Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on 5th day of February , 1999,
the City Council of the City of Dubuque, Iowa met on the 15th day of _
Fel:ruary , 1999, at 7:00 p.m. in the Public Library Auditorium, 11 th and
Locust, Dubuque, Dubuque, County, Iowa to consider the proposal for the sale of real
estate described as:
Lots 1, 1 A, 2 and 2A of Watters Subdivision No.2 in the City of Dubuque,
Dubuque County, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate, except for easement
as noted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lots
1, 1 A, 2 and 2A of Watters Subdivision No. 2 in the City of Dubuque, Iowa to
Dubuque Lodging, Inc. be and the same is hereby approved for cost of publication and
filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. The City of Dubuque reserves unto itself a perpetual easement 1 0
feet in width including the right of ingress and egress thereto, for the purpose of
erecting, installing, construction, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, t.V. cable, and electric lines as
may be authorized by the City of Dubuque, Iowa, as shown on the plat of Lot 2A of
Watters Subdivision No.2 in the City of Dubuque.
Section 3. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Dubuque Lodging, Inc. upon receipt of the purchase price in full.
Section 4. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.

Notice is hereby given that the Dubuque City Council will conduct a public hearing on
Monday, February 15,1999 at a meeting to commence at 7:00 P,M. in the Public
Library Auditorium for the purpose to consider disposing of City's interest in Lots 1A and
2A of Watters Subdivision NO.2 to Dubuque Lodging, Inc, contingent upon payment of
publication and filing fees, (Said real estate is that portion of vacated McClain Street
lying southwesterly of Clara Street and a portion of a 20 foot wide alley lying between
Lot 1 and Lot 2 of Watters Subdivision NO.2 in the City of Dubuque.) (Copies of
supporting documents are on file in the City Clerk's Office and may viewed during
normal working hours.)
Written comments regarding disposal of said property may be submitted to the City
Clerk on or before time of public hearing.
At said time and place of public hearing, all interested citizens and parties will be given
an opportunity to address the Council regarding above disposal.
Any visual or hearing impaired persons needing special assistance or persons with
special accessibility needs should contact the City Clerk's Office at (319) 589-4120 or

Vacating Petition - McClain Street and Adjacent Alley

Public Works Director Mike Koch is recommending that a request from John R. Van
Duyn, representing Dubuque Lodging, Inc., d/b/a Days Inn - Dubuque, for the
vacation and sale of McClain Street south of Clara Street and a portion of a twenty
foot wide alley between McClain Street and Hill Street, be approved and that
ownership be transferred at no cost, except for platting, publication and filing fees.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Section 2. The City of Dubuque reserves unto itself a perpetual easement 1 0
feet in width including the right of ingress and egress thereto, for the purpose of
erecting, installing, construction, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, t.v. cable, and electric lines as
may be authorized by the City of Dubuque, Iowa, as shown on the plat of Lot 2A of
Watters Subdivision No.2 in the City of Dubuque.
Section 3. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Dubuque Lodging, Inc. upon receipt of the purchase price in full.
Section 4. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.
