estate hereinabove described by and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby authorized
and directed to execute said plat for and on behalf of the City of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual easement 10
feet in width including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, t.V. cable, and electric lines as

Whereas, the Dubuque Lodging, Inc. has requested the vacating of McClain
Street lying southwesterly of Clara Street and a portion of a 20 foot wide alley lying
between Lot 1 and Lot 2 of Watters Subdivision No.2 in the City of Dubuque.
Whereas, IIW Engineers and Surveyors, P.C. have prepared and submitted to the
City Council a plat showing the vacated portion of McClain Street lying southwesterly
of Clara Street and a portion of a 20 foot wide alley lying between Lot 1 and Lot 2 of
Watters Subdivision No.2 in the City of Dubuque and assigned lot numbers thereto,
which hereinafter shall be known and described as Lots 1 A and 2A of Watters
Subdivision No.2 in the City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that
portions of this street and alley are no longer required for public use, except for utility

This issue has been discussed with Bill Stoner, Right of Way Property Management, Ames,
Bruce Chrystal, MOA, Dyerville, Mike Koch and Mike VanMilligan.

SUBJECT: Vacating Petition - McClain Street and Adjacent Alley

Public Works Director Mike Koch is recommending that a public hearing be set for
February 15, 1999, to consider a request from John R. Van Duyn, representing
Dubuque Lodging, Inc., d/b/a Days Inn - Dubuque, for the vacation and sale of
McClain Street south of Clara Street and a portion of a twenty foot wide alley
between McClain Street and Hill Street. Two excess right-of-way parcels left over
from the U.S. 20 project would also be sold.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
.
This is in response to a request from John R. Van Duyn, representing Dubuque
Lodging, Inc., d/b/a Days Inn - Dubuque for the vacation of McClain Street south of
Clara Street and a portion of a 20 foot wide alley between McClain Street and Hill
Street. Two excess right-of-way parcels leftover from the U.S. 20 Project would also
be sold.
DISCUSSION
The attached plat shows the areas proposed street and alley to be vacated. The
abutting properties are owned by Dubuque Lodging, Inc. and the City of Dubuque. The
current use of these properties is as a public street to the Days Inn. This street would
then become a private driveway to the Days Inn, and future maintenance would be
their responsibility. Days Inn is also interested in the installation of a business sign on
this property near the Hill Street traffic signals.
The areas to be vacated have been platted into two lots numbered Lot 1 A and Lot 2A
of Watters Subdivision No.2 in the City of Dubuque, Iowa. Lot 1 A is part of an
existing 20 foot wide alley between McClain Street and Hill Street. Lot 2A is a part
of McClain Street south of Clara Street. A perpetual easement along the easterly 10
feet of McClain Street will be maintained for the protection of existing public utilities.

The above vacated properties are to be combined with excess I.D.O.T. parcels platted
as Lot 1 and 2 of Watters Subdivision No.2 dedicated to the City and accepted by the
City Council at the November 2, 1998 Council meeting. Because maintenance of the
access road would become the responsibility of the Days Inn, the City has agreed to

transfer ownership at no cost, except for platting, publication and filing fees. A map
showing all the above parcels is attached.
RECOMMENDA TION
The City has no plans for the utilization of Lots 1, 1 A, 2 and 2A of Watters
Subdivision No.2 to be vacated, except for reserving the utility easement as noted.
I would recommend that the areas indicated by Lots 1 A and 2A of Watters Subdivision
No.2 on the attached plat be vacated, and that a public hearing be set for February
15, 1999 for the disposition of the City's interest in vacated Lots 1 A and 2A; and the
excess U.S. 20 parcels, Lot 1 and Lot 2, all of Watters Subdivision No.2. I would
further recommend that the purchase price be established as the cost of platting,
publication and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the enclosed
resolutions and ordinance.
