RESOLUTION APPROVING PLAT OF ALLISON PLACE AND A 20-FOOT ALLEY
ABUTTING THE NORTHWESTERLY LINE OF LOT 12 OF FINLEY HOME
ADDITION
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated January 27, 1999, prepared by IIW Engineers and Surveyors, Inc.
describing the proposed vacated Allison Place and a 20-foot alley abutting the
northwesterly line of Lot 12 of Finley Home Addition; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the plat dated January 27, 1999, prepared by IIW Engineers
and Surveyors, P.C., relative to the real estate hereinabove described be and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby authorized
and directed to execute said plat and on behalf of the City of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a permanent easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water,
sewer, drainage, gas, telephone, t.V. cable, and electric lines as may be authorized by
the City of Dubuque, Iowa.
Section 3. That the City Clerk be and is hereby authorized and directed to file
said plat and certified copy of this resolution in the office of the Recorder, in and for
Dubuque County, Iowa.

Vacating Petition - Allison Place and Adjacent Alley
INTRODUCTION
This is in response to a request from James Sinek, representing the Finley Hospital for
the vacation and sale to Finley Hospital of Allison Place and a 20 foot alley abutting
the northwesterly line of Lot 12 of Finley Home Addition.

DISCUSSION
The attached plat shows the areas of proposed Allison Place and a 20 foot alley
abutting the northwesterly line of Lot 1 2 of Finley Home Addition to be vacated. The
abutting properties are owned by the Finley Hospital.
The area to be vacated is divided into one lot numbered Lot 2A of Finley Home
Addition in the City of Dubuque, Dubuque County, Iowa. Lot 2A of Finley Home
Addition is an existing street and an alley on which public utilities exist. The City has
tentatively agreed to grant Finley Hospital an exclusive option to purchase said real
estate within two years for a $5,000.00 non-refundable payment. If the option is
exercised, this fee will be credited against the purchase price. The City of Dubuque
will be responsible for maintenance of the street and utilities until Finley Hospital
exercises the option and makes payment of the purchase price in full. The property
would be conveyed by Quit Claim Deed.
The property value has been agreed to at $28,945.00.

RECOMMENDA TION
The City has no plans for the utilization of Allison Place and the 20 foot alley abutting
the northwesterly line of Lot 12 of Finley Home Addition proposed to be vacated,
except for reserving an easement for the utilities as noted.
I would recommend that the City of Dubuque agree to an exclusive option to purchase
said real estate within a two year period from the date of Council approval subject to
the conditions outlined in the Option to Purchase dated February 15, 1999.
I would further recommend that the area described as Lot 2A of Finley Home Addition
in the City of Dubuque, Dubuque County, Iowa on the attached plat be vacated, and
that a public hearing be set for the disposition of the City's interest in the subject area
on February 15, 1999. I would further recommend that the purchase price be
established at $28,945.00, plus platting, publication and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the option to purchase and the disposal of the property
through adoption of the enclosed resolutions and ordinance.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 2 A OF
FINLEY HOME ADDITION IN THE CITY OF DUBUQUE, IOWA
Whereas, the Finley Hospital has requested the vacating of Allison Place and a
20 foot alley abutting the northwesterly line of Lot 12 of Finley Home Addition; and
Whereas, IIW Engineers and Surveyors, P.C. has prepared and submitted to the
City Council a plat showing the vacated portion of Allison Place and a 20 foot alley
abutting the northwesterly line of Lot 12 of Finley Home Addition and assigned a lot
number thereto, which hereinafter shall be known and described as Lot 2A of Finley
Home Addition in the City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that
Allison Place and a 20 foot alley abutting the northwesterly line of Lot 12 of Finley
Home Addition is no longer required for public use, except for utility easements as
noted, and vacating and sale of said portions of alleys and streets known as Lot 2A
of Finley Home Addition in the City of Dubuque, Dubuque County, Iowa should be
approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
. DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot
2A of Finley Home Addition in the City of Dubuque, Iowa, as set-forth in the Option
to Purchase" for Lot 2A of Finley Home Addition in the City of Dubuque, Iowa
providing for an exclusive offer to purchase within 2 years by the Finley Hospital for
the sum of $5,000.00. A copy of the Option to Purchase is on file at the Office of the
City Clerk, City Hall, Dubuque, Iowa. The option payment shall not be refundable if
the option is not exercised. If the option is exercised, the entire option fee shall be
credited against the $28,945.00 purchase price, plus cost of platting, publication and
filing fees at closing.
Section 2. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to enter into the "Option to Purchase" and to dispose of said
real estate, to be published in the manner as prescribed by law.

RE: Vacating of Allison Place
Dear Mayor Duggan and City Council Members:
This letter is in response to the November 3. 1998 letter I received from Mr. Michael A. Koch. Public Works Director,
outlining a process which both the City of Dubuque and The Finley Hospital agree upon for vacating the Allison Place
property.
I applaud Mr. Koch and the City Council's flexibility in designing a vacating process which accommodates both parties'
needs. As outlined in Mr. Koch's letter, the steps and conditions involved in vacating the property include:
.
I) The Finley Hospital platting the subject property; 2) The City of Dubuque holding a public hearing on the sale of said
property to The Finley Hospital. The sale of said property would not occur until the property was needed by the hospital
for expansion of services; 3) The City of Dubuque would grant an exclusive option to The Finley Hospital to purchase said
property within a two year time period at the purchase price set at $28,945.00 plus platting, publication and filing fees;
4) On the date that the City grants the exclusive option to Finley, Finley would execute a $5,000 non-refundable payment
for said option. This dollar amount would be applied toward the purchase price once Finley executes the exclusive option;
and 5) Until such time that said exclusive option is exercised by Finley, the property would remain under the ownership
and maintenance of the City of Dubuque.
As I understand it, this process would require only one public hearing and the terms and conditions of the vacating
agreement between the City of Dubuque and The Finley Hospital would be binding for a two year period within which
Finley could at any time execute the exclusive option to purchase the Allison Place property.
To date, The Finley Hospital has completed the survey plat for the Allison Place property. I have enclosed copies of the
plat of survey for the property to be vacated and have also enclosed the surveyor's certificate. Having completed the
survey plat and having, by this letter, concurred with the city's terms for vacating Allison Place and the exclusive option to
purchase said property, as identified in Mr. Koch's letter, I would request that the City Council prepare the specific option
language and set this matter for the Dubuque City Council agenda as soon as possible.
If the City Council has any questions or requires any additional information, please feel free to contact me. We will be
happy to respond to your request.
Again, thank you for your time and effort in this matter and we appreciate the flexibility and the professional services we
have received from the various representatives of City Government.
