RESOLUTION APPROVING RESIDENTIAL PROPERTY TAX EXEMPTION
APPLICATIONS SUBMITTED BY PROPERTY OWNERS IN RECOGNIZED URBAN
REVITALIZATION AREAS AND AUTHORIZING THE TRANSMITTAL OF THE
APPROVED APPLICATIONS TO THE CITY TAX ASSESSOR
Whereas, the Urban Revitalization Act allows cities to give property tax exemptions for
improvements made to properties in designated revitalization areas; and
Whereas, the Urban Revitalization Act requires property owners to submit a written
application for exemption by February 1st of the assessment year for which the exemption is first
claimed, and further requires the City Council to approve all applications that meet the requirements
ofthe adopted Urban Revitalization Plan and forward the approved applications to the City Assessor
for review by March 1 st of each year; and
Whereas, pursuant to the requirements of said Urban Revitalization Act, the following Urban
Revitalization Areas were established: Cathedral Gardens, Jackson Park, Holy Trinity, Washington
Street, West 11th Street, Windsor Park, Sacred Heart Place, Upper Main and Stout Place; and
. Whereas, the City Clerk of the City of Dubuque, as of February 1, 1999, received tax
exemption applications from the following property owner for property located within established
urban revitalization districts:

Whereas, the Community and Economic Development Department and the Housing Services
Department have reviewed the above described applications, have inspected the properties, and have
determined that the applications and the improvements conform to all requirements of the City of
Dubuque's Urban Revitalization Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the above-described tax exemption applications meet the requirements of
the City of Dubuque's Urban Revitalization Program.
Section 2. That the above described tax exemption applications are hereby approved by
the City Council, subject to the review and the approval of the City Assessor.
Section 3. That the City Clerk of the City of Dubuque is hereby authorized to forward the
above described tax exemption applications to the City Assessor.

INTRODUCTION
This memorandum submits for City Council review and approval the following resolutions:
1. A resolution approving the 1998 applications for residential property
tax exemptions filed in accordance with the Dubuque Urban
Revitalization Program; and
2. A resolution approving the late filing of applications by three property
owners for improvements made in prior years.
BACKGROUND
History of Program
In 1980, the City Council established, under the guidelines set forth in Chapter 404 of the Code
of Iowa, the Dubuque Urban Revitalization Program. The program was designed to provide a
partial tax exemption for qualifying residential property owners. The intent of the Council was
to stimulate private investment in deteriorating neighborhoods and to stabilize, perhaps even
increase, the tax base within those areas.
Four residential neighborhoods have been designated as Urban Revitalization areas: Jackson
Park, Upper Main, Washington Street, and West Eleventh Street. Individual residential
properties have also been declared as eligible project areas: Cathedral Gardens, Holy Trinity,
Sacred Heart Place, Windsor Park and the Stout Place (Iowa Inn).
Application Process
Applications for tax abatement are accepted on an annual basis. Each request is reviewed to
ensure that the properties in question are located within an Urban Revitalization Area and that
the improvements are completed in general conformance with the plan developed for that

particular property or neighborhood. The applications are then forwarded to the City Council for
consideration. If the City Council finds them to be in compliance with the appropriate Urban
Revitalization Plan, they are routed to the City Assessor who inspects the properties, determines
the assessable value of the new improvements and transmits this information to the County
Auditor. Applications must be received by the City Assessor by March 1, 1999, to receive the
abatement.
Once approved, property owners receive a ten (10) year tax exemption for one hundred (100)
percent of the assessed valuation of qualifying improvements.
Late Filings
Included within each of the four Urban Revitalization District Plans is a provision which permits
the City Council to accept tax abatement requests for improvements in prior years, even though
the filing deadline has passed. To approve such a request the City Council must adopt a
resolution allowing the property owner to submit the application of another filing period. The
property owner is then entitled to an abatement for the remainder of the ten year abatement
period, subject to review and approval by the City Assessor. The property owner cannot file for
abatement if the ten year abatement period has passed. In February 1994, the City Council
adopted Resolution No. 53-94 establishing the standards to be used in the review of untimely
requests for residential property tax abatement. The standards provide that the Council will
consider each request against the following:
1. The extent to which the project supports the specific goals and
objectives of the Urban Revitalization Plan developed for the district
or the individual property; or
2. The extent to which the project supports the creation or retention of
affordable housing for community residents.
This year, the City of Dubuque has received requests for late filing on four properties. These
applications are for improvements made prior to 1998.
DISCUSSION
This year a total of twenty (20) applications for property tax abatement were received by the
February 1 deadline. Information concerning these applications is contained in Attachment A.
Each application has been reviewed by the Community and Economic Development Department
and been found to be located within a designated Urban Revitalization Area and in general
conformance with the adopted revitalization plan. Housing Services staff has, as noted in the
accompanying report (Attachment B), inspected the properties and found each to be improved as
indicated by the applicant. The estimated value of improvements is approximately $595,495.00,
as provided by property owners on the application.

These estimates were calculated using the 1997 millage rate and rollback figures from the City
Assessor's office. Figures for 1998 are not yet available. It is the opinion of the City Assessor
that the actual impact on the City revenue for the above mentioned properties would be less than
what is estimated using the rates provided.
RECOMMENDATION
I recommend that the City Council approve the applications for tax abatement including those
which were filed for prior years and forward them to the City Assessor for final review and
approval. Staff review has found that the applications are consistent with the objectives of the

various urban revitalization districts and support the retention of affordable housing for
community residents.
ACTION
The requested action is for the City Council to:
1. Receive and file the eligible tax exemption applications and the
accompanying Housing Services report, adopt the attached resolution
accepting the applications and forward them to the City Assessor.
2. Receive and file the late tax exemption filings of B & W Properties,
Mark and Vickie Klinkhammer and Cecelia Boehm and the
accompanying Housing Services report; adopt the attached resolution
accepting the late applications and forward them to the City Assessor.

RESOLUTION APPROVING RESIDENTIAL PROPERTY TAX EXEMPTION
APPLICATIONS SUBMITTED AFTER THE LEGISLATED FILING DATE BY
PROPERTY OWNER IN A RECOGNIZED URBAN REVITALIZATION AREAS AND
AUTHORIZING THE TRANSMITTAL OF THE APPROVED APPLICATIONS TO
THE CITY TAX ASSESSOR
Whereas, the Urban Revitalization Act, as enacted by the 68th General Assembly of the
State of Iowa, allows cities to give property tax exemptions for improvements made to properties
in designated revitalization areas; and
Whereas, the Urban Revitalization Act requires property owners to submit a written
application for exemption by February 1st ofthe assessment year for which the exemption is first
claimed, yet provides for the acceptance, by Resolution of the City Council, of applications filed
beyond the legislated deadline; and
Whereas, the City Clerk of the City of Dubuque has received tax exemption applications
for improvements made in previous years from the following property owners for properties
located within established urban revitalization districts:
.
West 11 th Street Urban Revitalization District:
B & W Properties for improvements made in 1997 at 423 Loras Boulevard.
B & W Properties for improvements made in 1995 at 1091 Center Place.
Mark and Vickie Klinkhammer for improvements made in 1997 at 1630 Cornell Street.
Washington Street Urban Revitalization District
Cecelia Boehm for improvements made in 1996 at 1852 White Street.
Whereas, the Community and Economic Development Department and the Housing
Services Department have reviewed the above-described applications have inspected the
property, and have determined that the application and the improvements conform to all
requirements of the City of Dubuque's Urban Revitalization Program and its policy regarding the
acceptance of late filings.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the above-described tax exemption applications meet the requirements of
the City of Dubuque's Urban Revitalization Program.
. Section 2. That the above described tax exemption applications are hereby approved by
the City Council, subject to the review and the approval of the City Assessor.
